The wetland and waterway boundaries were concurred with by DSL on April 9, 2015 and these are the resources considered to be state and federally jurisdictional. As described in the delineation report and Impact Evaluation for Environmental Review Ruby Creek and two wetlands totaling 0.15 acres were identified. ‘The Incomplete Letter for LU 16-213734 indicates that all “ponds, seeps, springs and other drainageways” noted in the geotechnical report and impact evaluation report must be mapped on the project plans and protected. ‘The Geotechnical report describes on Page 4 “an area of concentrated flow in a zone about 100 fect wide in the area of Lot 6. At the head of this overland flow zone is a roughly 15-foot by 20-foot area where neighbors report that seasonal ponding of surface water occurs.” Additionally, “stormwater discharge pipes from the properties [that face SW Ruby Terrace above the site] contribute to the ponded water and overland flow discussed above.” On Page 6 the same area is referenced, “Perched groundwater ...is ponded along the western site boundary.” ‘This area was assessed by S&A and a sample plot taken to document conditions (SP A). S&A determined no jurisdictional wetland, water or seep was present in this location therefore there is nothing to map. As deseribed in the delineation report, “A small depression was identified... A ditched outlet was connected with this depression... Soils were not hydric... The area appeared to be excavated...” This area did not meet the three wetland criteria, and is not a wetland or water of the state, ‘The Landslide Hazard Assessment included with the Geotechnical Report also references “steep drainages” associated with landslides. As shown on Figure 4 of that report (included with this memo) these drainages consist of (2) Ruby Creek as well as identified features (1), (3), and (4) all of which are outside the project area. Feature 3 appears to originate at the eastern property boundary. S&A assessed this area during the delineation and located a sample plot just above it at the lowest point onsite (SP 8).
