AFFIDAVIT OF DESISTANCE

I, YURI D. YORKIE, Filipino, of legal age, single, and with residence at 1000
Blumentritt Sta Cruz Manila, having been duly sworn in accordance with law, hereby depose and
state:

1. That I am the complaining witness against accused Y, in the case entitled People of the
Philippines vs Y criminal case No. 123456 for allege RAPE WITH HOMICIDE WITH
AGGRAVATING CIRCUMSTANCES OF DWELLINGAND ARMED WEAPON, which is
pending before the Regional Trial Court Branch 15, City of Manila, Philippines.

2. That I filed and signed the aforesaid complaint against accused Y partly due to coercion and
intimidation exercised over me by my parents to name a perpetrator;

3. That I signed the aforesaid complaint against name accused without absolute certainty as to his
involvement in the crime committed against me;

4. That since I am uncertain of his liability, I am permanently withdrawing my complaint against

Y and thereby clear him from any responsibility towards me;

5. That I respectfully request the above mentioned complaint be withdrawn and dismissed and I
further manifest that I am desisting from testifying against named accused in court or in any
other proceeding related to said criminal case.

IN WITNESS WHEREOF, I have set my hand that this 3rd day of February 2017, in
