Dear Sisters and Brothers in Christ,

During the forty days of Lent as we begin our journey to the foot
of the cross we may ask ourselves, How can I develop a closer
relationship with Christ? What will I sacrifice during Lent? What can
I do that will benefit the less fortunate? These questions are answered by
the Church which asks us to pray, fast and give alms, a tradition that finds
its roots in the Old Testament.
Our first call is to prayer. Lent is essentially an act of prayer
spread over 40 days. Prayer sustains and nurtures our relationship with Masses 8am 12noon 6pm
God. It is a process of listening to Gods daily call, then responding.
Without prayer, personal and communal, this relationship is diminished,
sometimes to the point of complete silence on our part.

consistent part of our Catholic tradition. By fasting and self-denial, by
living lives of moderation we have more energy to devote to God's

CANONICAL- LITURGICAL FORUM

Tithing and Simony/Mass Stipend
Dear Father Gem: I have two questions that I think I
need to be clarified about Tithing and Simony/Mass
Stipend. Firstly, I came across this text from the Decree of
the Council of Trent, Session 25, Chapter 12, that says: The
Holy Synod, therefore, enjoins on all, of whatsoever rank
and condition they be, to whom the payment of tithes
belong, that they henceforth pay in full the tithes, to which
they are bound in law, to the cathedral church, or to what
other churches they are lawfully due. And they who either
withhold them, or hinder them [from being paid], shall be
excommunicated
Secondly, in our faithgroup discussion, a question came up
with regard to simony and buying a Mass. Please as Buying a Mass. A Mass stipend is a free-will offering given
explain the concept of a stipend being offered for a Mass for
a deceased person; non-Catholics (and Catholics, as well)
find it confusing. Was not the value of the Mass already
purchased by the sacrificial death of Jesus? What, exactly,
is being bought?

Dear D.R.: The concept of tithing, or giving 10% of ones wealth,
is of pre-Christian origin, and in fact a reference to it may be
found in the Book of Genesis:
Melchizedek, king of Salem, brought out bread and wine,
and being a priest of God Most High, he blessed Abram with
these words: Blessed be Abram by God Most High, the Creator
of heaven and earth. And blessed be God Most High, Who
delivered your foes into your hand. Then Abram gave him a
tenth [i.e., a tithe] of everything (Gen. 14:18-20).
I think I have to categorically say that just because the
Church promulgated a law in centuries past, doesnt mean its still
in effect. Canon 6.1 states right at the beginning of the current
Code of Canon Law that among other things, the previous (1917)
Code and other laws which are contrary to the New Code were
abrogated once the New Code took effect in late 1983. Canons
from the Council of Trent are thus of great historical interest, but
they do not constitute current law!
The current Code does indeed address the issue of
supporting the Church, and its wording is very different from that
of the 16th-century Council of Trent. Canon 222 asserts that the
Christian faithful are obliged to provide for the needs of the
Church, so that the Church has available to it that which is
necessary for divine worship, for works of the apostolate and of
charity, and for the worthy support of its ministers. Lets take this
canon apart and look at its various components.
First of all, the Code freely acknowledges that the Church
needs material goods in order to function. In order to celebrate
Mass, for instance, it needs gold or gilded vessels, suitable
priestly vestments, candles, bread and wine none of which is
free. The Church also dispenses charitable aid to the needy,
which obviously doesnt grow on trees either. Lastly, the canon
specifically notes that its ministers deserve suitable financial
support, a point reiterated later in canon 281.1. All of this
naturally requires money.
But note that canon 222 says absolutely nothing about
tithing much less does it attach the penalty of excommunication

to anyone who fails to tithe. In fact, the current law provides no
numerical figures or calculations at all. God bless a cheerful giver
though.
As regards to your second question, Simony, which is the
buying or selling of spiritual things, is sinful and, therefore,
unacceptable. The term takes its origin from the Acts of the
Apostles, where (in Chapter 8) a man named Simon the Magician
sought to purchase from St. Peter the spiritual power derived
from the imposition of hands and the invocation of the Holy Spirit.
Examples of simony would be to seek ecclesiastical
promotion through a cash gift or to attempt to bribe a priest to
receive sacramental absolution.
Mass stipends are not simony, and there is no such thing
for celebrating a Mass for a particular person or intention. In the
early church, it was often the sole source of a priests income and
support, and in poorer countries, it sometimes still is.
You are correct that the merits of Christs redemptive
death are infinite. A Mass intention is simply a plea to the Lord to
channel some of those already-gained merits in a particular
direction.
The churchs Code of Canon Law takes pains to avoid the
appearance of buying a Mass by explaining that the poor are
never to be denied a request for a Mass because of their inability
to provide the customary offering (No. 945) and by forbidding a
priest from keeping for himself more than one Mass stipend per
day (No. 951).
Like most priests, I have on a number of occasions
declined to accept a stipend because I thought it might be a
hardship for the person requesting the Mass intention. (In many
U.S. dioceses, the suggested offering is $10 or $15.)
Despite these canonical cautions, the misunderstanding
persists, and nearly every week a caller or visitor to our parish
office will ask, How much does a Mass cost?
I use that as a teachable moment to the point where our
parish staff is tired of hearing me explain a free-will offering. My
preference would be that Mass stipends be eliminated entirely,
but many priests, particularly in missionary territories, depend on
them for their livelihood.
So what can we conclude from all this? First of all, the
canons of the Council of Trent are, as a rule, no longer binding,
since they have been replaced by current laws which are in force
today. But the current law is written broadly enough to indicate
that if financial support is impossible, the Catholic faithful should
support their parish in other ways. Secondly, as a rule, a priest
may only offer one Mass per day, although there are occasions
when he is permitted to offer more than one Mass in a single day
(c. 905.1).
A major concern of the Church is that there be no
appearance that Masses are being bought or sold. Canon 947
notes that even the semblance of trafficking or trading in Mass
offerings is to be entirely avoided; and someone who traffics in
Mass stipends for profit may actually be punished with a censure
(c. 1385).
