discuss the violations. He informed me that the tenant made the modifications to the stairs,
removed the original heater which was mounted on the ceiling in the kitchen area and installed the
hot water heater. Mr. Huff expects to comply fully to the violations and said they plan to hire a
contractor to correct the stairs and other violations but need additional time now due to the tenant
requesting to only be contacted through his attorney. Mr. Huff would like to setup a meeting next
week to discuss permits and a reasonable time frame to resole the violations. Will discuss with Sr Ed
Labayog to grant time extension.
7/18/2014 8:48:51 AM RSCHIMM 07/18/2014 : RSchimm - Bob Huff called to advise they are sending the tenant a letter and are
requesting more time for the repairs. He said the tenant has retained an attorney and any contact
must go through the attorney causing more delays. I advised Mr. Huff we need a copy of the letter
and will need to get a time frame next week as to when the repairs will be completed. He said he is
drawing the letter up now and I will receive a copy early next week at the latest.

7/24/2014 11:24:09 RSCHIMM 07/24/2014 : RSchimm - Received several letters today from the property management group
AM RE/tenants complaints. Additional time is needed from property management group to obtain
construction bids and to perform work due to the tenant performing unauthorized work to the unit.
The property management group is going to hire a contractor and obtain permits to resolve the
violations originally caused by the tenant. I asked Mr. Huff to contact me and give me a timeframe
as to when he thinks the repairs will be completed after the permits have been issued. No fee
charge should be assessed at this point because the violations were created by the tenant. Will
monitor status for now.
8/4/2014 9:09:02 AM RSCHIMM 08/04/2014 : Received letter stating that the tenant, Paul Plotkin has denied request of having a
licensed contractor enter his residence until August 8, 2014 to do inspection. Scanned and saved to
case file.
8/11/2014 3:30:10 PM RSCHIMM 08/11/2014 : RSchimm - Email from Kurt Biddle: Randy, I wanted to keep you in the loop with this
case. The tenant has retained an attorney for this matter, we have to work through the attorney. (!)
The tenant denied us access to view the unit with our contractor so that our contractor could
provide us a bid on August 1. We then requested any day the following week. The tenant granted
us access on Friday the 8th. He wouldnt let us in at the scheduled time. We had to consult with his
attorney and have them convince him to open his door 15 minutes later. We went in to take pictures
and the contractor to get the bid. We asked to see the electrical panel and a hidden room. The
tenant cancelled the inspection and wouldnt let us complete our inspection and told us to leave. We
are again working with his attorney. Im trying to find out if my contractor has enough information
to get us a bid. This situation is bizarre to me. I will keep you informed.
10/10/2014 9:44:06 RSCHIMM 10/10/2014 : RSchimm - contacted property management co. to get update on case. Spoke to Kurt,
AM who informed me the tenant has filed a civil suit against the property management co. and has not
cooperated in allowing entry to the unit to make repairs. The property management co. must
contact the tenant's attorney every time they try to schedule an appointment for repairs.
Management co. states they have been refused entry and/or asked to leave during contractor
estimating appointments. Advised Kurt to send me all documentation regarding refusals by the
tenant.
12/3/2014 8:33:29 AM RSCHIMM 12/03/2014 : RSchimm - Discussed the needed permits with contractor hired to do repairs. He will
need building and plumbing permits to rebuild stairs and resolve water heater issues. Stairs do not
meet CA building code requirements. ongoing tenant/landlord dispute. Tenant has hired an attorney
and does not speak to property management personnel. Makes all correspondence go thru attorney.
Was not willing to let contractors enter unit. Tenant has filed a lawsuit.
10/13/2015 4:14:32 RSCHIMM 10/13/2015 - I called Bob Huff to discuss the case. Bob said the tenant refuses to talk to the
PM director of property maintenance or anyone else. He has refused entry on contractors to assess the
work needed and only accepts contact through his attorney. Bob said there was a hearing and the
attorneys came up with an agreement that he would move out of the unit by December 10, 2015.

As of last year, no one has been able to enter his unit to make any repairs due to non cooperation
by the tenant. Will discuss further with the director of property maintenance.
10/13/2015 4:24:20 RSCHIMM 10/13/2015 - I called the tenant (Paul Plotkin) to discuss his cooperation in letting contractors in to
PM assess the unit for repairs. He wants another inspection but is not willing to answer whether he will
cooperate with letting the repairs happen. He stated he will not answer any of my questions
regarding that and suggested I speak to his attorney. I advised him I can not setup an inspection
again if he will not cooperate as he has in the past. He said he will have his attorney contact me.

11/4/2015 7:30:21 AM RSCHIMM 11/02/2015 - Onsite inspection, photos taken, entered unit at request of tenant, Paul Plotkin. He
asked to have a re-inspection and said the landlords have done nothing to repair the violations. I
asked Mr. Plotkin if he framed the wall and stairs. He said he had a friend construct the wall at his
request and they modified the stairs. I asked to view what was behind the wall and he walked over
to a bookshelf and pulled the bookshelf away from the wall which was attached by hinges creating a
false doorway. He opened the wall but he said there was no lighting in it. I used my iphone's flash
light to view inside the dark room. I saw a minimum of 8 receptacles installed and MC shielded
wiring with several panels. I asked who installed the wiring and he said it was done to code by an
electrician. I asked where the permits were and he said, "Oh, you need a permit for wiring?". I
advised him he not only needs a permit, he needs to have the inspections and approvals and there
is no record with The City of Oakland that confirms permits were obtained for the unapproved
wiring. I told him he is jeopardizing the safety of himself and others in the building by doing such
wiring. He then was questioning why I took photos of the unapproved electrical work. I advised him
he asked me to do the inspection and he willingly opened the false bookshelf to show me the
unapproved room. We then entered the upstairs area and I observed an 8" metal exhaust vent
which penetrated the kitchen ceiling drywall and exited the roof. He said he also had that installed
for ventilation of the hidden room. I took more photos and ended the inspection. Note: The tenant
has refused entry of any person to assess and abate the violations. This case has been suspended
until the tenant has vacated the premises which he has agreed to do on 12/31/2015. I am sending
an addendum of the NOV to the building owners to advise them of the potential hazardous wiring
which exists and must be removed ASAP with permits, inspections and approvals. I contacted Kurt
Biddle on 11/03/2015 to advise my findings regarding the non permitted wiring and the new
violations discovered in my inspection. NOV Addendum to follow.
