Law No. 3 / 200, published on January 18, 2008. Introduces significant changes t
o the status of students of primary and secondary.
PARENTS / guardians in this document as most prominent duties of parents and gua
rdians: proceed to have your child comply with the obligations incumbent upon
it, being distinguished from the attendance and the proper behavior and engageme
nt in the learning process; help establish the facts in the case of disciplina
ry proceedings brought to your child and where to apply corrective measures or d
isciplinary sanction, arrange for it to fulfill the goals of strengthening civic
education, development of personality, capacity for relationships with others o
f full integration into the community and sense of responsibility; know the st
atus of the student, the rules of the school, and subscribe, as well as their st
udent, an annual statement of acceptance of it and commitment to compliance; s
ubmit request for justification of absences for the student's absence (if less)
the head teacher, indicating the time of the activity in which the failure occur
red and stating the reasons for the same through the book (school) or form (teac
hing secondary). The lack of justification must be
presented previously, when the subject is predictable, or in other cases, by the
3rd business day following the occurrence thereof.
STUDENTS Regarding the student, it highlights: • the duty of attendance, which i
mplies its presence in the classroom or at places where they develop their schoo
l work, and the duty of an attitude of commitment to intellectual and behavioral
age-appropriate; • the faults are only considered justified if they present the
following reasons:
I.
Illness of the student, which must be declared by a physician if the period of a
bsence exceeds 5 days;
II.
Prophylactic isolation due to infectious disease of people living with the stude
nt, which must be proven by declaration of the competent health authority;
III.
Death of family member, but only during the legal period assigned by the death o
f the family status of public officials;
IV. V.
Birth of brother, during the day of birth and the next day, outpatient treatment
and since this not take place outside the period of school activities;
VI.
Assistance to a household member and provided that it proves the impossibility o
f someone else that they can provide;
VII.
Act due to the professed religion and on a socially recognized as a specific pra
ctice of this religion and that the other can not be effected outside of school
activities;
VIII.
Participation in sporting events or cultural events, under the law (related to i
nternational events and elite athletes);
IX. X.
Fulfillment of legal obligations; Another factor impeding the presence in school
is not attributable to the student and when duly justified and considered by at
tendable class director;
XI.
Submission of the justification of absences (if larger) the head teacher, indica
ting the time of the activity in which the misconduct occurred and stating the r
easons for it;
XII.
Lack of explanation in advance if the subject is predictable or until the 3rd bu
siness day after the occurrence;
Other things to consider - Faults
The class director should ask the parents / guardians or the student if over t
he additional evidence it deems necessary to justify the failure; Where no jus
tification has been submitted to the faults within 3 working days or does not ha
ve been accepted to the class director to report on the situation, within 3 work
ing days, parents / guardians or the student if of legal age,by the most expedit
ious means; The rules must provide for the purposes and procedures for cases i
n which it considers as non-appearance of the pupil at the school activities
this fact does not accompany the materials necessary for their operation; When
the number of fouls to double the number of times per week for academic discipl
ine, parents / guardians are invited to school, the director of gang and speedie
st means , to be aware of the consequences of failure to make a frequency and fi
nd a solution to ensure the effective discharge of this duty and the necessary e
ducational attainment; If it proves impossible to achieve the above measure, t
he Commission must Protection Children and Young People be informed of excessive
absences the student, whenever the particular seriousness of the situation warr
ants; Schools can promote the implementation of measures or remedies under Art
icle 26 (see remedies); Whenever the student regardless of the nature of fault
s, a number of absences reaches more than three times the weekly time in the cur
riculum by subject, or twice only when justified, should take place as soon as t

cipline (s) that exceeded this limit; When the student does not obtain approva

rmine: a) compliance with a plan for monitoring individual and the consequent re
alization of a new trial;
b) The retention of students in the same school year (in the case of basic educa
tion), c) The exclusion of the student who is out of compulsory schooling, and t
hat is the problem of students attending (s) subject (s) in (s) which (is) not o
btained approval on the proof; approval in the test allows the student to retu
rn to her normal school course; Failure to show the student to carry out this
proof of recovery, if not justified under merit consideration as acceptable ago
determines the retention or deletion.
Corrective measures and disciplinary sanctions
The violation by the student of any of the duties provided for in Article 15 (co
ncretely: the duty to study, be diligent, punctual and committed to the completi
on of school activities; follow the guidance of teachers regarding their teachin
g and learning, to treat with respect and fix all members of the educational com
munity; store loyalty towards all members of the educational community, comply w
ith the instructions of teachers and non-teaching staff, contribute to the harmo
nious coexistence of school and the full integration in school of all students,
participate in education and training activities ...;
respect the physical and moral integrity of all members of the educational commu
nity, providing aid and assistance in case of danger to physical or moral integr
ity to the members of the educational community, to ensure the preservation, con
servation and cleanliness of facilities, teaching materials, furniture and space
s green school, respect the ownership of assets of all members of the educationa
l community, stay in school during their time, unless written permission from th
e parent or the school board, participate in electing their representatives and
prestarlhes collaboration; know and meet the student's status, the rules of work
ing of the school and its rules of procedure, not possess or consume addictive s
ubstances, especially drugs, tobacco and alcoholic beverages, or promote any typ
e of trafficking, facilitation and consumption of the same;not incorporate any m
aterials, technological equipment, instruments or devices, capable of objectivel
y disturb the normal functioning of school activities, or could cause physical o
r moral to students or others) and / or others listed in the regulations could d
etermine the application measure (s) Corrective (s) and / or sanction (s).
In addition to the corrective measures provided for in the Rules, the document s
ets as measures: the output order of the classroom or other places where they
develop their school work;
performing tasks and activities of school integration, which can be increased
period of stay required, daily or weekly, the student at school; conditioning
access to certain school spaces, or the use of certain materials and equipment,
subject those who are engaged in school activities; the change of class.
The order of exit from the classroom or other places where school work is to dev
elop the competence of the teacher and requires students to remain in school and
the determination by the teacher, the time period in which the student must sta
y out of the classroom and whether or not the measure carries no marking as well
as activities that students should develop during that time period.
The sanction measures also pursue disciplinary sanctions punitive purposes, bein
g distinguished: censure registered; suspension from school up to 10 working
days; transfer school.
Of these only a reprimand is registered competence of their teacher when the cri
me occurs in the classroom, other situations are the responsibility of the execu
tive board.
