Contract of Lease

Know All Men by These Presents:

This Contract of Lease is made and executed by and


between:

YANZ ADAZA, of legal age, Filipino, married to Angel


Adaza, with address at Brgy. Looc, Dumaguete City
hereinafter called the LESSOR;

- And

ANTHONY OBINA, of legal age, Filipino, married to Maine


Obina, with address at Brgy. Talay, Dumaguete City
hereinafter called the LESSEE;

Witnesseth that:

WHEREAS, the LESSOR is the legal owner of a Fully furnished


house with swimming pool, lawn, 4 bedrooms, 2 comfort
rooms, 1 kitchen; situated at Motong, Dumaguete City, with
floor area of 500 square meters;

WHEREAS, the LESSOR leases unto the lessee, and the


latter hereby accepts the lease from the former.

NOW THEREFORE, for and in consideration of the above


premises and covenants provided below, the LESSOR hereby
leases the PROPERTY to the LESSEE who accepts it under the
following terms and conditions:

1. The lease shall be for one year from execution of this


agreement;
2. The monthly rental on the PROPERTY leased shall be P20,
000.00 per month for one year;
3. All ordinary repairs concerning the PROPERTY shall be for
the sole account and expense of the LESSEE, without right to
reimbursement;
4. The LESSEE shall use the PROPERTY exclusively for family
dwelling, and shall have no right to use the same for
business and other purposes;

The Lessee hereby acknowledge that he has


received the Property in good, habitable condition and
undertake to maintain the such condition throughout the
duration of the lease;

CONTRACT OF ANTICHRESIS

KNOW ALL MEN BY THESE PRESENTS:

I, KOLLY VISMANOS JR, Filipino, of legal age, single, and


a resident of Brgy. Looc, Dumaguete City (hereafter referred
to as DEBTOR) I am the absolute owner of the following
described parcel of land, as evidenced by Transfer
Certificate of Title No. 1456 of the Registry of Deeds of
Dumaguete City: Lot: 60 coconut bearing trees in Lot
No. 2008-B, Pls-701; Location: Magsaysay Dauin,
Negros Oriental; Area: Five Hundred (500) Square
Meters

That for and in consideration of the loan of Sixty


Thousand Pesos (Php 60,000.00), with an interest rate of ten
percent (10) per month which is extended to me by SHEAN
DE GRACIA, Filipino, of legal age, single and a resident of
Brgy. Taclobo, Dumaguete City (hereafter referred to as
CREDITOR), I the said DEBTOR, in order to secure payment
of said loan and its interest do hereby grant in favor of
CREDITOR, the right to receive the fruits of, the above-
mentioned land, with the obligation of applying them to the
payment of the interest, if owing, and thereafter to the
principal of his credit; the actual market value of the fruits
obtained or harvested at the time of the application thereof
to the interest and principal shall be the measure of such
application. That the parties hereby agree that I, the
DEBTOR cannot not reacquire the enjoyment of the above-
described property, without first having totally paid in twelve
month or until what I owe to the CREDITOR. However, in case
of default, the CREDITOR does not acquire ownership of the
real estate for non-payment of the debt, but he may bring an
action for specific performance; or petition for the sale of the
real property in a foreclosure of mortgages under rules 68 of
the Rules of Court, or extra-judicially foreclose the security,
as agreed upon by the parties.

That I am the only surviving legal heir of my late


grandfather MARIANO S. DELA CRUZ who died intestate on
January 10, 2017 at BRGY. DARO, DUMAGUETE CITY.

That the said deceased left a parcel of agricultural


land and more particularly described:

A parcel of agricultural land situated at Brgy.


Tampukon, Sibulan containing an area of Ten Thousand
(10,000) Square Meters, more or less and a house and lot
with an area of 212 square meters floor area 170 square
meters and a Mitsubishi Montero sport 2016 model.

That since the said deceased left no will


or testament, I hereby adjudicate and by these presents
ADJUDICATE upon myself the above-described property
pursuant to the provision of Rule 74, Section 1 of the Rules of
Court of the Philippines and hereby files the same with the
request that said adjudication be made effective without
judicial proceeding as prescribed by the aforementioned
Rules of Court.

That I subscribed to this affidavit that I am the only


surviving legal heir of my late grandfather Mariano S Dela
Cruz.

REAL ESTATE MORTGAGE

This Real Estate Mortgage, made by and between:

Yanz Adaza, of legal age, single and a resident of Mabinay,


Negros Oriental Philippines (hereinafter known as the
MORTGAGOR);

Shean De Gracia, of legal age, single, and a resident of Brgy.


Junob, Dumaguete City Philippines (hereinafter known as the
MORTGAGEE);

WITNESSETH; That:

The MORTGAGOR is indebted unto the MORTGAGEE in


the sum of five million (P5, 000.000), Philippine Currency,
receipt of which is acknowledged by the MORTGAGOR upon
the signing of this instrument, payable to the order of the
MORGAGEE without need of prior demand or notice within a
period of 5 years (years/months/weeks/days), thereafter
until fully paid, with interest thereon at the rate of ( 5%)
percent per (month/annum).
NOW, THEREFORE, for and consideration of the afore-
mentioned indebtedness, and to assure the
performance of said obligation to pay, the MORTGAGOR does
hereby convey and DELIVER by way of MORTGAGE unto the
MORTGAGEE, (his/her) heirs, successors and as signs, the
following parcel of land, together with all the improvements
found and standing thereon, more particularly described as
follows:

Oriental

That it is the condition of this Mortgage that should the


MORTGAGOR perform the obligation to pay the afore-cited
indebtedness of 5,000.000 together with accrued interest
thereon, within the agreed term, this Real Estate Mortgage
shall be discharged and shall at once become null and void
and of no effect whatsoever, otherwise, it shall subsist and
remain in full force and effect and be subject to foreclosure
in the manner and form prescribed by law.

"YANZ ADAZA" as appearing in some documents or
specifically in his Certificate of Live Birth and

the same person and that his true and correct name

3. We are not in any way related to any of the foregoing


person within the fourth civil degree either by
consanguinity or affinity, nor do we have any
pecuniary interest in this matter whatsoever;

4. To remove confusion as to the two names, we hereby


declare that the name YANZ ADAZA and YANNZ
ADAZA refer to one and the same person whose
registered name is YANZ ADAZA;

5. We are executing this affidavit to attest to the


truthfulness of the foregoing statements and to
establish the real identity of YANZ ADAZA and for all

PETITION
Undersigned Petitioner and unto this Honorable Court most
respectfully states that:
1. Petitioner is a Filipino citizen, over twenty-one years of
age, and a resident in the Philippines since birth and
with office address at Brgy. Motong, Dumaguete City,
Negros Oriental.
2. Petitioner was admitted to the Philippine Bar on April
11, 2011 with Roll of Attorney No. 123456. A photocopy
of petitioners Certificate of Membership in the
Philippine Bar issued by the Office of the Bar Confidant
is attached as Annex A of this petition;
3. Petitioner is a lawyer in good standing with clearances
from the Office of the Bar Confidant of the Supreme
Court and the Integrated Bar of the Philippines,
attached as Annexes B and C;
4. Petitioner has not been convicted in the first instance
of any crime involving moral turpitude, nor charged in
any administrative case in connection with his present
profession;
5. Petitioner has not yet applied nor been commissioned
as Notary Public in any other jurisdiction;
6. Petitioner is a registered member of the Integrated Bar
of the Philippines as supported by a photocopy of the
Official Receipt of yearly dues as of January 2015,
attached as Annex D;
7. Petitioner has paid his Professional Tax Receipt for the
year 2014 under Official Receipt No. 0416909 dated
March 13, 2015 at Dumaguete City. Photocopy of the
receipt is attached as Annex E of this petition;
8. Petitioner will submit his notarial books and
acknowledged documents after the expiration of his
notarial commission as provided for by law;
9. Petitioner possesses all the qualification and none of
the disqualifications for the Office of the Notary Public
and have read, understood and is willing to abide with
the 2004 Rules on Notarial Practice;
10. Petitioner is attaching at Annex F, a facsimile of
his notarial seal prepared in accordance with Section 2,
Rule 7 of the 2004 Rules on Notarial Practice for
approval of this Honorable Court, together with 3
specimens of his official signature.
11. Also submitted are petitioners 3 passport sized
colored photographs with light background, take not
more than 30 days prior to the filing of this petition;

WHEREFORE, it is most respectfully prayed that:


A certificate of authorization to purchase notarial seal
as provided under Section 9, Rule 3 of 2004 Rules on
Notarial Practice, and certificate of authority for a
notarial act as provided under Section 1, Rule IX of the
same Rules be issued in favor of the petitioner.

ANTE-NUPTIAL AGREEMENT

KNOW ALL MEN BY THESE PRESENTS:

This Agreement is made and entered into by and between:

Kolly Vismanos jr., of legal age, Filipino and a resident of


Brgy. Junob, Dumaguete City;

and -

Jocelyn Tuble Sibala, likewise of legal age, Filipino and a


resident of Brgy. Junob, Dumaguete City;

- witnesseth -

WHEREAS, the parties hereto were married in civil


rights on February 25, 2017 in Cathedral Church Dumaguete
City;

WHEREAS, the parties hereto have properties of their


own acquired before their marriage to each other and,
because of the origin of the said properties, the parties
hereto desire that their respective properties remain as his
and her own solely.

WHEREAS, the particular property referred to herein is


that property described as a portion of that parcel of land
covered by Transfer Certificate of Title No. 123456 of the
Registry of Deeds for Dumaguete City containing an area of
SIXTY FIVE (65) SQUARE METERS, more or less, which the
parties hereto acquired by way of sale from the exclusive
paraphernal funds of Anthony Obina;

WHEREAS, for the foregoing reasons, the parties hereto


desire to fix and determine the respective rights and claims
of each in and to the estate and property of each other, and
to accept the provisions of this Agreement in lieu of and in
full discharge, settlement and satisfaction of all such rights
and claims, and the parties hereto do hereby agree under
this Ante-Nuptial Agreement that the property relations
between them as husband and wife during their marriage
shall be a regime of SEPARATION OF PROPERTY under the
New Civil Code of the Philippines, as amended by Executive
Order No. 209, otherwise known as the Family Code;

WHEREAS, pursuant to the said Regime of Separation of


Property, the parties hereto do hereby agree that:

1 Each spouse shall own, possess, dispose of,


administer and enjoy their individual rights over their
respective and separate estate or property with need of
consent from either spouse, and to each shall belong the
fruits, natural, industrial or civil, due or received during their
marriage from their respective and separate properties,
provided, however, that the earnings of each spouse from
their respective profession or industry shall be considered
conjugal property of the marriage;

2 All properties received by way of donation or


inheritance, including all the fruits or interest derived
therefrom, shall constitute the separate and individual
properties of each spouse;

NOW, THEREFORE, for and in consideration of the


foregoing and the solemnization of the marriage of herein
parties, and of the covenants herein contained, the parties
hereto do hereby sign, execute and acknowledge this ANTE-
NUPTIAL AGREEMENT, this February 28, 2017 at Quezon City.

EASEMENT OF RIGHT OF WAY

KNOW ALL MEN BY THESE PRESENTS:

This AGREEMENT OF EASEMENT OF RIGHT OF


WAY, entered into this 25th day of February, 2017 by and
between Gem Mijares owner of the dominant estate, of
legal age, single and a resident of Brgy. Motong, Dumaguete
city Philippines and Joy Bilbao, owner of the servient estate,
also of legal age, single, and a resident of Brgy. Motong,
Dumaguete City, Philippines, witnesseth:

That Gem Mijares is the owner of a parcel of land


located in the city of Dumaguete, province of Negros
Oriental, and more particularly described as follows, to wit:

Plan No. PSD-06-4583932
Portion of: Lot 11 Cadastral Survey of
Dumaguete City
Location: Barangay of Motong, City of
Dumaguete, Province of Negros Oriental
Owner: Gem Mijares
Which property is covered by T.C.T. No.2016-110283 of the
Register of Deeds of the province of Negros Oriental, which
lot is adjacent to Gem Mijares property, and more
particularly described as follows, to wit:

Portion of: Lot 12 Cadastral Survey of
Dumaguete City
Location: Barangay of Motong, City of
Dumaguete, Province of Negros Oriental Owner:
Joy Bilbao

Which property is covered by T.C.T. No. 2016-110282 of the


Register of Deeds of the province of Negros Oriental.

That Gem Mijares in order to have an access to and


from, and to cultivate the above-mentioned land, and so as
to have an outlet to the national highway, which is the
nearest public road and least burdensome to the servient
estate and to third persons, it would be necessary for her to
pass through Joy Bilbao property, and for this purpose, a
path or passageway of not less than two (2) meters wide
through the whole length of the western side of Joy Bilbao
property is necessary for the use of Gem Mijares and for all
his needs in cultivating his estate;

WHEREFORE, for and in consideration of the sum of


FIFTY THOUSAND PESOS (P50,000.00) the receipt whereof is
hereby acknowledged by Joy Bilbao, the latter agrees and
permits Gem Mijares to have a permanent easement of
right of way over the above-mentioned property of said Joy
Bilbao limited to not more than two (2) meters wide
throughout the whole length of the western side of said
property and as specifically indicated in the attached plan
which is made an integral part of this contract, as Annex A.

It is further agreed that Joy Bilbao shall deliver unto


Gem Mijares all the necessary papers, deed, and titles in
relation to the servient estate in order to facilitate the
registration of the above-mentioned right of way, in
accordance with.

This agreement shall be binding between the parties


and upon all their heirs, successors, and assigns.

IN WITNESS WHEREOF, the parties hereto have


signed this agreement the day and the year first above
written, in the City of Dumaguete, province of Negros
Oriental, Philippines.
