It is decided that both the parties have agreed as under:
1. Legitimate payment of the architect as per the services
actually rendered amounts to Rs. 6,01,509/- (Rupees Six lakh One thousand Five hundred and nine only) should be released by TCGL. The architect has agreed not to claim any interest on principle amount in any of the circumstances relating thereto in future. 2. M/s Falguni Desai: Architect shall, in turn, unconditionally withdraw the cases both from arbitrator as well as from Honble High Court of Gujarat bearing no: 96 of 2013 and 6929 of 2013 against blacklisting respectively. 3. The abandoned work at Dandi should be completed by the same architect in the interest of the execution of the pending contract for the project: Dandi Destination Development. 4. TCGL shall, in turn, also withdraw the counter claim with the decision of blacklisting and imposition of penalty @ 25% which was imposed as an administrative decision due to exigency of the situation of the relevant time. However, in view of long standing pendency of unexecuted work of Dandi Project and that resulted into sheer wastage of government money and the same should not further prolong to defeat the motive of holistic development of Dandi destination of TCGL. 5. It has unanimously been agreed that the charges borne by both the parties towards arbitrations fee etc. will not be claimed by either of the parties in any of the circumstances in future. 6. In the interest of both the parties, this constitutes the intention of both the parties for amicable settlement and disposal of cases in arbitration as well as before the Honble Arbitral Tribunal and secondary before the Honble High Court of Gujarat, Ahmedabad respectively. 7. This amicable settlement is the full and final settlement of all the claims, the architect has made against the Tourism Corporation of Gujarat Ltd. Gandhinagar and, therefore, the architect shall not raise any further additional claim in future towards any heads of her claim, of whatsoever in nature, in the said context of the matter as agreed upon in the Memorandum of Settlement.
