CLAIM
1. TheplaintiffRosemaryKing,claimsfromthedefendantsasfollows:
a) Generaldamagesintheamountof$200,000.00
b) Specialdamages,includingdamagesforeconomicloss,intheamountof$500,000.00;
c) Prejudgmentandpostjudgmentinterestpursuantsections128and129ofthe Courtsof
JusticeAct,R.S.O.1990,c.C43;
d) Thecostsofthisactiononasubstantialindemnityscale,and;
e) SuchfurtherandotherreliefasthisHonourableCourtmaydeemjust.
2. TheplaintiffBenjaminKing,claimsfromthedefendantsasfollows;
a) Damagesintheamountof$100,000.00,pursuanttosection61ofthe FamilyLawAct,
R.S.O.1990,c.3,asamended;
b) Prejudgmentandpostjudgmentinterestpursuantsections128and129ofthe Courtsof
JusticeAct,R.S.O.1990,c.C43;
c) Thecostsofthisactiononasubstantialindemnityscale,and;
d) SuchfurtherandotherreliefasthisHonourableCourtmaydeemjust.
3. Theplaintiff,RosemaryKing,isanindividual,ordinarilyresidentintheCityofSt.Catharines,
intheRegionalMunicipalityofNiagara,intheProvinceofOntario.Atallmaterialtimes,the
plaintiff,RosemaryKing,wastheoperatorofa2009DodgeCaravan,bearingOntariolicence
platenumberBMBW253(hereinafterreferredtoasthePlaintiffsMotorVehicle),drivingin
andaroundtheintersectionofCarltonStreetandBuntingRoad,inthecityofSt.Catharines,in
theProvinceofOntario.
4. Theplaintiff,BenjaminKing,isanindividualordinarilyresidentintheCityofSt.Catharines,in
theRegionalMunicipalityofNiagara,intheProvinceofOntario.BenjaminKingisthespouse
oftheplaintiff,RosemaryKing.
6. Thedefendant,ArnoldGolde,isanindividualordinarilyresidentintheCityofStCatharines,in
theReginalMunicipalityofNiagara,intheProvinceofOntario.Inallmaterialtimes,Arnold
GoldewastheowneroftheDefendantsMotorVehicle.
7. The plaintiffs state that on or about September 6, 2016, the plaintiff, Rosemary King, was
drivingintheCityofSt.Catharines,intheProvinceofOntario,inanortherlydirectionalong
Bunting Road, at or near its intersection with Carlton Street (hereinafter referred to as the
SubjectIntersection).
8. Theplaintiffs statethattheSubjectintersectionisafourwayintersection,atwhichBunting
RoadandCarltonStreetarebothgovernedbytrafficlights.
9. The plaintiffs further state that on the date and time referred to above and at the Subject
Intersection,theplaintiff,RosemaryKing,withtherightofway,attemptedtoproceedthrough
theSubjectIntersectiontravellinginanortherlydirectionalongBuntingroad.
10. The plaintiffs further state that at the above noted time and at the Subject Intersection, the
Defendants Motor Vehicle, travelling in an easterly direction along Carlton Street across
BuntingRoad,struckthePlaintiffsMotorVehicleontheleftside,(hereinafterreferredtoasthe
SubjectAccident).
11. TheplaintiffsstatethattheSubjectAccidentwascausedbythenegligenceofthedefendant,
Brayden Golde, for whose negligence the defendant, Arnold Golde is responsible at law.
Particularsofthatnegligenceareasfollows:
a) Hefailedtokeepaproperlookout;
b) HefailedtooperatetheDefendantsMotorVehiclewithduecareandattention;
c) Hetravelledthroughastoplightandenteredtheintersectionatatimewhenitwasunsafe
todoso;
d) HeoperatedaDMVataspeedwhichwasunsafeinallcircumstances;
e) HefailedtoapplybrakesontheDMVintime,orproperly,oratall,orinthealternative,
wereoperatingamotorvehiclewithdefectivebrakesand/ortires;
f) HeoperatedtheDMVwhiletheirabilitytodosowasimpairedbyalcohol,drugs,fatigue,
orstressoracombinationthereof;and
g) Hefailedtoslowdown,turnout,orstopsoastoavoidtheSubjectAccident.
12. Inadditiontotheaboveallegations,theplaintiffspleadandrelyuponsection144and193ofthe
HighwayTrafficAct,R.S.O.1990,c.H.8,asamended.
13. Inadditiontotheaboveallegations,theplaintiffspleadandrelyuponsection267.1(1)ofthe
InsuranceAct,R.S.O.1990,c.I.8,asamended.
14. TheplaintiffsstatethatasaresultoftheSubjectAccident,theplaintiff,RosemaryKing,has
sustainedpermanentseriousdisfigurement,andpermanentandseriousimpairmentofimportant
physical, mental, and/or psychological function. Particulars of the injuries sustained by
RosemaryKingasaresultoftheSubjectAccidentareasfollows:
a) Fracturetotheleftradiusandulna;and
b) Injurytoleftknee,
15. Asaresultoftheinjuriessustainedbytheplaintiff,RosemaryKing,shehasexperiencedpain
andwillcontinuetoexperiencepain,sufferingandadiminutioninherenjoymentoflife.Shehas
beenunabletoparticipate,atall,or,totheextentshewasablepriortotheaccident,inher
ordinaryrecreational,social,athletic,householdandemploymentactivities.
16. AsafurtherresultoftheSubjectAccident,theplaintiff,RosemaryKing,hasundergoneandwill
continuetoundergo,hospitalization,therapy,andrehabilitation.
17. AsafurtherresulttotheSubjectAccident,theplaintiff,RosemaryKing,hasincurredandwill
continuetoincur,expensesforhospitalization,medication,therapyandrehabilitationaswellas
expensesforthemaintenanceandupkeepofherhomeandproperty.Fullparticularsofthese
expenseswillbeprovidedatareasonabletimepriortotrial.
18. AsafurtherresultoftheSubjectAccident,theplaintiff,RosemaryKing,hassufferedandwill
continuetosufferalossofincome,alossofcompetitiveadvantageintheemploymentfield,and,
adiminutioninherincomeearningcapacity.
19. As a further result of the damages and injuries suffered by Rosemary King, the plaintiff,
BenjaminKing,hassufferedalossofthecare,guidance,andcompanionshiphecouldhave
expectedtoreceivefromtheplaintiff,RosemaryKing,hadtheSubjectAccidentnotoccurred.In
addition,BenjaminKinghasprovided,andwillcontinuetoprovide,nursing,housekeepingand
otherservicestoRosemaryKing,suchserviceshavingbeennecessitatedbytheinjuriestothe
plaintiff,RosemaryKing.
20. TheplaintiffsproposethatthisactionbetiredintheCityofSt.Catharines,intheRegional
MunicipalityofNiagara,intheProvinceofOntario.
