REGUIATION ORDINANCE NO. 2016-292


AN ORDINANCE ESTABLISHING THE TOBACCO CONTROL
OFFICE IN ILOILO CITY

WHEREAS, Iloilo City has been and still is very and effective in its campaign
against smoking in public places through the Iloilo City anti-Smoking Task Force
(ICAST);

WHEREAS, the same ICAST was created through Executive Order by the
incumbent Mayor;

WHEREAS, such momentum showed by the ICAST in its campaign against the
ill-effects of smoking shall not be hampered by a change of the direction and priority of
the Administration in the City Government and shall be continued regardless of the
change ofleadership;

WHEREAS, there is a need to institutionalize the program and campaign of the


Iloilo City Government on the ill-effect of smoking and other similar social vices.

NOW, THEREFORE, be it ordained by the Iloilo City Council, duly assembled


that:

Section 1. - TITLE. - This ordinance shall be known as the "ILOILO CITY


TOBACCO CONTROL OFFICE ORDINANCE";

Section 2. - DEFINITION OF TERMS. - As used in this ordinance, the


following terms are defined as:

a) Iloilo City Anti-Smoking Task Force (ICAST) - refers to the Task Force
created through Executive Order No. 34, Series of 2013, by Mayor Jed Patrick E.
Mabilog;

b) Office - refers to the Iloilo City Tobacco Control Office created through this
ordinance;

c) Ordinances - refers to the existing and future ordinances relative to smoking


and other similar or related social vices, such as vaping, e-cigarette and of all tobacco-
controlled "vices" that emits smokes; including Ordinance on Tobacco Sales and
advertisements promotions.

Section 3. - COMPOSITION. - The Office shall be composed of the City Mayor


as the Chairman and the existing Executive Director, Secretariat and Agents of the Iloilo
City Anti-Smoking Task Force (ICAST);

The existing ICAST Personnel maybe given priority for regularization subject to
the discretion of the appointing authority and qualifications. The Chairman, after due
hearing, may impose disciplinacy action against the erring agents upon proper
recommendation by the Executive Director and such disciplinacy action may be in the
form of dismissal from service or suspension for the maximum of fifteen (15) days
without pay, as the case maybe;

Section 4. - ORGANIZATIONAL STRUCTURE. - The Office Organizational


Structure shall be as follows: The existing Director, Head of the Administrative Services
Division and the Head of the Enforcement Team, which may be given priority in case of
regularization and subject to the availability of funds;

Section 5. - DUTIES AND RESPONSIBILITIES. - The Office, through the


ICAST, and under the control and supervision of the Chairman, shall strictly implement
all the Iloilo City Ordinances relative to Tobacco Control, promotions and
advertisements;

Section 6. - SEPARABILITY CLAUSE. - For any reason or reasons that any


part of the provision of this ordinance be declared unconstitutional or invalid, the other
parts or provisions thereof not affected shall continue to be in full force and effect;

Section 7. - REPEALING CLAUSE. - All other existing ordinances which are


inconsistent with this ordinances are repealed or modified accordingly;

Section 8. - EFFECTIVITY CLAUSE. -This ordinance:', will take effect fifteen


(15) days after its approval and publication in a newspaper of general circulation in
Iloilo City.
