REGULATION ORDINANCE NO. 2016-319

AN ORDINANCE AMENDING SECTION 3 (B) OF REGULATION
ORDINANCE NO. 2009-218, "AN ORDINANCE PROHIBITING
THE OPERATIONS OF COLORUM VEHICLES IN THE CITY OF
ILOILO", BY INCREASING COLORUM TRICYCLE PENALTY

WHEREAS, Regulation Ordinance No. 2009-218 is an ordinance prohibiting the

operations of colorum vehicles in the City of Iloilo passed by the Sangguniang

j Panlungsod on May 20, 2009;

WHEREAS, despite the lowering of the yearly regulatory fees for operation of
tricycle units with franchise, the licensing division of the city government noted a
considerable decrease of payments for the said yearly regulatory fees;

WHEREAS, the existing penalty for operation of colorum tricycle no longer

serves as a deterrent or operators/ drivers of tricycle unit to operate without proper
authority to do so;

WHEREAS, there is a need to increase penalty for operation of colorum tricycle

as one among many measures to be implemented to discourage operators and drivers of
tricycles from catering passengers without the necessary franchise or payment of the
yearly regulatory fees;

NOW THEREFORE, let it be ordained by the Sangguniang Panlungsod of Iloilo

City, in session assembled, that:

Section 1. - The penalties for colorum tricycle units violation in Regulation

Ordinance No. 2009-218 be amended as follows:

"Section 3. Penalty Clause

B. Motorized Tricycles - Any person who violates Section 2 of this

ordinance shall be subject to:

1st Offense - Penalty of ONE THOUSAND PESOS (Pi,000.00)

and warning.

2nd Offense - FINE OF ONE THOUSAND PESOS (Pi,000.00)

and impoundment of the tricycle unit by the TRANSPORTATION
MANAGEMENT AND TRAFFIC REGULATION OFFICE. Should
redemption of the unit will be made, a redemption fee of Three Thousand
Pesos (P3,ooo.oo) shall be imposed.

3rd Offense - Penalty under the second offense PLUS

RECOMMENDATION BY THE TRANSPORTATION
MANAGEMENT AND TRAFFIC REGULATION OFFICE TO
SUSPEND OR REVOKE ITS TRICYCLE FRANCHISE.

Section 2. - Except for the above stated penalty for colorum tricycle violation, all
other provisions of the Regulation Ordinance shall remain in full force and effect;

Section 3. - Let a copy of this ordinance be furnished to the Transportation

Management and Traffic Regulation Office (TMTRO) and the tricycle associations for
information and guidance;

Section 4. This ordinance shall take effect after publication in a newspaper of

general circulation in the City of Iloilo.
