BENIGNO AQUINO AVENUE BIKE LANE REGULATION
ORDINANCE

WHEREAS, Section 458 (5), (v) and (vi) of Republic Act 7160, otherwise known
as the Local Government Code of 1991, empowers the Sangguniang Panlungsod to
regulate the use of street and other public places;

WHEREAS, Iloilo City has designated elevated bike lanes along Benigno Aquino
Avenue;

WEHREAS, biking is also an alternative and cheaper mode of transportation


which is not only beneficial to the health but also to the environment;

WHEREAS, the regulation of bike lanes will promote safety and encourage more
bike commuters such as the students and workers, and it will help decongest traffic and
minimize the effect of pollution and global warming.

NOW, THEREFORE, be it ordained by the Sangguniang Panlungsod of the City


of Iloilo, that:

ARTICLE I
TITLE, GENERAL STATEMENT OF POLICY
AND DEFINITION OF TERMS

Section 1. - Title. - This Ordinance shall be known as the "BENIGNO


AQUINO AVENUE BIKE LANE REGULATION ORDINANCE"

Section 2 . - Statement of Policy. - It shall be the policy of Iloilo City


Government to regulate the use of bike lane considering that it is the primordial role of
the state keep safe its citizens from harm and to promote safety and encourage more
bike commuters such as the students and workers and it will help decongest traffic and
minimize the effect of pollution and global warming.

Section 3. - Definition of Terms. - As used in this ordinance the following are


defined:

a) Bike/Bicycle - any two wheeled vehicle having a rear driver which is solely
human powered;

b) Cyclist/Rider - person who rides/ drives a bike/bicycle;

c) DPWH - Department of Public Works and Highways;

d) Designated Bike Lane - an elevated bike lane made and designated for
pedestrians and bicycles along Benigno Aquino Avenue;

e) Motorist - riders using motorized vehicles including electronic bikes;

f) Motorized vehicles - other vehicle that uses mechanical engines and gas
including electricity in cases of e-bikes

g) Obsb-uction - any form of blockage and excavation along Designated Bike


Lane which hinders the passage of Cyclist/Rider or Pedestrian.

Section 4. - Coverage. - This ordinance shall apply to Designated Bike Lanes


along Benigno Aquino Avenue within Iloilo City;

Section 5. - Prohibited Acts. - Prohibited acts of Designated Bike Lanes are as


follows:

a) No motorized vehicle shall pass on the designated bike lane except when
crossing form the highway to the seivice road and vice versa at the designated areas
indicated by road signals;

b) No motorized vehicle or any person shall create any obstruction or excavation


along the bike lane.

Section 6. - Penalties. - Penalties shall be meted out to any driver of motorized


vehicle or any person caught in violation of this act shall be fine Two Thousand Pesos
(P2,ooo.oo) payable to the local treasury.

Driver of any motorized vehicle or any person who violates Section 5 of this
ordinance shall be issued a citation ticket by the TMTRO and Task Force Asis with a fine

payable to the City Treasurer's Office. Failure to pay for the period of three (3) days
from the issuance of Citation Ticket, the City Legal Office shall initiate the filing of the
case.

Obstruction by any other person shall be outrightly removed by the Task Force
Asis at the expense of the violator.

Section 7. - Enforcement. - The enforcement agency is the TMTRO and Task


ForceAsis.

Section 8. - Repealing Clause. - All ordinances, Executive Orders or any


issuance by the City Mayor inconsistent with the provision of this ordinance are hereby
repealed or modifies accordingly;

Section 9. - Separabiltiy Clause. - If for any reason any section or provision of


this ordinance or any portion thereof of the application of such section, provision or
portion thereof is declared invalid, illegal or unconstitutional the remainder of this
ordinance shall remain effective and operational.

Section 10. - Effectivity Clause. - The information dissemination of this


ordinance shall commence immediately after its publication in a newspaper of general
circulation in the City of Iloilo until December 31, 2016. This ordinance shall take effect
fully on January 1, 2017.
