1.0 INTRODUCTION

The owner/operator of the vessels in this plan is committed to complying with the provisions of
the Oil Pollution Act of 1990. In response to the regulations, the Companys Response
Organization is designed to provide a swift response to a pollution incident, regardless of its size
or impact.

In the event of a discharge of oil into the water, the owner or operator of the vessel causing the
spill is legally responsible for the cleanup. The crew members of the vessel, including the Master,
will likely be able to do very little cleanup in the water, since they must give their first priority to the
safety of vessel personnel and the vessel itself. Hence, the tasks at hand have been divided up
as follows:

Onboard Response Team Responsibilities

Once a spill has occurred, the crew of the vessel, led by the Master, is responsible for two things:
prevention of further leakage of oil (or, failing that, its minimization) and retention on board of all
spilled oil that has not yet entered the water. Once oil has entered the water, its cleanup becomes
the responsibility of the Shoreside Response Team.

The ships crew, led by the Master, becomes the Onboard Response Team. It is divided into two
parts: The Damage Control Element, led by the Chief Engineer, has the responsibility of stopping
leakage of oil; and the Cleanup Element, led by the Chief Mate (Spill Officer), is tasked with
cleaning up spilled oil still on the vessel to keep it from entering the water. Members of the crew
with appropriate training are assigned to these two elements. Other crew members are to report
to the bridge and take direction from the Master. The crew, in general, has no responsibilities off
the ship.

Shoreside Response Team Responsibilities

The Shoreside Response Team, reporting to the Qualified Individual, led by the Spill Manager
and backed by the Response Organization, has the job of supervising the prompt and effective
cleanup of oil in the water and on the shoreline. Their task includes determining methods,
developing priorities, managing operations and communicating with the Company and
appropriate governmental bodies. This Team manages containment, removal and/or dispersal of
oil on the water, directs contractors and handles administrative, legal, insurance and public
relations matters.

The Onboard and Shoreside Response Teams collectively form the Company field response
organization. Each team member must be suitably trained and know how his task fits into the
whole. Each person must be able to do more than one job, and in no case must there be a job
that only one person can perform.

1.5. SMFF DISTRIBUTION & CONSENT 33 CFR 155.4035 (a) & 33 CFR 155.4050 (b)(c)

A copy of Chapter 3 Shipboard Spill Mitigation Procedures has been provided to the plan holders
contracted SMFF resource provider(s) as required in 33 CFR 155.4035 (a).

The contracted Salvage and Marine Firefighting (SMFF) resource provider identified in Chapter 9.6
has provided written consent to the plan holder agreeing to be listed in this plan confirming that they
agree to provide the services that are listed in 155.4030 (a) through 155.4030 (h) and that these
services are capable of arriving within the response times listed in Table 155.4030 (b). A copy of
this document is located at ECM Maritime Services, LLC and is available for USCG review, if
requested.

As of December 3, 2000, the Texas General Land Office revised the requirement to submit a copy of the OPA 90 VRP. A
database with password protected access is in effect. The plan holder is responsible to verify that any vessel operating in Texas
state waters is entered into the database. The Interactive Internet Vessel Account Database and additional information regarding
