Issue: Whether the Honble Commission was justified in granting the lesser compensation for harassment,
mental agony, anger, sadness and for the lesser compensation for litigation charges.?

Facts: The appellant in 2006 booked a flat in a residential project start by a respondent company by paying
booking amount of Rs 6,50,000. The appellant on regular interval paid the amount to respondent company
which is in total of Rs 59,98,560/-.The stipulated time for delivery of house was 36 months but the
respondent company did not deliver the same even after 5 years. So the appellant went to National
Consumer Dispute Redressal Commission.

Appellant Prayed for :


1. The appellant prayed for sum of Rs 59,98,560 that was remain deposited with the respondent.
2. Wanted 20% interest on the deposited amount that is Rs 59,98,560.
3. Loss of reputation, Loss of business amounting to sum of Rs 10,00,000 and Litigation cost of Rs
75,000.

The Respondent will pay a sum of Rs 59,98,560 along with the interest @ 18% p.a from the date of its
deposit till its realisation.
Also an order by Granting only Rs 50,000 for harassment, mental agony,anger,frustration and only Rs
50,000 as litigation charges and it must be paid within 90 days.
