I will make all payments under this Note in the form of cash, check or money order.
I understand that Lender may transfer this Note. Lender or anyone who takes this Note by transfer and who is
entitled to receive payments under this Note is called the "Note Holder."
2. INTEREST
Interest will be charged on unpaid principal until the full amount of Principal has been paid. I will pay interest
at a yearly rate of 7.375 %. The interest rate I will pay may change in accordance with Section 4 of
this \,Jote.
The interest rate required by this Section 2 and Section 4 of this Note is the rate I will pay both before and after
any default described in Section 7(13) of this Note.
3. PA Y!\IENTS
(A) Time and Place of Payments
I will make a payment on the first day of every month, beginning on FEBRUARY 01 2008
Before the first Principal and Interest Payment Due Date as described in Section 4 of this Note, ~y payment will
consist only of the interest due on the unpaid principal balance of this Note. Thereafter, I will pay principal and
interest by making a payment every month as provided below.
I will make my monthly payments of principal and interest beginning on the First Principal and Interest
Payment Due Date as described in Section 4 of this Note. I will make these payments every month until I have paid
all of the principal and interest and any other charges described below that I may owe under this Note. Each monthly
payment will be applied as of its scheduled due date, and jf the payment includes both principal and interest, it will
be applied to interest before Principal. If, on JANUARY 01, 2038 , I still owe amounts
under this Note, I will pay those amounts in full on that date, which is called the "Maturity Date."

I just finished speaking with the FBI concerning the fraud involving your house please note I said the fraud concerning your house. Even
though you have not provided any additional funds noting your retainer has been depleted, I spoke with Mr. L.J. CONNOLY
[310.996.4401] on the mortgage fraud squad in Los Angels. He called looking for information so I returned his telephone call. I explained
to him I though you had been victimized and if he sticks to the documents could possibly prove a fraudulently case.
I said while I havent seen/read anywhere near all the documents various depositions and material suggest a fraud took place that I
thought needs investigation. I cautioned you might want to talk about working other corruption cases and suggested before listening to
same that he first handle the fraud involving the house to make sure he wasnt just chasing windmills. I told him you could be difficult, but
were an intelligent individual whose case should be investigated because again the facts suggest a fraud took place and thats the issue.
I told him the FBIs job was to pursue mortgage fraud even with difficult individuals noting thats an agents job and he agreed.
I believe he said he spoke to you already and had looked at the documents and did think a fraud had taken place. Consequently, I
thought he was likely to pursue an investigation. In the likely event Mr. CONNOLY calls you [because I think he will], Im going to suggest
you control yourself and try NOT to get him to chase allegations suggesting Los Angeles judicial circuit is all corrupt [because its not].
Thereafter, if per chance you are lucky and he is able to get the Bureau behind an investigation, hes going to need all the help you can
give him in order to convince the U.S. Attorneys office to file charges which can be very difficult. Because youre a smart man, l know you
know what I mean when I say youre going to have to remain extremely FOCUSED in order for CONNOLY to be successful.
Again, getting the U.S. Attorneys office to file charges can be extremely trying job not to mention formidable so do not let yourself get
distracted with QUI TAMS and the like. Im giving you this information because I want you to be successful. Because I think this
opportunity gives you one last bite of the apple, I suggest you have available for CONNOLYs review only those documents/information
concerning the fraud so he can quickly get a CLEAR picture of what happened. He needs you to be focused so that he can open an
investigation and pursue a line of inquiry.
Because you dont have the funds to pay me, I told him I was no longer engaged and didnt expect to do anything further noting the
distance and the fact I believe I need to examine all the documents/dispositions before I could proceed further which is probably cost
prohibitive. Getting an FBI agent to pursue your case is ideal so please dont blow the opportunity by confusing them with a civil case.
Remember if they think they are being used to help with a civil fraud, the FBI will close the criminal investigation.
Good luck with the FBI noting I dont intend to get further involved particularly with the FBI so dont even try sending emails suggesting
same. Good Luck! And Joseph Im trying to be extremely helpful here so dont try to bully me with a thousand emails.

I am writing in response to your July 25, 2008 letter to the FBI on behalf of your
constituent, Mr. Joseph Zemick, who alleges corruption in the Los Angeles Superior Courts.
Although Mr. Zemick has made numerous allegations, there are insuHicicnt facts to
demonstrate a violation of federal law within our investigative jurisdiction or to support the initiation
of an FBI investigation. In order for the FBI to initiate an investigation of any complaint we receive,
specific facts must be set forth to indicate that a violation of federal law within our investigative
jurisdiction has occurred.
In the past, Mr. Zemick has been in contact with the FBI's Los Angeles Office and
the Central District of Califomi a United States Attomey's Office regarding these same allegations. In
addition, Mr. Zernick has requested various other elected representatives to contact the FBI and the
Department of JuSlice on his behalf regarding these same allegations.
If Mr. Zernick has further details to support his allegations, he should provide them

This responds to your letter dated July 25, 2008, to the Office of Legislative Affairs,
regarding your constituent, Joseph Zernik. Mr. Zernik asserts that the "Enterprise Track"
procedures for real estate foreclosure cases in the Los Angeles Superior Court violate his civil
rights and have resulted in his being improperly fined. He also complains that he has been
prevented from inspecting and copying records of the Los Angeles Superior Court.
Mr. Zernik's claims are currently pending before the United States District Court for the
Central District of California in civil action 2008cv01550. The action names Superior Court
judges and clerks as defendants. Because the issues are pending before that court, it would be
improper for us to comment on those issues.
Mr. Zernik states that he has already been in contact with the Federal Bureau of
Investigation (FBI) and the United States Attorney's Office (USAO) for the Central District of
California. Legal and ethical constraints prevent us from discussing the status of any matter
under consideration by a USAO, other than facts of public record. Please be assured, however,
that United States Attorneys' Offices take all allegations of criminal conduct very seriously and
carefully review any investigative evidence presented to suppoI1 such allegations. We encourage
Mr. Zernik to continue to provide information that evidences criminal conduct to the FBI.

8 to ask for Notice of Re-Assignment Orders of Samaan v Zernik to the several judges
10 The only Re-assignment Order found in this case on the record that appears
11 legitimate is for Defendant who is Judge Connor (Exh Vol II- Minute Orders, pp200-1).
12 However, this record is likely to be part of fraud inherent in Sustain. Page one of this
13 order is dated 11/1/2005 as its date of entry in the record, whereas page 2 of the same
14 order is dated 1/30/2006. Plaintiff demands his right for full access to electronic Trial
15 Court Records, and believes that he would find there full evidence to show that this
17 No Reassignment Order was ever found for any of the other Defendants who are
18 judges.

20 7. Defendants who are Judges of LA Superior Court are not Eligible for
Immunity since they Officiated as Presiding Judges with no authority at all
21 after being Disqualified.

23 None of the Defendants who are judges had their disqualification adjudicated as
24 required by law. Therefore, after the first disqualification for each and every one of
25 them, they were acting without any authority and without any immunity.
26 The notion heard by Plaintiff that it is a “Local Custom” in LA County not to
27 adjudicate Answers to disqualification is out of compliance with the law, and a
28 fundamental abuse of Plaintiff’s Due Process rights.

Defendant O’Brien himself conceded that he was operating without any authority

when he lodged a Proposed Order for his own appointment on September 14, 2007, that

is after he conducted a hearing on Sept 10, 2007, where he conspired with Samaan’s
13
Counsel, per Oct 11, 2007 Transcript, how to execute an “Entered Oral Judgment”.

9. Defendant who is Receiver Pasternak
16
17 Defendant Pasternak is not eligible for immunity since his appointment on
18 November 9, 2007 was the outcome of a fraudulent motion. Exhibit A in that Motion,
19 which was to be the legal foundation for the appointment was stated in Att Kehsavarzi’s
20 Declaration under penalty of perjury to be the “Judgment by Court Pursuant to CCP
21 437c” issued on Aug 9, 2007 by Defendant Connor.
22 In fact Att Keshavarzi never included the Judgment in any document, since he did
23 not recognize it as a valid record. Instead he included under Tab A the Aug 9, 2007
24 Order Granting Summary Judgment. Such an Order is not sufficient as the basis for
25 execution of judgment as entailed by Pasternak.
26 Defendant Pasternak is also involved in fraud relative to the document entered on
27 the record in LA County Register/Recorder, as the subject for transfer of Deed.
