AlthoughMalaysiainheritedthepoliticalsystemofBritishIndiabasedontheWestminstersystem,whichmade
noprovisionforjudicialreview,theFederalConstitutionofMalaysiainstitutedasystembasedonthatofIndia
whichwasinturninfluencedbyotherconstitutionsincludingthatoftheUnitedStates.Judgesareempowered
todeclarelawsorexecutiveactionsultraviresiftheyclashedwiththeConstitutionand/ortheparent
legislation.However,thispowerwascurbedafterthe1988MalaysianconstitutionalcrisisbythenPrime
MinisterMahathirbinMohamadthroughamendmentstotheFederalConstitution.[1]Aparticularlysignificant
amendmentwastheremovalofthejudicialpowerandsubjectingthejudiciarytosuchjurisdictionandpowers
asmaybeconferredbyorunderfederallaw.[2]ThemeritsofdetentionsmadeundertheInternalSecurityAct
arealsonotsubjecttojudicialreview,buttheproceduresare.[3]
