REGULATION ORDINANCE NO. 2009-218


AN ORDINANCE PROffiBITING THE OPERATIONS OF COLORUM
VEHICLES IN THE CITY OF ILOILO

Sponsored by Councilor Erwin J. Plagata, seconded by Councilors


Antonio V. Pesina, Jr. and Lyndort V. Acap

WHEREAS, the Land Transportation and Traffic Code or Republic Act 4136, as
amended, defines a private motor vehide .a$ vehicles owned by private individuals or companies
which are NOT INTENDED TO BE USE:b FOR HIRE UNDER ANY CIRCUMSTANCES.

WHEREAS, the persistent complaints of legitimate public utility vehicle owners and
drivers against the operations of colorum vehicles are well founded and valid.

WHEREAS, as of date the City of Iloilo has no regulatory ordinance to address


complaints relative thereto.

NOW, THEREFORE, be it ordained, as it is hereby ordained by the Sangguniang


Panlungsod of the City of Iloilo, in session assembled, that:

Section 1. Definition of Terms -

Colorum - for the purposes of this ordinance shall mean any private motorized vehicle
used for public utility and/or commercial purposes; or for hire vehicles used or operated

differently from the type of service indicated in it's Certificate of Public Conveyance issued by
the Land Transportation Franchising and Regulatory Board.

for the purposes of this ordinance shall also means private motorized tricycles used
for public utility or commercial purposes with a franchise duly issued by way of a
franchise ordinance.

Section 2. - It shall be unlawful for any person to operate colorum vehicles in the City of
Iloilo.

Section 3. Penalty Clause -

A. Motorized Vehicles - Any person who violates Section 2 of this ordinance shall be
subjected to:

1st Offense - Fine of Three Thousand Pesos (P3,000.00). In case of insolvency


he shall be subjected to an imprisonment of three (3) days.

2nd Offense-Fine of Five Thousand Pesos (P5,000.00). In case of insolvency


he shall be subjected top an imprisonment of five (5) days.

3rd Offense - Penalty under the second offense plus a recommendation by the
Traffic Management and Engineering Unit to the Land Transportation
Office for the cancellation of registration in case of private vehicles;
and to the Land Transportation Franchising and Regulatory Board
for the revocation of franchise in case of public utility vehicles.

B. Motorized Tricycles - Any person who violates Section 2 of this ordinance shall be
subjected to:

1st Offense - Penalty of Five Hundred Pesos (P 500.00) and warning. In case of
insolvency he shall be subjected to an imprisonment of two (2) days.

2nd Offense - Fine of Five Hundred Pesos (P500.00) and impoundment of the
tricycle unit by the Traffic Management and Engineering Unit.
Should redemption of the unit be made, a redemption fee of Three
Thousand Pesos (P3,000.00) shall be imposed. In case of insolvency
He shall be subjected to an imprisonment of three (3) days.

3rd Offense - Penalty under the second offense plus recommendation by the
Traffic Management and Engineering Unit to the Land Transportation
Office for cancellation of registration.

Section 4. Repealing Clause - All other ordinances, executive orders, resolutions,


regulations, or part thereof, in conflict with the provision of this ordinance are hereby repealed
and revised.

Section 5. Separability Clause - If any provision of this ordinance or the application


thereof to any person or circumstances is held invalid, the remainder of this ordinance and th~
application of such provision to other persons or circumstances shall not be affected thereby.

Section 6. Effectivity - This ordinance shall take effect after publication in a newspaper
of general circulation in the City and Province of Iloilo.
