3.1.2 Plans for Waste Management in Construction / Exploitation Period

In Portugal, legislation about construction and demolition waste (CDW) material is in


force and was published in DECRETO-LEI N. 46/2008 of March 12. This aims at giving
an adequate answer to the following problems:
a) High amount of waste generated in the construction / demolition sector;
b) Heterogeneity of this waste;
c) Geographical dispersion of the workplaces;
d) Transitory nature of the works.

Existing constraints for solving the CDW management problem:


a) Lack of available technical solutions for CDW valorization - in what concerns
sorting, and at the level of appropriate and available sites for the installation of
such waste final disposal units;
b) Need to minimize the amount of waste not subject to recovery the principle of
prevention.

Methodologies and practices to be adopted in the design and execution phases
The preparation of projects and their implementation in the work should focus on the
adoption of methodologies and practices that:
a) Minimize the production and the hazard of the CDW, in particular through reusing
materials and using materials not liable to cause CDW containing hazardous
substances;
b) Maximize the recovery of waste, including through the use of recycled and
recyclable materials;
c) Promote the construction methods that facilitate demolition based on the
application of the principles of prevention and reduction and the hierarchy of
waste management operations.

Prevention and management plan for CDW
1 - In contracts and public works concessions, the project implementation is
accompanied by a prevention and management plan for CDW, which ensures
compliance with the general principles of CDW management and other applicable rules
contained in the Decreto-Lei n. 178/2006, of 5 September.
2 - CDW prevention and management plan must contain:
a) A brief characterization of the construction site, including the description of
construction methods to be used according to the principles defined in Article 2 and
the methodologies and practices referred to in Article 5 of Decreto-Lei n. 178/2006;
b) The methodology for incorporating recycled CDW;
c) The CDW prevention methodology, identification and estimation of the materials to
reuse in their own construction site or other destinations;
d) The reference to packaging methods and CDW screening on site or in a place
assigned to it, and, if it is not expected to be sorting of waste materials, reasons for
this impossibility must be presented;

e) An estimate of the amount of CDW to be produced, the fraction to recycle or


subject to other forms of recovery, and the amount to be eliminated, with
identification of the respective European Waste List code.
3 - It is up to the contractor or concessionaire to execute the CDW prevention and
management plan, guaranting in particular:
a) The promotion to reuse materials and to incorporate recycled CDW onsite;
b) The creation onsite, of an adequate storage system that allows for the selective
disposal and management of the CDW;
c) The application onsite of a CDW screening methodology or, where this is not
possible, their adequate removal and treatment by a licensed operator;
d) The maintenance of CDW onsite for the minimum time possible; which in the
case of hazardous waste, can not exceed three months.

4 - The CDW prevention and management plan can be amended by the owner in the
implementation phase, upon proposal of the CDW producer or, in the case of projetc-
building contracts, the contractor with the owner permission, as long as this change is
justifiable.
5 - The CDW prevention and management plan should be available at the construction
site for the purpose of inspection by the competent authorities, and all intervenient must
be aware of it.

Licenciamento de operaes de gesto de RCD
According to the general and specific legislation::
- Decreto-Lei 73/2011 and Decreto-Lei 178/2006 (storage, sorting, treatment,
recovery and disposal of CDW)
- Decreto-Lei 183/2009 (disposal of CDW in landfills)

Important:
Hazardous waste can not remain onsite for longer than three months
Asbestos containing waste must be handled by operators specifically licensed for
this purpose
