INTERVIEW TO THE CLIENT

SEPTEMBER 21, 2016 (Wednesday)

Interviewer: Hi Good morning! I am Amor and beside me are Claire and

Irish we are Law students from Saint Loiuse University Baguio City, We are
here to conduct an interview about your case for our requirement in our
subject Practicum. Anything that you say to us today will be just between you
and we meaning it will be Confidential.

Interviewee: Yes, maam/ and sir.

Q1: Please state your name, age and other personal circumstances?

A1: JOHN CHRIS K. NEHKEY but most people call me DANDAN, 18

years old (December 13, 1997), single, Filipino, and I am originally from Nueva
Viscaya but in 2014 we transferred to Tinoc, Ifugao to plant and harvest
carrots.

Q2: What are the names of your parents and what do they do for a
living?

A2: My fathers name is Theofilo Nehkey and my mothers name is

Virginia Nehkey. They are both farmers sir.

Q3: Do you have any siblings and how many are you in the family?

A3: Yes sir I have and we are six (6) in the family two (2) boys and four
(4) girls and I am the second child.

Q4: Did you attend school and what year level school level did you finish?

A4: Yes I attended school at Ambaguio Elementary School Nueva Viscaya

in 2007 and finished grade 5 as to my highest educational attainment, maam
and sir.

 Q5: So can you tell us about your case?

A5: Yes sir.

Q6: Why are here and what happened?

A6: I was filed with a case of Alleged Rape. Sometime in August 2015
when I and my father are harvesting our crops (carrots) the Abaton police
enforcers came pretending to be buyers of our crops and asked my name then I
told them that my name is JOHN CHRIS dandan K. NEHKEY then after
they determined that it was me, they told me that I have a case and they show
a warrant of arrest and put handcuffs on both of my hands. I was first detained
in Abaton and then they transferred me here in La Trinidad Provincial Jail last
September 24, 2015.

Q7: Did the Abaton police officers state your Miranda rights while they
are arresting you? That you have the right to remain silent. Anything you say
can and will be used against you in a court of lawetc.. Something like that?

A7: Yes, they did.

Q8: Who filed the complaint against you?

A8: The mother of Roselyn, maam and sir.

Q9: Do you know her surname?

A9: No.

Q10: How are you related to Roselyn and how old is she?

A10: Her mother and my mother are siblings; I think she is twelve (12)
years old maam and sir.

Q11: So you are first cousins correct? Then how come you dont know
her surname?

A11: (smiles)

Q12: From where is Roselyn?

A12: From Tinoc, Ifugao also, but from the other barangay sir.

Q13: How many hours will it take you to go to their place?

A13: If by using a motorcycle, it will take you like three (3) to four (4)
hours.

 Q14: Do you always see her or talk to her or is there any event that you
and her went out alone or play something like that?

A14: No, the first time I saw her is during our grandfathers funeral and
that is also the last time I saw her.

Q15: if thats the case, then what do you think is the reason why the
mother of Roselyn filed a complaint against you and it is even alleged rape?

A15: I dont know.

Q16: Did you already have your arraignment?

A16: Yes, last March 13, 2015 in Abatan.

Q17: Then how come you dont know why they filed a case against you?
Because during arraignment the clerk of court will confirm your identity, reads
the charges against you, and ask you how do you plea guilty or not guilty?

A17: I dont know. I was not paying attention during that time because
what is on my mind during that time is what my lawyer told me that I will not
admit the case filed against me.

Q18: Do you even know what rape is?

A18: No, I dont know.

Q19: Really? Rape is the crime of having sexual intercourse with

someone without his or her consent and against his or her will. Now, do already
have an idea what rape is?

A19: No, I dont know what rape is.

Q20: Then what would be your defense during your hearing if you dont
know about your case?

A20: I dont know

Q21: Then how did you plea during your arraignment guilty or not
guilty?

A21: not guilty sir.

Q22: What is the status of your case?

 A22: I dont know.

Q23: You dont know? Who is your lawyer? Is he not visiting you here to
update you about the status of your case?

A23: Atty. Cupas. No, he is not visiting me here the first and last time I
saw him is during my arraignment.

Q24: What about your parents when they visited you here did they
mention anything about the status of your case?

A26: No, they did not. They just told me that Roselyn will have another
medical examination because the first result did not show any lacerations on
her vagina and that the family of Roselyn will withdraw the case they filed
against me.

Q27: What do you think is the reason why the family of Roselyn will
withdraw the complaint they filed against you?

A27: I dont know.

September 22, 2016 (Thursday).

Q1: Hello again can you tell us again about your case?

A2: I was filed with a case of alleged rape by the mother of Roselyn.

Q2: Who is Roselyn again?

A2: My first cousin.

Q3: Is she married or single? If she is married does she have any
children?

A3: She is married and she has three daughters.

Q4: You told us yesterday that Roselyn is only twelve (12) years old and
now youre telling us that she is married and have three (3) daughters, then
who is the twelve (12) years old you are referring to us yesterday?

A4: I dont know.

Q5: How old are her children?

A5: I dont know..

 Q6: You havent seen them or heard about them?

A6: Yes, I havent seen them.

Q7: Then how come you know that Roselyn have children?

A7: My uncle Noel told me.

Q8: Who is uncle Noel?

A8: My fathers brother.

Q9: Do you have boarding house in Buguias, Benguet?

A9: No, we dont have. I have never been there or live there.

Q10: Do you know a person named Rishelle Cadpino, 6 years old, grade
1 and Milalyn Cadpino, 7 years old, grade 2. Both studying in Ambanglo,
Primary School, Ambanglo, Catlubong, Bungias, Benguet?

A10: No, I dont know them.

Q11: But Rishelle and Milalyn know you they even call you uncle
dandan. Are you sure you dont know them, seen them or heard about them,
they never went to your house to visit you or play?

A11: I dont know I dont know about them.

Q13: Is Roselyn your neighbor?

A13: No, she is not my neighbor.. Never.

Q14: Roselyn never went to your place?

A14: She goes to our place during the harvesting of our carrots.

Q15: Yesterday, you told us that the first and last time you saw her is
during your grandfathers funeral and now youre telling us that she goes to
your place during the harvesting of your crops which one is the truth?

A15: She goes to our place during the harvesting of our carrots.

Q16: Where does she leave her children every time she goes to your place
and harvest carrots?

A16: I dont know, maybe to her husband.

 Q17: Do you know about your case, can you tell us about your case?

A17: No, I dont know and I dont like to know.

Q18: If you dont know about your case then what will be your defense
during your hearing? Do you know the penalty of your case if the court
rendered a decision against you?

A18: I dont know, I will just stay here since no one from my family would
like to help me and my uncle told me that I should just stay here in jail
because I keep on gallivanting.
