ENERGYSERVICECOMPANY(ESCO)

INTRODUCTION

The Ministry of Energy, Green Technology and Water (MEGTW) is support the efforts to improve supply
securityandefficiencyinenergyconsumptionundertheNationalKeyEconomicAreas(NKEAs)fortheOil,
GasandEnergy(OGE)sector.Oneoftheidentifiedenergyperformanceprogram(EPP)istheEPP9whichis
toimproveenergyefficiency

In implementing the above initiatives its required direct involvement of the private sector to implement
projectstoimprovetheenergyefficiencyingovernmentbuildingsthroughEnergyPerformanceContracting
(EPC).EPCimplementationwillofferthegovernmentthefollowingbenefits:

i. Savings in terms of investment to identify and implement energy saving measures in

governmentbuildings;
ii. Annualelectricitybillsavingsandguaranteedenergysavingstargets;
iii. Improve the competency of efficient energy management among the owners of government
buildings;
iv. To drive the energy efficiency services industry to be more viable in the future with the
participationoftheEnergyServicesCompanies(ESCOs),and;
v. Toensureamorecomprehensivebuildingmaintenanceinachievingsustainability.

InensuringsuccessfulimplementationofenergyefficiencyimprovementprojectsbasedontheEPCconcept
for government buildings, ESCOs are required to register with the Ministry of Finance to enable them to
carryouttheEPCactivityinvolvinggovernmentbuildingsundertheGreenTechnologyServicesCode.The
MinistryofFinancerequiresthatESCOsapplyingforregistrationunderthisGreenTechnologyServicesCode
beregisteredwiththeEnergyCommissionasanEnergyServiceCompany.

2. OBJECTIVES

i. To disseminate information on the process for the registration of Energy Service Companies
(ESCOs)withtheEnergyCommission.
ii. To spell out the requirements and conditions for the registration and issuance of a Letter of
RegistrationasanEnergyServiceCompany(ESCO).

3. SCOPEOFWORKOFESCO
The Energy Service Company (ESCO) is required to register with the Ministry of Finance (MOF) to qualify
themasanEPCcontractor,consultantorsupplier.UndertheGreenTechnologyServicesCode,registration
ofESCOsisrequiredforthefollowingscopeofwork:

i. Supplyofenergyefficientdevicesandequipments.
ii. ConsultancyServices.
iii. ContractWorks.
iv. EnergyAudit.
v. DesignEngineering.
vi. ProjectFinancing.
vii. ManagementofEPCContract.
viii. CommissioningandServices.
ix. Theoperationandmaintenanceofequipment/energyefficientinstallation,and.
x. Inspectionofenergyefficiencyimprovementprojects.

4. REQUIREMENTANDCRITERIAFORREGISTRATIONOFESCO
ForpurposesofregistrationofESCOswiththeEnergyCommission,thelistofrequirementsandcriteriatobe
fulfilledbytheapplicantsareasfollows:

i. theapplicanthasregisteredhisbusinesswitheithertheRegistrarofBusinessortheRegistrarof
Companiesasthecasemaybe;
ii. the applicant has employed, on a full time basis, a Registered Electrical Energy Manager as
prescribedundertheEfficientManagementofElectricalEnergyRegulations2008;
iii. theapplicanthasaccesstosuitablemonitoringandtestingequipmentandinstrumentsrequired
forenergyefficiencymanagementworks(PartDoftheAttachmentA);
iv. theapplicanthassatisfactorilyfurnishedalltheinformationasstipulatedintheapplicationform
(AttachmentA).

The Letter of Registration as an Energy Service Company may not be transferred unless with the written
approvaloftheEnergyCommission.

Any change of name, address and other details of the business or company stated in the Letter of
RegistrationmustbeinformedinwritingtotheEnergyCommissionwithin14daysofsuchchange.

IntheeventofanychangeorreplacementofanappointedRegisteredElectricalEnergyManager,theEnergy
ServiceCompanyshallensurethatanewRegisteredElectricalEnergyManagerbeappointedtoeffectsuch
changeorreplacementandtheEnergyServiceCompanyshallnotifyinwritingtoEnergyCommissionwithin
14daysofsuchchangeorreplacement.

All electrical works in relation to the Energy Services provided by the Registered Energy Service Company
must be performed by Competent Persons in accordance with the Electricity Supply Act 1990 and the
ElectricitySupplyRegulations1994.

5. VALIDITYPERIODOFLETTEROFREGISTRATION
TheLetterofRegistrationissuedunderthisguidelineisonlyvalidforaperiodofoneyearfromthedateof
issuanceofthesaidLetterofRegistration.

6. RENEWALOFLETTEROFREGISTRATION
The renewal of the Letter of Registration as an Energy Service Company must be made not less than 1
monthbeforethedateofexpiryoftheregistration.

7. CANCELLATIONOFLETTEROFREGISTRATION
TheEnergyCommissionmaycanceltheLetterofRegistrationasanEnergyServiceCompanyif

i. the holder of the Letter ceases to carry on the business in respect of which he is
registered;
ii. theholderoftheLetterhasbeenadjudicatedabankrupt;
iii. thecompanygoesintoliquidation.

8. RETURNOFLETTEROFREGISTRATION
Where a Letter of Registration as an Energy Service Company is cancelled by the Energy Commission, the
Letter must be returned to the Energy Commission within fourteen days of the notification of the
cancellation.

9. SUBMISSIONOFAPPLICATION
Thecompletedapplicationformtogetherwithallthesupportingdocumentsandanapplicationlettermust
besubmittedtotheDirectorofEnergyManagementandIndustryDevelopment,EnergyCommissionatthe
followingaddress:
