If a final inspection is required, please contact your designated District Office when you are ready for an
inspection of your establishment. For the remainder of the documents requested by the Commission in
the approval order, you may bring all of the required documents, forms and/or fees to the Lansing
Commission office. Staff is available to personally assist you in the office Monday through Friday from
8:00 am to 3:30 pm.

At the April 28, 2017 meeting of the Michigan Liquor Control Commission in

Lansing, Michigan.

ORDER OF LICENSING DENIAL

DAZHR, LLC (applicant) has filed an application for new Class C license issued
under the provisions of MCL 436.1521a(1)(b) to be located at the above noted address,
new Sunday Sales Permits (A.M. & P.M.), one (1) new Additional Bar (for a total of 2
Bars), new Dance-Entertainment Permit, and new Extended Hours Permit (Dance-
Entertainment).
Article IV, Section 40, of the Michigan Constitution (1963), permits the legislature
to establish a Liquor Control Commission, which shall exercise complete control of the
alcoholic beverage traffic within this state, including the retail sales thereof, subject to
statutory limitations. MCL 436.1201(2) provides the Commission with the sole right,
power, and duty to control the alcoholic beverage traffic and traffic in other alcoholic liquor

within this state, including the manufacture, importation, possession, transportation and
sale thereof.

Findings of Fact
Applicant member, Alexa D. Rix, was issued a citation in 2015 for sale to a minor.

Conclusions of Law
Administrative rules 436.1105(2)(g) and R 436.1105(2)(j) provide that the
Commission must consider the applicants past convictions and the effects that the
issuance of a license would have on the health, welfare, and safety of the general public
when determining whether an applicant should be issued a license or permit.
Based on the findings of fact, review of the file, and discussion of the issues at the
meeting, the Commission concludes that the applicants request should be denied under
the provisions of administrative rules R 436.1105(2)(g) and R 436.1105(2)(j) due to the
following:
1. The conviction history of applicant stockholder, Alexa D. Rix.
2. That the issuance of a license would have a negative impact on the health,
welfare, and safety of the general public.

Decision
THEREFORE, IT IS ORDERED that the applicants request is DENIED under the
provisions of administrative rules R 436.1105(2)(g) and R 436.1105(2)(j).

Appeal Right
Under the provisions of administrative rule R 436.1925(2), if a license application
is denied, then the applicant may request an appeal hearing. The request shall be made
to the Lansing office of the Commission within 20 days from the date of the mailing of the
decision of denial.
