Personsaccusedofdrugcrimesarenowbannedfromavailingthemselvesoftheprovisiononpleabargaining,and
onceconvictedincourttheywilllosetheprivilegegrantedbytheprobationlaw,Sen.RenatoCayetanosaidyesterday.

UnderthenewDangerousDrugsLaworRepublicAct9165,alldrugconvictsarenowprohibitedfromavailingofthe
benefitsofprobation.

"Inthepast,manydrugoffendersresortedtopleabargainingandabusedtheprobationlawtoavoidservingtimein
prison,"thesenatorsaid.

Cayetanodisclosedthatpreviously,manyaccusedpushersfacing12to30yearsinprisonsimplypleadedguiltytoa
lessgravedrugoffensepunishablebysixyearsinprisonorlessandafterconviction,theysimplysoughtprobation.

"Soweactuallyhadcaseswhereinconvictedpusherswereabletogoscotfreeandabletoplytheirnefarioustradethe
followingday,"Cayetanosaid.

"ThenewDangerousDrugsLawhasputanendtothisanomaly.Pusherscannolongeravailofpleabargainingforthe
purposeofprobation,"headded.

Section23ofRA9165providesthat:"Anypersonaccusedofanydrugoffenseregardlessoftheimpossiblepenalty
shallnotbeallowedtoavailoftheprovisiononpleabargaining."

Section24declaresthat:"Anypersonconvictedofdrugtraffickingorpushing,regardlessofthepenaltyimposedbythe
court,cannotavailoftheprivilegegrantedbytheProbationLaw."

Cayetanosaidinthepast,pleabargainingforthepurposeofavailingofprobationhadbeenamajorsourceofcollusion
betweenprosecutorsanddefenselawyersindrugcasesandalsoofcorruption.

Thesenatorexpressedconfidencethattheprovisionsofthenewlawwillputmorepushersbehindbarsandmake
homesandstreetssaferfromdrugrelatedcrimes.
