PROBLEM

Vineesh wants to gift his self-acquired property to Vidhya out of natural love and affection as he
had no legal heirs and Vidhya had remained loyal to him all her life. Draft a gift deed for
Vineesh.

MODEL DEED

GIFT DEED

This DEED OF GIFT executed this, the 2nd day of April, 2017 BETWEEN

T. B. Vineesh, son of P.K.Ravi, aged about 62 years and residing at No. 20F/7, Jawahar Nagar,
Kovalam, Kochi 600 020, hereinafter called the DONOR (which term shall mean and
include all their legal heirs, executor, representatives, assigns, etc.) of the ONE PART AND T. D.
Vidhya, daughter of T. R. Balan, aged about 37 years and residing at No. 10, GN Chetty Road,
West Convent Sreet, Kochi 600 033, hereinafter called the DONEE (which term shall mean
and include all their legal heirs, executor, representatives, assigns, etc.) of the OTHER PART.

WHEREAS the donor is the absolute owner of the property consisting of a vacant land covering
an extent of 5 acres, bearing R.S. No. 1378/43, located in Vagamon, Erattupetta village,
Kottayam 600 041, more fully described in the Schedule hereunder, he having acquired the
same from T. N. Krishna, by way of sale in the year 2000, and registered with the District
Registrars office at Vagamon village, Kottayam, as evidenced by Sale Deed No.1898/65.

WHEREAS the donor is desirous of disposing off by way of gift the property consisting of a
vacant land covering an extent of 5 acres, bearing R.S. No. 1378/43, located in Vagamon,
Erattupetta village, Kottayam 600 041, more fully described in the Schedule hereunder, since
the said property is no longer required for his use and to gift the property to the donee in
consideration of natural love and affection for the loyalty of the donee towards the donor.

WHEREAS the donor and donee having carried out the negotiations for the Grant of Loan and
Acceptance respectively of the property consisting of a vacant land covering an extent of 5 acres,
bearing R.S. No. 1378/43, located in Vagamon, Erattupetta village, Kottayam 600 041, more
fully described in the Schedule hereunder, the donor having agreed to transfer the said property
and the donee having agreed to accept the same for no consideration.

NOW THIS DEED WITNESSES THAT IN CONSIDERATION OF the donor having agreed to
transfer and the donee of a vacant land, covering an extent of 5 acres, bearing R.S. No. 1378/43,
located in Vagamon, Erattupetta village, Kottayam 600 041, more fully described in the
Schedule hereunder, the donee having agreed to accept the same; the donor does hereby convey
unto the donee absolutely all the title and interests in the Schedule mentioned property and
further, the donor also delivering vacant possession of the said property to the donee to enable
the donee to enjoy the said property absolutely and without any interruption of whatsoever
nature.

TO HAVE AND TO HOLD the property by the purchaser absolutely and forever and without
any encumbrance of whatsoever nature.

THAT the donor and donee hereby mutually covenant as follows:

1. The Donor hereby declares that the Donee may at all times hereafter peacefully and
quietly enter upon, possess and enjoy the said property, as he deems fit without any
interruption, claim or demand whatsoever from or by the Donor.
2. The Donor hereby assures the Donee that the property hereby sold to the Donee is free
from all encumbrances and that if any subsisting is found to be there, the same shall be
discharged at the expenses of the Donor.
3. The Donor hereby declares that in respect of the property sold by him to the Donee, he
shall pay all the taxes and other levies due on the property up to the date of execution of
this Gift Deed and that the Donee shall pay the taxes and dues falling due hereafter.
4. The Donee shall apply to the appropriate authorities and arrange to carry out the change
of name required in all the necessary record and for this purpose, the Donor is always in
readiness to give consent and affix his signature.
5. The Donor hereby declares that he surrendered all the parent deeds connected with the
property and that no document is retained by him.

IN WITNESS WHEREOF, the parties hereto have set their hands on this, the 2 nd day of April,
2017.

All that piece and parcel of land including all trees and bushes property, covering an extent of 5
acres, bearing R.S. No. 1378/43, located Vagamon, Erattupetta village, Kottayam 600 041, and
bounded on,

NORTH by a house Door No. 151, bearing R.S.No. 1378/43 and belonging to J. Hari, and having
a right of entry to the property from this side.

SOUTH by a house Door No.101, bearing R.S.No. 1385/43 and belonging to S. Ram

WEST by 50 Feet Road leading to Kovalam city

EAST by a 30 road leading to Ayyapan Temple and situated within the Registration and Sub-
Registration District of Vagamon village, Kottyam.
