WHEREAS, Regulation Ordinance No. 99-118 is "An Ordinance Condemning


and Penalizing Vandalism including Graffiti in the City oflloilo";

WHEREAS, Section 16 of the Local Government Code states that "Every local
government unit shall exercise the powers expressly granted, those necessarily implied
there from. as well as the powers necessary, appropriate, or incidental for its efficient
and effective governance, and those which are essential to the promotion of the general
welfare";

WHEREAS, aerosol spray paints are the primary tool being used by the
graffitist;

WHEREAS, those who are prone to commit vandalism and graffiti are minors;

WHEREAS, boredom, alienation, family and community breakdown, lack of


leisure opportunities and youth unemployment have all been cited as causes;

WHEREAS, these minors are free to purchase aerosol paints and other painting
paraphernalia from stores and are used in vandalizing walls, fences and other properties
in the City of Iloilo.

NOW, THEREFORE, be it ordained by the Sangguniang Panlungsod of the City


of Iloilo, in session assembled, that:

Section I. - Title. This Ordinance shall be known as "AN ORDINANCE


REGULATING THE SALE OF AEROSOL SPRAY PAINTS TO MINORS IN THE
CITY OF ILOILO AND FOR OTHER PURPOSES"

Section 2. - Purpose. To regulate the sale of aerosol spray paints as it is used as


a tool of vandalism in the City of Iloilo especially graffiti painting as defined in the
ordinance.

Section 3. - Coverage. This ordinance shall apply to all establishment or person


selling aerosol spray paints in the City of Iloilo.

Section 4. - Defmition of Terms:

1. Graffiti - the result of an act of inscribing or designing unnecessary signs or


letters, languages or designs in walls or building of private or public places
which defaces the said structure.
2. Minors-persons below eighteen (18) years old.
3. Aerosol paints - paint in a sealed pressurized container that is released in a
fine spray mist when depressing a valve button.
4. Graffiti implement - an aerosol container.

Section 5. All establishments selling aerosol spray paints shall register and keep
a record of sales of aerosol spray paints sold to their customer. Registration shall
include the name of customer, address, date of purchase, color of aerosol paint and
purpose of purchase.

Section 6. Any establishment or person who sells aerosol spray paint containers
shall display at the location of retail sale a sign, in letters at least three-eight of an inch
high, clearly visible and legible to employees and customers which states, as follows:

"MINORS SHALL NOT BE ALLOWED TO


PURCHASE AEROSOL SPRAY PAINTS UNLESS
ACCOMPANIED BY A RESPONSIBLE ADULT"

Section 7. - Administrative Penalties. Any establishment or person found


violating Sections 3, 5 and 6 of this ordinance shall be imposed the following
administrative penalties:

First Offense : A fine of PS00.00


Second Offense : Suspension of Mayor's Permit for a period of one (1)
week or a fine of Pl,000.00
Third Offense : Cancellation of the Mayor's Permit to operate for the
establishments found violating Sections 3, 5 and 6 of
this ordinance or a fine of PS,000.00

Section 7. - Separability Clause. If, for any reasons or reasons, any part or
provision of this ordinance be declared unconstitutional or invalid, the other parts or
provisions thereof not affected shall continue to be in full force and effect.

Section 8. - Repealing Clause. All other existing ordinances and resolutions


inconsistent herewith are repealed or modified accordingly.

Section 9. - Effectivity. This ordinance shall take effect fifteen (15) days after
its approval and publication in a newspaper of general circulation in the City of Iloilo.
