REGULATION ORDINANCE NO. 2008-225


AN ORDINANCE AMENDING SECTION 3 OF ORDINANCE NO.
338, SERIES OF 1992 "AN ORDINANCE EMPOWERING
POLICEMEN AND TRAFFIC AIDES TO ISSUE TRAFFIC
CITATIONS TO VIOLATORS OF CITY TRAFFIC ORDINANCES
PROVIDING FOR THE PROCEDURES AND PENALTIES FOR
VIOLATION THEREOF AND FOR OTHER PURPOSES"

Councilors Antonio V. Pesina, Jr. and Lyndon V. Acap

WHEREAS, Ordinance No. 338, Series of 1992 empowers policemen and traffic
aides to issue traffic citations to violators of city traffic ordinances and provided for the
procedures and penalties for violations;

WHEREAS, Section 3 of Ordinance No. 338, Series of 199Z authorizes ONLY


the Office of the City Treasure to forward "Protested" traffic citation tickets to the Office
of the City Prosecutor for immediate filing at the Municipal Trial 6ourt in Cities in Iloilo
City to be dealt with in accordance with law;

WHEREAS, in order to expedite the above mentioned procedure, an amendment


to Section 3 is necessary.

NOW, THEREFORE, be it ordained by the Sangguniang Panlungsod of the City


of Iloilo, that:

Section 1. - Section 3 of Ordinance No. 338, Series of 1992, is hereby amended


to read, as follows:

"Section 3. - Such person issued a traffic citation if he does not


intend to question or protest the issuance of such traffic citation, shall
withinforty eight (48) hours from such apprehension, immediately pay the
fine as imposed by the city traffic ordinance concerned to the Office of the
City Treasurer, who shall then issue an official receipt evidencing
payment of such fine. The official receipt for pavment is to be presented
to the Office of the Traffic Management for immediate release of the
confiscated driver's license. if anv. In the event such person desires to
question or protest the issuance ofsuch traffic citation or payment of such
fine is not made within the forty eight (48) hour period, it shall be
presumed that it is being protested and the Office of the City Treasurer
shall stamp mark the traffic citation as "Protested" and within forty eight
(48) hours refer the same to the Chief. Traffic Management and
Engineering Unit fTMEU), as the head agency, in coordination with the
City Legal Office or City Treasurer's Office or Office of the City
Prosecutor or ro er ilin at the Municipal Trial Court in Cities in
lloilo ity to be dealt with in accordance with law.

Section 2. - This ordinance shall take effect upon approval.
