AGREEMENT OF SUPPORT

KNOW ALL MEN BY THESE PRESENTS:

This Agreement of Support entered into this ___ day of ____________ 2016 by
and between:

ALEXANDRE CABULISAN LOCATE, of legal age, Filipino and a

resident of Block 62 Lot 18, Floraville St., Rizal Makati City, hereinafter
referred to as the FIRST PARTY

and

MARY GRACE TOMATE LOCATE, of legal age, Filipino and with office
address at Mezzanine Floor, Adamson Centre, 121 L.P. Leviste St.,
Salcedo Village, Makati CIty, hereinafter referred to as the SECOND
PARTY

WITNESSETH:

WHEREAS, the parties herein are married to each other;

WHEREAS, during their marriage, they were blessed with a child

named ALYSSA MARCELLE TOMATE LOCATE, a minor and currently living with
the SECOND PARTY.

WHEREAS, the parties herein, due to irreconcilable differences, have

mutually agreed to live separately from each other, leaving to the SECOND
PARTY, the care and custody of their minor child;

WHEREAS, the FIRST PARTY, aware of the fact that the minor, ALYSSA
MARCELLE TOMATE LOCATE , is his legitimate child, recognizes and accepts his
responsibility to support the needs of his said minor child;

NOW THEREFORE, in view of the foregoing, the parties hereby agree to

the following:

1. The FIRST PARTY, without need of demand, shall give to the

SECOND PARTY a financial assistance for the care and support of his minor
child, ALYSSA MARCELLE TOMATE LOCATE, in the amount of but not limited to
FIFTY THOUSAND PESOS (Php50, 000) which shall be increased on the event
that economic needs of the child shall arise and which shall be paid on or
before the 30th day of each month, beginning July 2016 to be delivered by
him at the residence of the SECOND PARTY or deposited to a bank account
that shall be opened for the purpose;

2. Aside from the financial assistance stated in the immediately

preceding paragraph, the FIRST PARTY shall support the education of the
minor ALYSSA MARCELLE TOMATE LOCATE from elementary up to college by
paying in full the tuition and other matriculation fees of the latter in the
school of her choice;

3. In the event that the minor ALYSSA MARCELLE TOMATE LOCATE is

hospitalized for whatever reason, the FIRST PARTY shall shoulder all medical
expenses including but not limited to, hospital bills, doctors fees, medicines
and laboratory expenses.
 4. The SECOND PARTY shall GIVE the FIRST PARTY visitorial rights
over their said minor child, ONCE A WEEK, but not to bring the minor child
outside the residence of the SECOND PARTY except when accompanied by
the SECOND PARTY or her representative;

5. Should the FIRST PARTY fail or refuse to comply with his

obligation herein, the SECOND PARTY shall seek the intervention of the
courts of law or any other agency to enforce this agreement or to initiate the
necessary proceedings against the FIRST PARTY;

6. The SECOND PARTY is reserving other rights, if there should arise

such, in favour of the Minor Child of the Parties.

7. The SECOND PARTY is reserving the sharing rights under the

Common Community Fund which shall be demandable in determinate future
time.

8. If any clause of this Agreement is determined to be

unenforceable, those clauses shall be severable, while other provisions of
this agreement shall remain in effect.
