PROPOSED ORDINANCE NO. ___

AN ORDINANCE CREATING THE ILOILO CITY YOUTH DEVELOPMENT DIVISION


IN THE CITY OF ILOILO PROVIDING FOR ITS STAFFING PATTERN AND
APPROPRIATING FUNDS FOR THE PURPOSE THEREOF.

WHEREAS, under the General Welfare Clause of the Local Government Code,
every local government shall exercise the powers expressly granted, those
necessarily implied therefrom, as well as powers necessary, appropriate, or
incidental for its efficient governance, and those which are essential to the
promotion of the general welfare.

WHEREAS, under the 1987 Philippine Constitution, one of the declared policies of
the state is that it recognizes the vital role of the youth in nation-building and shall
promote and protect their physical, moral, spiritual, intellectual, and social well-
being, inculcating in the youth patriotism and nationalism, and encourage their
involvement in public and civil affairs.

WHEREAS, under Section 25 of Republic Act 10742, otherwise known as the


Sangguniang Kabataan Reform Act of 2015, there shall be in every province, city,
and municipality a youth development office.

WHEREAS, under Section 27 of Republic Act 10742, otherwise known as the


Sangguniang Kabataan Reform Act of 2015, the local government unit shall
incorporate in its annual budget such amount as may be necessary for the
operation and effective functioning of the local youth development office and in
accordance with the COA accounting and auditing rules and regulations.

NOW THEREFORE, be it ordained by the Sangguniang Panlungsod of Iloilo City in


session duly assembled that:

Section 1. Title This ordinance shall be known as an ordinance creating the


Iloilo City Youth Development Division in the City of Iloilo and appropriating funds for
the purpose thereof.

Section 2. Declaration of Policy It is a declared policy of the city to


promote the positive development of the social and emotional environment of the
youth, protect their rights and interests, inculcating in them patriotism and
nationalism, and encourage their involvement in public and civic affairs.

Section 3. Creation The Iloilo City Youth Development Division (CYDD) is


hereby created in the City of Iloilo under the Office of the City Mayor.

Section 4. Definition of Terms As used in this ordinance, the following


terms shall mean:

a) Commission refers to the National Youth Commission created under


Republic Act No. 8044;

b) City Youth Development Council (LYDC) A multi-sectoral youth


association, which shall be called, City Youth Development Council (CYDC),
headed by the concerned Sangguniang Kabataan Pederasyon President

and composed of representatives of Youth Organizations and Youth-
Serving Organizations in the city level;

c) Local Youth Development Plan (LYDP) refers to the City Youth


Development Plan as initially drafted by the Sangguniang Kabataan
Pederasyon, finalized by the CYDC and approved by the local sanggunian.
Local Youth Development Plan (LYDP) shall be anchored on the Philippine
Youth Development Plan (PYDP) and the local development plans of Iloilo
City;

d) Youth refers to a person whose age ranges from fifteen (15) to thirty
(30) years as provided for under Republic Act 8044 or the Youth in Nation-
Building Act of 1998. For the purpose of targeted programming for the
youth, the age disaggregation shall be considered:
15-17 - child youth
18-24 - core youth
25-30 - adult youth;

e) Youth Organizations refer to those organizations whose membership


or composition are youth;

f) Youth-Serving Organizations refers to those registered organizations


whose principal programs, projects, and activities are youth-oriented and
youth-related, and whose composition are not limited to the youth. The
organization shall be duly-recognized or accredited either by proper
national or local government entities.

Section 5. Functions of the Office The City Youth Development Division


shall have the following functions:

a) Register and verify Youth Organizations and Youth-Serving Organizations


in accordance with the Youth Organizations Registration Program
guidelines, ordinances and other existing laws;
b) Provide technical assistance to the City Youth Development Council of
Iloilo City in the formulation of the Local Youth Development Plan;
c) Facilitate the election of the City Youth Development Council
representatives;
d) Serve as secretariat to the City Youth Development Council;
e) Conduct the mandatory and continuing training of Sangguniang Kabataan
Officials and City Youth Development Council members, in accordance
with the programs jointly designed and implemented by the National
Youth Commission and the Department of the Interior and Local
Government. The City Youth Development Officer and/or his/her staff shall
apply for accreditation from the Commission in order for them to conduct
the mandatory and continuing training programs of Sangguniang
Kabataan Officials and CYDC members;
f) Provide technical, logistical and other support in the conduct of the
mandatory and continuing training programs, and to such other programs
of the Commission and Department of the Interior and Local Government;
g) Coordinate with the Commission, with regard to the youth programs within
their jurisdiction;
h) Perform such other functions as may be prescribed law, ordinance, or as
required by the City Mayor, Department of the Interior and Local
Government and the Commission.

Section 6. Composition and Structure The City Youth Development


Division shall be initially organized and composed of the City Youth Development
Officer to be assisted by three (3) personnel responsible for: (1) policy and planning;
(2) administration and finance (3) programs and operations.

who shall head the City Youth Development Division shall have the
position of at least Division Chief, consistent with the existing law.

In addition to the requirements prescribed by the Civil Service


Commission, the City Youth Development Officer provided under section
26 of the RA 10742 shall have the following qualifications:

i) Preferably not more than thirty years of age at the time of his/her
appointment;
ii) Must be a registered voter of Iloilo City;
iii) Must be a resident of Iloilo City for a period of at least 6 months at the
time of his/her appointment;
iv) Be of good moral character;
v) Must have acquired experience in youth development affairs or
involvement in Youth Organizations or Youth-Serving Organizations for
at least three (3) years; and
vi) He/She shall be appointed by the City Mayor, but in no case is he/she
be within the fourth (4th) civil degree of consanguinity or affinity of the
appointing authority.
vii) Has not been found guilty of a crime involving moral turpitude or of
infamous, disgraceful or immoral conduct, dishonesty, drunkenness or
addiction to drugs;
viii) Has not been dismissed from the service for cause or has currently no
pending administrative cases against him.

b) Implementing Units If the funds of Iloilo City are sufficient, the City
Youth Development Division shall create units to perform and undertake
activities, tasks and services that underlines the 3 important areas of the
office, but shall not be limited to the following:

i) Policy and Planning Unit Designs, evaluates and modifies policies to


ensure that programs are effective and in compliance with legal
requirements.
ii) Administration and Finance Unit Oversee all financial resources
and administrative aspects of the office.
iii) Programs and Operations Unit Manage delivery and overall
success of all programs, activities, and projects.

c) Other Personnel of the City Youth Development Office The City


Mayor, upon the recommendation of the City Youth Development Officer,
may provide additional staffing requirements in the CYDD and shall be
appointed by the City Mayor in whatever status deemed appropriate, and
in accordance with civil service rules and regulations.

Section 7. Iloilo City Youth Development Fund The City of Iloilo shall
incorporate in its annual budget such amount as may be necessary for the
operation and effective functioning of the CYDD and in accordance with the COA
accounting and auditing rules and regulations.

Section 8. Appropriations the Iloilo City Government shall allocate and


appropriate budget for the implementation of this Ordinance.

Section 9. Repealing Clause - All other policies or laws creating


organizations, councils or boards in the city which exists having similar program
with the City Youth Development Council are hereby repealed.

Section 10. Effectivity Clause - This ordinance shall take effect within thirty
(30) days from its approval and publication in a newspaper of local circulation.
