A BILL
ENTITLED

AN ACT concerning

Department of Corrections Duties

FOR the purpose of amending the duties of the Baltimore County Department of Corrections to

include certain immigration law enforcement functions; and generally relating to the

Department of Corrections.

BY repealing and re-enacting, with amendments

1 SECTION l. BE IT ENACTED BY THE COUNTY COUNCIL OF BALTIMORE

2 COUNTY, MARYLAND, that the Laws of Baltimore County read as follows:

4 ARTICLE 3 ADMINISTRATION

5 Title 2 The Administrative Services

6 Subtitle 3 Department of Corrections

8 3-2-302. DUTIES OF THE DEPARTMENT.

9 The Department of Corrections shall:

10 (1) Take charge of the detention facilities and inmates in the detention facilities;

11 (2) Be responsible for the safekeeping, care, and feeding of an inmate in the detention facilities

12 from the time the inmate is committed until the inmate is legally released, including while the

13 inmate is working outside the detention facilities and going to and from that work;

14 (3) At the expense of the county through the budgetary and purchasing requirements of the

15 Charter and the Code, provide food and board for all inmates committed to its charge, including

16 food and other articles for the comfort of sick inmates as the physician attending sick inmates

17 considers necessary;

18 (4) Comply with all rules adopted by the county concerning the detention facilities buildings and

19 the inmates;

20 (5) Admit no visitor to the inmates except in accordance with the rules; [and]

21 (6) In accordance with state law, keep a complete record of an inmate committed to its custody,

22 when and by whom committed, the charge, and when released, together with other information

23 required by the county[.]; AND

1 (7) PARTICIPATE IN THE IMMIGRATION AND NATIONALITY ACT SECTION 287(G)

2 PROGRAM, AND THE COUNTY SHALL EXECUTE SUCH MEMORANDUM OF

3 AGREEMENT (MOA) AND ALLOCATE SUFFICENT FUNDS, INCLUDING PERSONNEL

4 AND OTHER NECESSARY RESOURCES, IN ORDER TO IMPLEMENT THE PROGRAM.

6 SECTION 2. AND BE IT FURTHER ENACTED, that this Act, having been passed by

7 the affirmative vote of five members of the County Council, shall take effect on June 19, 2017.
