A RESOLUTION AUTHORIZING THE CITY MAYOR RICHARD I.

GOMEZ OR HIS DULY AUTHORIZED REPRESENTATIVE TO


ENTER INTO AND SIGN A MEMORANDUM OF AGREEMENT
(MOA) FOR AND ON BEHALF OF THE LOCAL GOVERNMENT OF
ORMOC (LGU-ORMOC) TO RESORT TO NEGOTIATED
PROCUREMENT IN TIMES OF CALAMITY.

WHEREAS, the City Mayor Richard I. Gomez through an Indorsement dated June 08,
2017 forwarded to this august Body for consideration a Memorandum of Agreement (MOA) to
be entered into by LGU-Ormoc to resort to negotiated procurement in times of calamity and
further requesting for authority to sign the same, a copy of the final MOA is hereto attached and
made an integral part hereof;

WHEREAS, the availability of common commodities are scarce in times of calamities;

WHEREAS, Republic Act (RA) No. 9184, otherwise known as the Government
Procurement Reform Act provides that in cases of emergencies, a procuring entity may directly
negotiate with a technically, legally and financially capable supplier, contractor or consultant
since during such state of calamity, immediate action is necessary to prevent damage to or loss of
life or property, or ti restore vital public services, infrastructure facilities and other public
utilities;

WHEREAS, the need to procure goods and infrastructure projects through Negotiated
Procurement under Section 53.2 (Emergency Cases) of the IRR of R.A. 9184 in order to carry
out rescue, recovery, relief, and/or rehabilitation efforts brought about by the damage caused by
calamities is but necessary;

WHEREAS, there is a need to pass a resolution granting a blanket authority to the City
Mayor to enter and sign for and on behalf of the City Government of Ormoc to enter into
negotiated procurement in times of calamities so as to facilitate the swift and smooth operation
of all emergency and disaster response projects for the City;

WHEREAS, the subject MOA clearly and plainly encapsulates the terms and conditions
of the agreement of the parties thereto, including their specific roles and obligations towards the
attainment of the lofty ends of the same, and this Sanggunian, upon thorough review, finds that
overall it is favorable and advantageous to all Ormocanons for faster and more efficient disaster
response operations by the City Government, and therefore, is most deserving of this august
Bodys prompt and favorable consideration;

WHEREFORE, on motion of SP Member Benjamin S. Pongos, Jr. Chairman,


Committee on Laws and Ordinances, _______ seconded by SP Member ___________; be it
RESOLVED, AS IT IS HEREBY RESOLVED, to pass a RESOLUTION
AUTHORIZING THE CITY MAYOR RICHARD I. GOMEZ OR HIS
DULY AUTHORIZED REPRESENTATIVE TO ENTER INTO AND
SIGN A MEMORANDUM OF AGREEMENT (MOA) FOR AND ON
BEHALF OF THE LOCAL GOVERNMENT OF ORMOC (LGU-
ORMOC) TO RESORT TO NEGOTIATED PROCUREMENT IN
TIMES OF CALAMITY.

RESOLVED, FINALLY, to furnish copies of this resolution each to the City Mayor of
Ormoc Richard I. Gomez, the City Administrator, Mr. Vincent L. Emnas; the City Legal Officer,
Atty. Jasper Lucero; and other concerned offices for their information and guidance.
