bulltamingsporthavegotatemporaryrelief.Butevenasthefightfora
permanentsolutioncontinues,onequestiononeveryonesmindiswhether
thisordinancewillwithstandthescrutinyofthecourts.

ThisquestionisespeciallyrelevantsincetheTamilNadugovernmenthad
broughtinalawin2009fortheregulationandconductofthesport,which
wasstruckdownbytheSupremeCourtinits2014verdictinthejallikattu
case.

Sowhyshouldthisordinancebeanybetter?

Theshortanswer:TheyvegottheassentofthePresidentofIndiathistime
aroundandthePCAActforthestateofTamilNaduhasbeenamended.

Letsbackupalittlehere.In2009,whentheTamilNadugovernmenthad
madetheTamilNaduRegulationofJallikattuAct,theydrewpowerfromthe
StateListofSchedule7oftheConstitution.Thisisalistofitemsoverwhich
thatonlyastategovernmentcanmakelaws.

ThePreservation,protectionandimprovementofstockcomes
underthestatelist,andtherefore,TamilNaduwaswellwithinitsrightto
passsuchalaw.

However,thingschangedin2011whentheSupremeCourtorderedthatthe
bullshouldbeaddedtothelistofanimalsthatcannotbeusedfor
performancepurposes.Andwiththat,thejurisdictionformakinglawson
jallikattuchanged.

thattheTamilNaduRegulationofJallikattuAct,2009,wasvoid.

TheapexcourtquotedArticle254(1)oftheConstitutioninmakingthis
judgment.

Article254(1):IfanyprovisionofalawmadebytheLegislatureof
aStateisrepugnanttoanyprovisionofalawmadebyParliament
whichParliamentiscompetenttoenact,ortoanyprovisionofan
existinglawwithrespecttooneofthemattersenumeratedinthe *T&CApply

ConcurrentList,then,subjecttotheprovisionsofclause(2),
thelawmadebyParliament,whetherpassedbeforeorafterthelaw
madebytheLegislatureofsuchState,or,asthecasemaybe,the
existinglaw,shallprevailandthelawmadebytheLegislatureofthe
Stateshall,totheextentoftherepugnancy,bevoid.

Whatthismeansisthat,subjecttoprovisionsofclause(2)ofthisArticle,a
lawmadebyastategovernmentonaconcurrentlistsubject,whichgoes
againstacentralgovernmentlawonthesamesubject,willbebeconsidered
void.

Andclause(2)ofArticle254says,thatsuchastatelawwillbeatthecentral
governmentlawifthePresidentofIndiahasgivenhisassenttoit.

Article254(2):WherealawmadebytheLegislatureofaStatewithrespect
tooneofthemattersenumeratedintheconcurrentListcontainsany
provisionrepugnanttotheprovisionsofanearlierlawmadebyParliament
oranexistinglawwithrespecttothatmatter,then,thelawsomadebythe
LegislatureofsuchStateshall,ifithasbeenreservedforthe
considerationofthePresidentandhasreceivedhisassent,prevail
inthatState:ProvidedthatnothinginthisclauseshallpreventParliament
fromenactingatanytimeanylawwithrespecttothesamematterincluding
alawaddingto,amending,varyingorrepealingthelawsomadebythe
LegislatureoftheState.

Sincetheordinancehasbeenpromulgatedaftergettingtheassentofthe
President,somepeoplebelievethatthistimearound,itwillstandabetter
chanceinthecourtsoflaw.

AsthePresidenthasgivenhisassent,theordinanceandthesubsequent
lawwillprevailIncaseofaconflict,saysBalakumarSomu.
