JUDICIAL AFFIDAVIT OF MARK VARGAS

I, Mark Vargas, of legal age, married and residing at

Bolton Street, Poblacion District, Davao City, state under
oath that I am the chemist in the above-entitled case state
under oath as follows:

Preliminary statements

I am the same and identical person who caused the

execution of this Judicial Affidavit under the supervision and
at the law office of the undersigned counsel with name and
address stated below;

The person interrogating me is Atty. Simoun Ibarra,

who is a resident of Luna Ext., Digos City, Davao del Sur.
The interrogation is being held at the said address. I am
answering his questions fully conscious that I do so under
oath and that if I lie. I may face criminal liability for false
testimony and perjury.

Q1 Do you remember having executed an Affidavit Mr.

A1 Yes sir.

Q2 I have here an Affidavit dated March 1, 2017, is this

the affidavit you have executed?
A2 Yes Sir.

Q3 There is a signature above the printed name Mark

Vargas, whose signature is this?
A2 It is mine sir.

Q4 Above the printed name Ricardo Dalisay there is a

signature, whose signature is this?
A4 It is the signature of Fiscal Ricardo Dalisay, sir.

Q5 How did you know

A5 Because I saw him sign the document, sir.

Q6 Where were you last February 28, 2017 at around 9 in

the evening?
A6 I was on duty sir. I was at the Regional Crime
Laboratory.

Q7 What happened on February 28, 2017 at aroung 9 PM,

if any?
A7 I was on duty sir when Ms. Glenda Corpuz came to our
office to have a specimen checked.

Q8 What do you by to have a specimen checked?

A8 She had with her a specimen and she wanted me to
identify if it is an illegal drug.

Q9 And so what did you do after that?

A9 Well then, I told her to log in to our record book, to put
on record her time of arrival as well as the specimen
she brought with her.

Q10 And then?

A10 And then I put the specimen in our drug machine,
which is used to identify whether the specimen is an
illegal drug.

Q11 And what did you find?

A11 The object, which is weighing 7.584 grams, is positively
identified by the machine as a methamphetamine
hydrochloride also known as shabu.

Q12 And so after finding that the object is a marijuana,

what did you do?
A12 Thereafter, I issued a certificate stating as to the
authenticity of the test, stating specifically the time it
was transmitted to my office, who hand it over to me,
the weight of the drug, and the positive result; that
indeed, it a shabu.

Q13 For how long have you been working as a chemist, sir?
A13 For ten years already Atty.

Q14 Did you ask the Chemist Licensure Exam?

A14 Yes sir.

Q15 Were there any instances, if any, wherein your study or

identification of a specimen became wrong?
A15 None sir.

Q16 Were there instances, if any, wherein your drug

machine detector malfunctioned?
A16 None sir.

Q17 Do you attest as to the truth of your testimonies Mr.

Witness?
A17 Yes sir.

Vargas, witness in the above-entitled case, with address at
Bolton Street, Poblacion District, Davao City, in his
testimony as to the circumstances relative to the above-
entitled case;

I recorded the questions I asked Mark Vargas and

corresponding answers to these questions; and

Neither I nor any person then present coached Mark

Vargas regarding his answers.
