(SECTION A) (04X15)
1. It is common for large organizations selling on credit to ask would be buyer to sign an
agreement, but not to commit the organization until they have taken up credit reference on
the buyer. The form signed by the buyer usually contains a clause such as:
This shall only become binding on the owners upon acceptance by signature on their behalf
and shall be deemed to be made on the date on which it is so signed.
If the agreement is signed by the owners, but before they have communicated this to the
other party, the letter notifies them that he is withdrawing, what is the legal position as to the
formation of the contract? Explain in the light of the legal provisions and leading case laws.
2. What is the scope of the doctrine of Restraint of trade especially restraints which are
applicable after the termination of employment Contracts with judicial pronouncements and
statutory provisions.
3. When the party of his own Contract-creates a duty or charge upon himself, he is bound to
make it good. Explain in detail with the help of the applicable statutory provisions and case
laws.
4. Mr. JK owned a factory constructed on a plot of agricultural land. The land was entered in
the revenue records in the name of his brother, Mr. Karam singh. Mr. JK agreed to sell the
land and the factory for Rs. 500,000 to Mr. Kalyan Singh. J.K. received a part payment Rs.
2,50,000 and put Mr. Kalyan Singh in possession of the property Mr. JK had undertaken in
the agreement above stated to get the name of his brother, Mr. Karam Singh removed from
the revenue records. Following this, Mr. Kalyan Singh was to pay the balance on or before
25 Feb. 2016. Kalyan Singh was willing to do so. However, the land continued to be in the
name of Karam Singh till March 10, 2016. As Mr. Kalyan Singh did not pay the money by
the appointed date, Mr. JK terminated the contract. Whether this termination can be justified.
Decide as per the provisions of the Indian Contract Act, 1872.
5. Distinguish unilateral agreements from bilateral agreements with the leading judicial
pronouncement.
6. B and C get into an agreement whereby B will pay Rs. 30,000 to C and C will transfer the
ownership of his Cell-Phone to A. In pursuance of this agreement B has paid Rs. 30,000 to C
but C refuses to transfer the ownership of his Cell-Phone to A. as a result, A launched a suit
against C Argue on behalf A and C. Decide with leading case laws.

and two of brandy and I accept them, what price I shall pay for the brandy. Elucidate in
detail.
10. The sponsors of a city cricket team entered into an agreement with the owners of the city
team that they would pay Rs. 5 lakh as bonus to the owner of the city team for every wine.
What type of contract it is? Explain with the applicable section in the Indian Contract Act,
1872.

DSM-5 Diagnostic Criteria for Generalized Anxiety Disorder

The diagnostic criteria for GAD as defined by the Diagnostic and Statistical Manual of
Mental Disorders (DSM-5, 2013) published by the American Psychiatric Association, are as
follows:

A. Excessive anxiety and worry (apprehensive expectation), occurring more days than not
for at least 6 months, about a number of events or activities (such as work or school
performance).
B. The individual finds it difficult to control the worry.
C. The anxiety and worry are associated with three (or more) of the following six symptoms
(with at least some symptoms having been present for more days than not for the past 6
months):
Note: Only one item is required in children.

1. Restlessness or feeling keyed up or on edge.

2. Being easily fatigued.

3. Difficulty concentrating or mind going blank.

4. Irritability.

5. Muscle tension.

6. Sleep disturbance (difficulty falling or staying asleep, or restless, unsatisfying sleep).

D. The anxiety, worry, or physical symptoms cause clinically significant distress or


impairment in social, occupational, or other important areas of functioning.
E. The disturbance is not attributable to the physiological effects of a substance (e.g., drug
abuse, medication) or another medical condition (e.g., hyperthyroidism).
F. The disturbance is not better explained by another mental disorder (e.g., anxiety or worry
about having panic attacks in panic disorder, negative evaluation in social anxiety
disorder social phobia, contamination or other obsessions in obsessive-compulsive
disorder, separation from attachment figures in separation anxiety disorder, reminders of
traumatic events in posttraumatic stress disorder, gaining weight in anorexia nervosa,
physical complaints in somatic symptom disorder, perceived appearance flaws in body
dysmorphic disorder, having a serious illness in illness anxiety disorder, or the content of
delusional beliefs in schizophrenia or delusional disorder).
