CONTRACT OF AGREEMENT

FOR THE PRODUCTION OF 2016 ALLIANCE OF YOUNG

MATHEMATICIAN ORGANIZATIONAL SHIRT

Know All Men By These Presents:

This MEMORANDUM OF AGREEMENT entered into by and between:

The SCHOOL GEAR, a duly registered company/organization

created and existing under the policies of the Republic of the
Philippines, with business address at B-54, L-4 P-2 UPPER
BICUTAN TAGUIG CITY, and herein represented by its
Authorized Representative, JULIUS ERIC T. ALCANTARA,
and hereinafter referred to as the PROVIDER;

-and-

The ALLIANCE OF YOUNG MATHEMATICIANS, a

recognized student organization of RTU BONI with principal
address at 704 Boni Ave Cor Sacrepante, Mandaluyong,
1550 Metro Manila, herein represented by its President,
__________, hereinafter referred to as the ALLIANCE OF
YOUNG MATHEMATICIANS.

WITNESSETH:

WHEREAS, the ALLIANCE OF YOUNG MATHEMATICIANS has approved project

for academic year 2016-2017,which is the AYM Organizational Shirt. Both parties agreed
with the following terms and conditions:

1. That the PROVIDER agrees to finish the production of _____

Organizational Shirts for ALLIANCE OF YOUNG MATHEMATICIANS for
190/ea.
2. That the PROVIDER shall be responsible in purchasing materials,
coordinating with the ALLIANCE OF YOUNG MATHEMATICIANS as regards
to design details and approval of materials. (See Appendix A for the design
details and list of approved materials).
3. That the PROVIDER shall finish and turn over the said Organizational Shirts
at the said contract price and in accordance with the plans and
specifications.
4. That the PROVIDER shall pay a penalty of 1% of the contract price for every
day of delay of turnover.
5. That the starting date of the Organizational Shirt shall be on
______________________.
6. That the turnover date shall be on _________________.
 7. That the PROVIDER must return the remaining funds, if any, after the
turnover date.
8. That the ALLIANCE OF YOUNG MATHEMATICIANS, agrees to pay 50% of
the contract price at least 5 working days before the projected starting date
as down payment and the 50% of the contract price shall be paid upon
completion of the project. Additional cost, if any shall be paid on an
as-required basis, and must be agreeable to both parties.
9. That the SCOPE OF WORK are as follows:

I. FABRIC TYPE:
i. The fabric type that will be used in producing the Organizational
Shirts is Winner Cotton Shirt,

II. ORGANIZATIONAL SHIRT DESIGN:

i. The color and other details of the organizational shirt are upon the
agreement and discussion of both parties (See Appendix A for the
design specifications).

10. Both parties shall exert all efforts necessary to achieve the objectives of this
joint undertaking.

EFFECTIVITY/DURATION

1. This Agreement shall take effect on the date of the signing and for shall continue to
be in force for the whole duration of the project or unless earlier terminated for just
cause, by either party within seven (7) days prior written notice to the other party.
Any renewal shall be through the mutual consent by both parties.

IN WITNESS WHEREOF, the parties hereby affix their signatures this _____ day of
