In a scenario where a young high school principle, Debbie Young, which served as a

special education teacher and an assistant principle in a south school district. She was

approached by the parents of a severely disabled tenth-grade student to have their son, Jonathan,

attend one of the schools in the district. Jonathan has multiple disabilities requiring constant care

by a specially trained nurse. He is profoundly mentally disables, has spastic quadriplegia, and

has a seizure disorder. The high school principle refuses the parents request due to extraordinary

expense and a view that school is not the most appropriate placement.

InthecaseofRidleySchoolDistrictv.D.R.,theU.S.SupremeCourtdeclinestotakeupa

specialeducationcase.Thecourt,lastfall,hadaskedfortheadministrationviewinthecaseand

itwasdenied.Thequestionaroseinthecaseofanelementaryschoolstudentwithmultiple

learningdisabilitieswhoseparentsenrolledherinaprivateschoolafteradisputeoverthechilds

individualizededucationprogram.Thehearingofficerhadruledinthefamilysfavoratone

point,thentheprivateschoolbecamethechildsstayputplacement.

InthecaseofHendrickHudsonBoardofEducationv.Rowley,TheEducationof

HandicappedActprovidesfederalmoneytoassiststateandlocalagenciesineducatinggoalsand

procedures.Inotherwords,theprincipleisnottheonewhoispayingforthemoneythatgoes

towardshelpingchildrenwhoaredisabled.Thestudentshouldbeallowedtogotoanypublic

schoolthattheywantbecausetheyareallfundedtohavesomeonetheretogivethemthe

attentionthattheyneedaswellasalltheeducationthattheyneed.Theguidelinesforthestateof

theuseofthegrantmoneywerebothaimedmainlytodevelopeducationalresourcesandtotrain

personnelforeducatingthehandicapped.

InthecaseofCedarRapidsv.GarretF,Garretisaverycreative,intelligentandfriendly

youngman.Whenhewasfouryearsold,hisspinewasinjuredinamotorcycleaccident.After

theaccidenthebecameparalyzedfromtheneckdownbuthismentalcapacitieswereunaffected.

Hewasstillabletospeakandtocontrolhismotorizedwheelchairthroughtheuseofapuffand

suckstrawtooperateacomputerwithadevicethatrespondstoheadmovement.Heattends

CedarRapidsCommunitySchool;heattendsregularclassesinaschoolprogram.However,he

requiresaresponsiblepersonnearbytoattendcertainphysicalneedswhileheisinschool.

Youngsdecisionwasnotdefensible.Thestatesgetmoneytofundprogramsinorderto

helpchildrenwithspecialneeds.Themoneyisusedforeverythingandanythingthatanychild

needs,forexample,theyhavespecialmaterialsorequipmentthatthestudentsneedinclassin

ordertohelpthem,someonewhoistrainedandknowswhattheyaredoing.Theschoolshould

havehadthemoneytosupportthesestudentsandshouldnothavedeniedhim.
