EXTRA-JUDICIAL SETTLEMENT OF ESTATE OF THE

DECEASED EMELIANO S. RETUYA WITH DEED OF


ABSOULUTE SALE

KNOW ALL MEN BY THESE PRESENTS:

That this Agreement made and executed by:

SERFINA P. RETUYA, widow, VERGELIO RETUYA, ALEX RETUYA,


MELANIO RETUYA, MARILOU RETUYA, JUANCHO RETUYA, all of legal age,
Filipinos and all residents of Brgy. Caranglaan, Alcala, Pangasinan; do hereby declare as
follows:

WITNESSETH:

WHEREAS, the above-named parties are the surviving wife and the legitimate
children of EMELIANO S. RETUYA, who died on at;

WHEREAS, the decedent died intestate, without leaving any Last Will or
Testament and without leaving any debts or accounts whatsoever;

WHEREAS, the decedent is the registered owner of a certain property situated at


Brgy. Caranglaan, Alcala, Pangasinan and covered under Transfer Certificate of Title No.
4149 of the Registry of Deeds of the Lingayen, Pangasinan and more particularly
described as follows:

TRANSFER CERTIFICATE OF TITLE NO. 4149

A parcel of land (Lot 32, Bsd No. 1-000177 (OLT), being a


Portion of Lot 64 (LRV) Psd. 180591, TCT No. 107332 situated at
Barangay Caranglaan, Municipality of Alcala, Province of Pangasinan,
Island of Luzon. Bounded on the NE., along line 3-4 by Lot 33; on the
SE., along line 4-5 by Lot 30 and along lines 5-6 & 6-1 by Lot 31; on the
SW., along line 1-2 by Lot 18; all of the subdivision plan and on the
NW., along line 2-3 property claimed by Justo Bacolor. Beginning at a
point marked 1 on the plan being. beginning, containing an area of
SEVEN THOUSAND ONE HUNDRED EIGHTY NINE (7,189)
SQUARE METERS, more or less

WHEREAS, pursuant to Section 1, Rule 74 of the Revised Rules of Court of the


Philippines, we do hereby adjudicate unto ourselves, the rights/ownership over the above-
mentioned property, under the name of late EMELIANO S. RETUYA;

WHEREAS, we hereby affirm that we have executed this instrument out of our
own free will without force, intimidation or violence upon our person, and that we have
hereby received rights and have no more claim or demand in connection with the
adjudication of the above-mentioned property;
WHEREAS, the VENDORS are willing to SELL the above-mentioned property
to the herein VENDEE JOJIT M. JACALNE, married to CATHERINE C. JACALNE,
Filipino citizen, and with residence and postal address at No. 13-C Kaunlaran Ext.
Batasan Hills, Quezon City, who is willing to buy the same from the VENDOR;

NOW THEREFORE, for and consideration of the sum of NINETY SEVEN


THOUSAND PESOS (Php 97,000.00) Philippine Currency, receipt of which in full is
hereby acknowledged by the VENDORS, said VENDORS by these presents hereby
SELLS, TRANSFERS and CONVEYS in a manner absolute and irrevocable to the
VENDEE the above-described parcel of land, his heirs, successors and assigns, free from
all aliens and encumbrances whatsoever;

That expense for capital gains tax, documentary stamp tax, transfer tax,
registration fees and all other expenses relative to the transfer of title shall be for the
account of the VENDEE.

IN WITNESS WHEREOF, the parties have set their hands this day of
