(i) a cirizcn of India; and
(ii) resides, or carrics on his profession or is employed in W e s ~
Bcngal.

8. (1) An appointed or electcd niember of rhe Council shall bc


deemcd ro have vacarcd his sent-
(a) if he is abscnl wirhou~excuse sufficienr in rhe opinion OF the
Council f r ~ mthree consecurive mccr ings of the Council;
(b) if he is absenr oul of India for any period exceeding six
consecurive months.
(2) On thc occurrence of any vacancy referrcd to in sub-secrion (I),
[he PrcsidenioT~heCouncilshaIl f ~ r h w i t hreport the facr nCsuch vacancy
lo [he l[S [ate Govcrnmen\], who shall rhercupon, by nolification, declare

9. If any n~embcrdies or resigns his mcmhership or ceascs l o be a


n~embcras pfovided in sub-section (1) of seclion 8. h c vacancy shall be

nppoinrmenl or cleclion, as the care may' be, under secrion 4:
Providcd that if any such casual election i s not held within the said
period, or if at any such elcction no membcr is elcc~ed,thc '[State
Govcmment] shall, by no~ificalion,appoinl to the vacancy a pcrson
qualified for elccBon thercro:
Provided also rhal any pcrson appointed or eieclcd 10 fill a casual
vacancy shall hold officc only so long as the mcmher in whose placc the
appointment or clcction is made would havc held office.

11. ( I ) The Council shall makc regulations to rcgulale-
(a) [he modc oflransacrion of business, including provision for
decisions on emcrgcnt rnarrers by h e circulatjnn of papcrs l o
mcmbers, and for co-opdng persons specialIy quiilitied to
advise on any particular martcr beforc the Council;
(b) the times and places at which ils meelings shall bc held;
(c) the issuc oinoiiccs convcning such meetings;
(d) the conduct of business rhcreat; and

(2) The Council may appoint such other officers and such clcrks and
scrvanls as i[may considcr necessary for the purposes of this Acl. and shall
pay them such salary or rcmuneration and such allowances (if any) as he
Council may deleminc.
(3) The Rcgistrx shall act as Secretary and Treasurer to the Council.

six months from irs despatch, the Regisuar may erasc the name of such
person from the rcgister in which ir is entercd:
