Information

The undersigned Assistant City Prosecutor of


the City of Cebu accuses Homey F. Cidey for the
crime Frustrated Homicide in violation of Article
249 of the Revised Penal Code, committed as
follows:

That on or about 3:00 o clock in


the afternoon of February 14, 2013,
in the City of Cebu and within the
jurisdiction of this Honorable Court,
the said accused, allegedly with
intent to kill,repeatedly stabbed one
VIC C. TIM on the stomach with a
knife, thus performing all the acts
of execution which should have
produced the crime of homicide, as a
consequence but which nevertheless
did not produce it, by reason of some
causes independent of the will of the
accused; that is the timely and able
medical assistance rendered to said
VIC C. TIM which prevented his death.

the Revised Penal Code has been committed and that
the accused is probably guilty thereof.
