PETITION

COMES NOW, the petitioner and by the undersigned counsel and unto this Honorable

Court most respectfully states:

1. That Petitioner ABRAHAM O. ALBA, is of legal age, Filipino, married and a

resident of Purok 5, Dansuli, Isulan, Sultan Kudarat, where he may be served with

summons and other processes of this Honorable Court;

2. That the Respondent is being impleaded in his official capacity as the Register of

Deeds for the Province of Sultan Kudarat whose office is located in Old Capitol,

Kalawag 11, Isulan, Sultan KUdarat, where he may be served with summons and

other processes of this Honorable Court;

3. That petitioner is the registered owner of a parcel of land identified as Lot No. 169-

A, Psd-12-0626, situated in Dansuli, Isulan, Sultan KUdarat, Island of Mindanao.

Containing an area of ONE HUNDRED TEN (110) ) SQUARE METERS and

covered by TCT NO. 153-2012000045, machine copy of which is hereto attached as

ANNEX A hereof;
4. That the electronic generated title is in the PHILARIS system of the Register of

Deeds for the Province of Sultan Kudarat.

5. That on March 5, 2013, the residential house of the petitioner and all his personal

belongings together with the aforesaid title were all razed by fire. Attached herewith

is the Fire Incident Certification of the Bureau of Fire Protection of Isulan, Sultan

Kudarat dated March 15, 2013 as ANNEX C;

1. That petitioner has executed the necessary affidavit of loss of title which was duly

annotated at the back of TCT No. T-33430 on file with the Registry of Deeds for the
 Province of Sultan Kudarat under entry No. ____________ dated ____________, copy

of which is hereto attached as ANNEX B;

2. That said title was not encumbered to anybody or used as collateral for a loan or bail

bond for the provisional liberty of any person/s;

3. That for all legal intents and purposes, the petitioner hereby prays to the Honorable Court

to issue an Order declaring the said lost owners copy of TCT No. T-33430 registered in

my name, as without effect and in lieu thereof, to direct the Registry of Deeds for the

Province of Sultan Kudarat to re-issue another owners copy of title unto the petitioner

upon payments of fees.

WHEREFORE, in view of all the foregoing, it is most respectfully prayed of this

Honorable Court that after due notice, publication and hearing, this instant petition be granted,

and accordingly, an order be issued directing the Register of Deeds for the Province of Sultan

Kudarat to issue a New Owners Duplicate Copy of Transfer Certificate of Title No. T- 33430 in

lieu of the lost one subject to the same terms and conditions in the original copy thereof.

That I am the petitioner in the foregoing petition filed before the Regional Trial Court,
Branch 19, Isulan, Sultan Kudarat;

That I have caused the preparation and filing of the same;

That I have read the contents thereof and to the best of my knowledge, information and
belief all the allegations therein are true and correct.

That, likewise under oath, I hereby CERTIFY:

That I have not commenced any action or proceeding involving similar issues with the
Supreme Court, Court of Appeals, inferior court, tribunal or agency;

That to the best of my knowledge, there is no such action or proceedings involving

similar issues pending before any such courts, tribunal or agency;

That should I thereafter learn of such action or proceeding later on, I undertake to report
the same within Five (5) days to this Honorable Court.

AFFIDAVIT OF LOSS OF TITLE

I, ABRAHAM O. ALBA, of legal age, Filipino, married and a resident of Purok

5, Dansuli, Isulan, Sultan Kudarat, Philippines, after having been duly sworn to in
accordance with law, depose and say:

1. That I am the registered owner of a parcel of land known as Lot 169-A, Psd-12-
0626, situated in Dansuli, Isulan, Sultan Kudarat, Island of Mindanao. Containing
an area of ONE HUNDRED TEN (110) ) SQUARE METERS and covered by
TCT NO. 153-2012000045, machine copy of which is hereto attached as ANNEX
A hereof;
 2. That the Registry of Deeds for the Province of Sultan Kudarat issued the owners
copy of my title;

3. That on March 5, 2013, my residential house and all my personal belongings

together with the aforesaid title were damaged by fire incident, Attached
herewith is the Fire Incident Certification issued by the Bureau of Fire
Protection of Isulan, Sultan Kudarat dated March 15, 2013;

4. That said owners duplicate copy of title was not given to anybody,
encumbered or used as collateral for a loan or any obligation;

5. That I am executing this affidavit freely and voluntarily and for the purpose of
re-issuance of a new owners copy of TCT No. 153-2012000045,
