of FISHBALL S. FISHER

PRELIMINARY STATEMENT

The person examining me is Assistant Prosecutor, with office address Iloilo

Provincial Prosecution Office, Ramon Avancea Hall of Justice, Iloilo City, where
this examination is being held. I am answering her questions fully conscious that I
do so under oath and may face criminal liability for false testimony and perjury.

Q1: Palihog hambal sang imo ngalag kag iban pa nga hitabo.
(Please state your name and other incidents)
A1: Ako si Fishball S. Fisher, single, taga Brgy. Dulunan Arevalo, Iloilo City. Ako
isa ka manug-baligya sang fishball sa plaza sang molo.
 (I am Fishball S. Fisher, single, resident of Brgy. Dulanan, Arevalo, Iloilo
City. I am a fishball vendor in molo plaza.)
Q2: Ikaw bala ang nagasampa sang kaso nga rape kay Chuy Taraya Mola?
(Are you the same person filing a case of rape against one Chuy Taraya
Mola?)
A2: Huo.
(Yes)
Q3: Personal mo bala nga kilala si Mola?
(Do you personally know the defendant Mola?)
A3: Huo.
(Yes)
Q4: Ano ang imo relasyon sa akusado?
(What relation do you have with the defendant?)
A4: Upod kami sir sa school paper sa PUSJ.
(We belong in the PUSJ school paper)
Q5: Diin kamo sang April 22, 2016?
(Where were you on April 22, 2016?)
A5: May team building kami Sir sa Doctrine of Last Beach Resort, San Joaquin,
Iloilo. Last day na sadto namon, bale dinner party na.
(We had our team building Sir in Doctrine of Last Beach Resort, San
Joaquin, Iloilo. It was the last day of our team building, like a dinner party)
Q6: Nakainom bala kamo sa adlaw nga sadto?
(Were you drunk that day?)
A6: Huo Sir. Si Chuy Sir, waay.
(Yes Sir but Chuy was not.)
Q7: Ano kamo oras naghalin sa party?
(What time did you leave the party?)
A7: Mga 8:00 PM Sir, mabalik na kami tani sa quarters galing gin hagad ko ni Chuy
mag istorya kay gin basted siya sang miga ko.
 (We left the party around 8:00 PM, we were going back to the quarters but
then Chuy invited me to talk because my friend rejected him.)
Q8: Sa diin kamo nag istorya?
(Where did you talk?)
A8: Sa mga cottage Sir.
(In the cottages Sir.)
Q9: May upod pa bala kamo nga nag istoryahanay sa cottage?
(Was anyone else with you when you talked in the cottages?)
A9: Wala na Sir, kami lang duwa kay nabilin iban sa venue, ang iban nagtulog na,
ukon nagpuli.
(No sir, it was just the two of us because some were left at the dinner venue,
some slept, some of them went home.)
Q10: Ano sunod nga natabo?
(What happened next?)
A10: Nag istorya kami sa may cottages Sir. Sang una pa lang daw permi ya gina
hikap ako butkon kag legs. Daw waay man lang sa akon Sir kay ti, miguhay
man kami ni Chuy dasun tomboy pa ako galing gulpi lang siya Sir nag hipos,
daun nag singgit, daun nag uba sya sa tubang ko.
(We were talking in the cottages Sir. At first he was touching my arms and
legs. I did not mind that because Chuy and I were friends and look at me, I
am a tomboy but then he suddenly became silent then screamed and took
his clothes off in front of me.)
Q11: Ano gin himo mo sang natabo ina?
(What did you do then?)
A11: Nagkadlaw pa ako Sir, nag kadlaw ko kay abi ko dw panan-awan ko lang kay
hubog ako. Gulpi ya lang gin butong kwelyo sang polo ko kag gin bunggo
ya ako sa pader sang cottage.
 (I laughed at first Sir, I laughed because I thought I was too drunk to see
things properly. But then he grabbed me by the collar and slammed me on
the wall.)
Q12: Nag ano ka dayon sang gin bunggo ya ka?
(What did you do when he slammed you against the wall?)
A12: Wala na ako kahulag gid Sir kay daw ka baskog sang pag bunggo ya sa
akon. Gin daskan ya dayon sang daw tela akon bibig.
(I was not able to move because of the impact on my body when he slammed
me on the wall. He gagged me with a fabric of some sort.)
Q13: Ano dayon natabo?
(What happened next)
A13: Gin hambalan ya ako nga Pasugut kaw nalang. Sino pa mapati kanimo kay
tomboy kaw. Pasalamat kaw pa gani kay may mapatol pa kanimo. samtang gina
pilipilan ya ako sa salog .Gin ukas ya akon short kag underwear kag ginsulod
ang kinamataho ya sa akon. Naghibi ako sir kag gin karos ko sya sa ichura
para untatan ya pero gin sige ya man gihapon. Pagkatapos about 20
minutes, nag untat sya Sir kag gin kakas ang tela sa baba ko kag didto ko
nabal-an nga boxers ya gali.
(He told me that I should just agree with him because no one would believe
me and told me no one would like me while holding me with force on the
floor. He removed my shorts and underwear and inserted his penis on me. I
cried and scratched his face for him to stop but he did not. After about 20
minutes, he stopped and removed the fabric on my mouth and that was
when I found out that it was his boxers.)

(What happened next?)
A14: Gin hambalan ya ako nga Hipos kaw lang kay wara man may mapati nga may
nagrape kanimo kay tomboy kaw. Wala gid ako kabalo sang himuon ko Sir
 nahadlok na ako sa iya. Daw indi ko bala kilala, daun nag suksok sya bayo kag
short daun nag lakat.
(He told me not to say anything because no one would believe me when I
would say that he raped me because I was a tomboy. I did not what to do
Sir because I was afraid of him. It was like I did not know him, he then wore
his shirt and shorts and left.
Q15: Pagkatapos ya na himo sa imo, nag ano ikaw?
(What did you do after?)
A15: Sang nakita ko nga nakapalayo na siya, nag ilis ako kag nakita nga wala ya
nadala ang boxers nga gin dasok ya sa baba ko. Wala na ako nag balik sa
quarters kay nahadlok ako nga basi ara to siya. Nagkadto na lang ako sa
balay sang miga ko nga si Marie, gin istorya ko sa iya, kag gin pilit ko siya
kung pwede ako kapaligo kay nahigkuan gid ako sa lawas ko kag
nagpaupod sa police station.
(When I saw that he was already away, I wore my clothes and noticed that
he did not bring the boxers he used to gag me. I did not come back to the
quartes because I was afraid he would be there. I went to my friend, Maries
house told her what happened and begged her to let me bathe myself
because I felt so dirty and asked her to accompany me to the police station.)

(What did the police men do?)
A16: Gin pamangkot ako nila kung ano natabo, pagkatapos sina gin tawagan nila
ang resort kag gin dala sa hospital para i-examine ako sang doctor.
(They asked me what happened and after called for the security of the resort
then they took me to the hospital for a medical examination.)
Q17: Gin gaan ka man sang doctor sang medical certificate?
(Did the medical examiner provide you with a medical certificate?)
A17: Huo.
(Yes.)

(Who issued the medical certificate?)
A18: Si Doctor May Dela Cruz.
(It was Doctor May Dela Cruz.)
Q19: Kay sin-o nga pirma ang ara sa medical certificate?
(Whose signature is in the medical certificate?)
A19: Iya ka doctor ko, kay Dr. Dela Cruz.
(It is of my doctor, Dr. Dela Cruz.)
Q20: Paano mo nabal-an nga kay Dr. May Dela Cruz ang pirma nga ini?
(How do you know that it is Dr. May Dela Cruz signature?)
A20: Bal-an ko kay ara ako sang gin pirmahan nia ang certificate sa tubang ko.
(I know because I was there when she signed the certificate in front of me.)
Q21: Gin kuha man sang police imo statement?
(Did the police take down your statement?)
A21: Huo, sang ara ako sa hospital pagkatapos sang akon examination, gin kuha
sang police akon statement.
(Yes, at the hospital after my examination, the police officer took my
statement.)

A22: Ang pirma iya kay PO3 Tito Mhiranda, siya nag-kuha sang akon statement.
(It is the signature of PO3 Tito Mhiranda, he was the one who took my
statement.)
Q23: Paano mo nabal-an nga pirma ini ni PO3 Tito Mhiranda?
(How do you know it is the signature of PO3 Tito Mhiranda?)
A23: Bal-an ko kay gin pirmahan ini ni PO3 Mhiranda sa tubing ko.
(I know that it is PO3 Mhirandas signature because he signed it in front of
me.)
Q24: May ara ka pa gusto idugang sa imo statement, Ms. Champupot?
(Do you have anything else to say, Ms. Champupot?)
A24: Wala na ako may idugang.
(I have nothing more to say.)
