Object of the Course


Crime and Punishment has been the one of the most important task
of rule of law of the State. This course is designed with a prime
object to familiarize students with the principles of criminal liability
and other concepts of substantive criminal law
Unit- I Introduction
a) Charactertics of Criminal Law; what is crime?
b) Constituent Elements of Crime:-
Mens Rea and Actus Reus ; Conception of crime, stages of crime (including
S.511)
c) Extent and operation of Indian Penal code. Intra- Territorial & Extra
Territorial jurisdiction. ( S.2, S.3 & S.4)
d) General explanations:
Public servant(S.21) wrongful gain, wrongful Loss(S.23), valuable
securities(S.30), Harbour(S.52A).
e) Group Liability- Common intention (S.34), Common Object (S.149),
Criminal Conspiracy (S.120B), Abetment (S.107), Unlawful Assembly
(S.141), Rioting (S.146), Affray(S.159).

Unit- II General Defenses


a) Mistake(S.76), Accident(S.80), Infancy(S.82), Insanity(S.84),
Intoxication(S.85), Consent(S.90),Good faith (S.89)
b) Offences against the State- Waging War against Government of
India((S.121)- Sedition(S.124.A)
c) Giving false evidence(S.191), fabricating false evidence(S.195)
d) Death penalty- life imprisonment(S.53)
e) Right of Private Defence (S.96-106)

Unit- III Offences against Human body


a) Culpable Homicide(S.299), Murder(S.300), Attempt Murder(S.307),Attempt
to commit suicide(S.309)- Abetment of suicide punishable as a offence and
its constitutionality (S.306).
b) Hurt (S.319), Grievous Hurt (S.320), Wrongful Restraint (S.338), Wrongful
Confinement (S.340)

c) Causing death by Rash and Negligent Act(S.304.A)


d) Death caused by consent of the deceased, euthanasia and surgical operations
constitutionality (S.300 Exception 5) .
e) Kidnapping (S.359) and Abduction (S.362) & POCSO Act( 2012).
