Your attention is invited to the following items in the recommendation of Dir. J. Thaddeus Hernan of the ASD: 1. ox 2. Contents of that damaged, broken or unserviceable ballot box cannot be disposed within a period of at least six years after the election on which it was used; 3. Herman, Administrative Services Department, as submitted by Executive Director Jose M. Tolentino, Jr., containing the. proposed guidelines on the disposal of ballot boxes used during the May 2010 and 2013 National and Local Elections. The Memorandum of Director Hernan reads: ‘In compliance to Minute Resolution No. 16-0223 dated 29 March 2016, we respectfully submit the following amended proposed guidelines on the disposal of ballot boxes used during the May 2010 and 2013 National and Local Elections, as requested by Regional Election Director Jose Nick A. Mendros in his Memorandum of 10 March 2016: 1. Only ballot boxes that are damaged, broken and/or unserviceable, such as those that need repair or maintenance in excess of filly percent (50%) of their current market value, can be disposed; 2. Contents of that damaged, broken or unserviceable ballot box cannot be disposed within a period of at (sic) six (6) years after the election on which it was used, = 3. Contents of such damaged, broken or unserviceable ballot box is not the subject of any election contest, as duly certified by any or all of the following: a. the Presidential Electoral Tribunal ». the Senate Electoral Tribunal ©. the House of Representatives Electoral Tribunal d. the Electoral Contests Adjudication Department ©. the Office of the Clerk of the Commission f. the Regional Trial Court g. the Metropolitan/Municipal Trial Court 1) The Office of the Cepuly Executive Director for Operations (ODEDO) shall communicate with the Presidential Electoral Tribunal, the Senate Electoral Tribunal and the House of, ~.ay Page 2 of MR. No. 16- oho Representatives Electoral Tribunal about the pendency and status of any election contest or protest, particularly that of PET Case No. 001, Manuel Roxas vs. Jejomar Binay. 2) The Office of the Regional Election Director (ORED) concerned shall communicate with the various Regional Trial Courts in hisiher area of jurisdiction about the pendency and status of any election contest or protest. 3) The Office of the Provincial Election Supervisor (OPES) concemed shall regularly communicate with the various ‘Municipal/Metropolitan/Municipal Circuit Trial Courts in his/her area of jurisdiction about the pendency and status of any election contest or protest. [i]n the case of the National Capital Region, this shall be done by the ORED-NCR. 4) The Director IV of ECAD and the Clerk of the Commission shall regularly give an update on the pendency and/or status of election contests or cases pending in their respective departments or offices. After determination that the contents of the damaged, broken or unserviceable ballot box is not under any election contest or investigation, a date shall be specified by the City or Municipal Treasurer concemed in coordination with the Election Officer for its disposal. Due notice shail be sent to the political parties and groups existent in the city or municipality, PPRRCV and other civil society groups, and other concerned persons or groups. Such notice shall state the date, place and time and shall be posted at the conspicuous places of the City/Municipal Hall building, the Office of the Election Officer, as well as in other conspicuous places within the city or municipality. The contents of the damaged, broken or unserviceable ballot box shall be placed in a yellow ballot box, properly labelled, indicating the precinct number, clustered precinct number, barangay, municipality or city, and province. A report on the conduct of such activity shall be jointly submitted by the Election Officer and City/Municipal Treasurer concemed, to the Administrative Services Department (ASD), with a request for disposal of the damaged, broken, or unserviceable ballot box, with a copy of such request furnished the Office of the Deputy Executive Director for Operations and the Provincial Election Supervisor or the Regional Election Director, in the case of the National Capital Region. Upon approval by the ASD of the request for disposal of the damaged, broken or unserviceable ballot box, the Election Officer concemed may proceed with such disposal, following the procedures laid down in MR. No. 08-0819, ‘In the Matter of the Creation of Ad Hoc Disposal Team for COMELEC Field Offices’, dated 5 August 2008.
