AFFIDAVIT FILED UNDER SECTION 139 C.P.C

I, Ketha Srinivasa Rao S/o.Koteswara Rao, indu, aged about 34 years,

Tailor, R/o.D.No.22-3-38/2, 3rd line, Nancharamma Colony, Kandukur (V) &
(M), Prakasam District, do hereby solemnly affirm and sincerely state as
follows:-

I am the deponent herein and sole petitioner in the main O.P. The
O.P., is filed for compensation for the spinal card injuries sustained by me
in a motor accident. Later the same was decreed in my favour for a sum of
Rs.13,71,128/- with interest and costs on 27-03-2015 against the
respondents 2 & 3. Later the petitioner filed an E.P.No.38/2016 against the
3rd J.D.R/respondent and after that the petitioner was not pressed the same
on 05-08-2016. Later the 3 rd respondent deposited an amount of
Rs.15,72,525/- only on 19-11-2016 into the Court towards decree
amount. The Honble Court was pleased to permit me to withdraw an
amount of Rs.8,00,000/- only and I withdrew the same in
I.A.No.221/2016, dt.10-01-2017 and the remaining balance amount of
Rs.7,72,525/- was kept under fixed deposit for about one year. Later I
filed a petition to send for my entire compensation amount and this Honble
Court was pleased to allow the petition in E.A.No.91/2017, dt.22-5-2017. I am
entitled to withdraw the same and there are no attachments or stay or appeal on
the said amount. The above said amount of Rs.7,91,499/- was lying in C.C.D.
I, under take that if the Honble Court directs me to re-deposit the amount, I
will deposit the same. I am herewith filing my Bank Pass-Book.

Hence I pray that this Honble Court may be pleased to issue a cheque for
Rs.7,91,499/- (Rupees Seven lakhs ninety one thousand four hundred and
ninety nine Only) in favour of the Branch Manager, Corporation Bank,
Kandukur Branch, Prakasam District, and he may be directed her to credit the
same to the S.B.A/c No.102400101012119 of the petitioner in the interests of
justice.
