ITEM TITLE: Buletproof Vest Application for the Sheriff's Office

RECOMMENDATION
Approval of Resolution

SUMMARY
Since 1999, the Bedford County Sheriffs office has participated in a matching grant program with the U.S.
Department of Justice designed to help state and local jurisdictions purchase armor vests to be used by law
enforcement officers. The Bulletproof Vest Partnership program requires that each jurisdiction provide for at least
50% of the total vest cost including taxes and shipping and handling. Applicants will be awarded a percentage,
which will not exceed 50% of the vest cost.

The Sheriffs office has been notified that they are eligible to apply for the Bulletproof Vest Program for FY 2017.
The Sheriffs office has used this program to provide 334 new armor vests for the department. The vests are made to
each deputys specific measurements and have a warranty for 5 years. Due to turnover and the warranty time frame,
vests must be replaced on a regular basis. In FY 2018, they wish to purchase 19 additional vests at an expected total
cost of $9,956.00. The required local funds for these vests are included in the FY 2017-2018 budget. The
application was submitted online to meet the July 7, 2017 deadline. Robin Sundquist, the grant administrator for
the Sheriffs office, is now requesting that the Board of Supervisors approve the submission of an application to
participate in this program.

A RESOLUTION
BULLETPROOF VEST GRANT APPLICATION FOR THE SHERIFFS OFFICE

WHEREAS, the Sheriffs Office has prepared a grant application to be submitted to the
Bulletproof Vest Program; and

WHEREAS, the funds will be used to provide 19 additional vests at a cost of $9,956.00
during FY 2018; and

WHEREAS, the grant requires a local match of 50% or $4,978.00 which has been included
in the Sheriffs budget for FY 2017-2018; and now

NOW, THEREFORE, BE IT RESOLVED, by the Bedford County Board of Supervisors that the
Board does hereby authorize the submission of a Bulletproof Vest Grant Application in the
amount of $9,956.00 to the Bulletproof Vest Program.

81 Chairman Martin called the work session to order, and then turned the meeting over to Deputy
82 County Administrator Reid Wodicka. Dr. Wodicka introduced Mr. Michael D. Berg, Manager of
83 Regulation and Compliance for the Virginia Department of Healths Office of Emergency Medical
84 Services.
85 Mr. Berg noted he has spent almost his entire career as a volunteer EMS provider in Virginia, and
86 briefly reviewed his training and expertise with the Board. He said his office handles everything from
87 providing technical assistance and enforcement to investigating complaints.
88 Mr. Berg stated their authority to promulgate regulations comes from State code 32.1, and
89 commented that the entire EMS code section was updated in 2016. He noted that they take many things
90 into account when writing and enforcing regulations such as Federal curriculum requirements, State
91 legislation and mandates, public input, and updated information from science, technology and research.
92 Mr. Berg then reviewed the lengthy regulatory process, noting it can take two years to get a regulation
93 approved and in place. He stated that regulations are developed with provider input, approval from the
94 EMS Advisory Board, standing committees and workgroups.
95 In response to a question from Vice-Chairman Thomasson, Mr. Berg confirmed that all localities
96 in the State must comply with these regulations.
97 In response to a question from Chairman Martin, Mr. Berg stated that, if an agency is not
98 complying with regulations, his office offers to meet with the agency and discuss what the regulations
99 require and what challenges the agency may be dealing with that keeps them from being able to comply.
100 A correction order might be issued to explain which regulations are not being met and time will be
101 given to allow the agency to make changes. A series of steps will follow to ensure the agency is taking

102 steps to correct the issue. An individual can be suspended for certain (usually criminal) actions; an entire
103 agency typically will not be suspended unless they dont have proper insurance or a medical director. In
104 order to suspend or revoke a license or certification, the agency follows an administrative process; Mr.
105 Berg noted that during his tenure they have only suspended two or three agencies. In these instances, they
106 work with neighboring agencies to be certain there is no lapse in service to citizens. Mr. Berg stated his
107 agency would work with localities in these situations to assist with funding, emergency grants, etc., to
108 ensure EMS is still available the affected community.
109 In response to a question from Vice-Chairman Thomasson, Mr. Berg stated that re-certification
110 hours for paramedics have only increased by four hours; recertification hours for EMTs have decreased.
111 He noted that Virginias recertification standards mirror those of the National Registry, which is
112 recognized in approximately 30 states across the country. Mr. Berg stated that continuing education
113 hours can be taken online or in traditional classes, and are also available on CD.
114 A discussion followed between Mr. Berg and members of the Board regarding the issues facing
115 volunteer agencies such as funding, volunteer retention, access to training, the need for better screening of
116 emergency calls, the publics expectation of the services provided, and the need to make the path to
117 volunteerism easier.

182 (9a) Public Works Director Sheldon Cash addressed the Board with a request to execute a work order
183 for Solid Waste Permitting and Design Services. Mr. Cash briefly reviewed the process that led to this
184 request coming before the Board, noting that analysis has revealed that operating the local landfill is still
185 the most cost effective option for the County at this time. He noted that doing all the permitting for
186 multiple disposal areas at this time will provide a cost savings, and that the Public Works committee has
187 recommended this request for approval to the Board.
188 Mr. Cash and Mr. Bob Dick, representative from SCS, then answered clarifying questions from
189 the Board.
190 Supervisor Dooley made a motion to approve Resolution #R06121706.
191 WHEREAS, the permitting of additional disposal areas within the Bedford County Landfill is
192 necessary;
193 WHEREAS, the County's Landfill engineering firm, SCS Engineers, has provided a scope of
194 services and cost estimate to provide the initial design and permitting work; and
195 WHEREAS, the cost for SCS to provide this initial service is $240,000; and
196 WHEREAS, funds are available within the Landfill Expansion CIP; and
197 NOW, THEREFORE, BE IT RESOLVED, by the Bedford County Board of Supervisors that the
198 Board authorizes the execution of a work order with SCS Engineers to facilitate initial permitting and
199 design services for future landfill disposal areas.

206 (9b) County Administrator Carl Boggess addressed the Board to request authorization to issue a
207 Request for Proposals for the hiring of a commercial real estate broker to assist the County in the sale of
208 the Montvale Elementary School property and the Thaxton Elementary School property. Mr. Boggess
209 said staff had determined these properties have more commercial or industrial uses than they do as public
210 use properties.
211 Supervisor Dooley commented that he has not heard from any citizens regarding this issue. He
212 said we should not let these building just sit until they fall apart.
213 In response to a question from Chairman Martin, Mr. Boggess said that Body Camp Elementary
214 was not included due to its potential for further public use, plus it does not have water or sewer conducive
215 to commercial use.
216 Supervisor Dooley made a motion to approve Resolution #R061217-07.
217 WHEREAS, the County of Bedford obtained from the Bedford County School Board the former
218 Montvale Elementary School property in 1996 and the former Thaxton Elementary School in 2015; and
219 WHEREAS, both properties have commercial or industrial potential and the future County need
220 for the properties is limited; and
221 WHEREAS, the RFP process will help focus on the need for demolition or being sold "as is" and
222 will help the Board in the future decision of whether the Montvale Library should be left at its current
223 location or whether a new library should be built; and
224 WHEREAS, the Public Works Committee has been consulted and the Committee has
225 recommended the commencement of the process of selling the real estate.
226 NOW, THEREFORE, BE IT RESOLVED, by the Bedford County Board of Supervisors that the
227 Board does hereby authorize county staff to issue a Request for Proposal for the hiring of a commercial
228 real estate broker to assist the County in the sale of the Montvale Elementary School property and the
229 Thaxton Elementary School property.

237 addressed the Board with proposed amendments to the Dock Permit Ordinance. Mr. Boggess stated that
238 the recommendations were sent out to the Board for review prior to this meeting and he has not been
239 contacted with any revisions. He noted that Franklin County has indicated that they will be moving
240 forward with similar revisions.

241 Mr. Zody said the intent of this request is to remove all references to AEP from the ordinance.
242 He noted that those seeking a building permit will be notified that they will also need a permit directly
243 from AEP.
244 In response to a question from Vice-Chairman Thomasson, Mr. Boggess stated that the current
245 cases will be going to the Supreme Court. After that, we will have a back-up ordinance in the event that
246 we will need to pick up where AEP leaves off.
247 Mr. Zody then answered clarifying questions from the Board. Mr. Boggess stated that currently,
248 citizens have to bring their AEP permit in order to get a building permit. With the amended ordinance,
249 citizens will be advised to get the AEP permit, but it will not be needed to acquire a building permit.
250 The Board gave its consensus for staff to move forward with the recommended amendments.

255 Chairman Martin asked if VDOT picks up the temporary advertising and political signs that are
256 placed in road right-of-way areas. Mr. Todd Daniel, VDOT Residency Administrator, stated that while
257 they could do this, they tend to attempt to contact the owner of the signs to have them moved back (as
258 long as they are not blocking the sight distance) before removing the signs completely.

SUMMARY
Sifen, Inc. requests a Special Use Permit (SUP) for a change of use of the existing Grainger WW, Inc. structure to
Automobile Repair Services, Major on Tax Map #101-A-44B in a General Commercial (C-2) zoning district. The
parcel is located at 18395 Forest Road, Lynchburg, Virginia 24502. The property is in Election District #4

TO APPROVE A SPECIAL USE PERMIT


TO ESTABLISH AN AUTOMOBILE REPAIR SERVICES, MAJOR USE
ON PROPERTY IDENTIFIED AS TAX MAP NUMBER 101-A-44B

WHEREAS, Sifen, Inc. has submitted Special Use Permit application #SU170004 to establish an
Automobile Repair Services, Major use in a C-2 (General Commercial) district on the property
identified as Tax Map Number #101-A-44B currently owned by Grainger WW, Inc., but will be
purchased by applicant; and
WHEREAS, the application has been submitted pursuant to Section 30-79-2 of the Zoning Ordinance,
which allows an Automobile Repair Services, Major use in the C-2 zoning district after a Special Use
Permit has been approved in accordance with Section 30-19 of the Zoning Ordinance; and
WHEREAS, the Board of Supervisors has carefully considered the public record, the public testimony, and
the recommendation of the Planning Commission; and
WHEREAS, the Board finds that the request meets the goals and objectives of the Comprehensive Plan
and the purposes of the Zoning Ordinance for issuance of a Special Use Permit;
THEREFORE, BE IT RESOLVED, by the Bedford County Board of Supervisors that the Board does hereby
approve of a Special Use Permit pursuant to application #SU170004 with the following conditions:
1. Existing landscaping and buffer yard must remain as part of the landscaping requirement at the site
plan level. Should any modifications be made, the applicant shall contact the Zoning Administrator to
determine if a new landscaping plan must be submitted in order to verify compliance with the
landscaping requirements listed in Article V Section 30-92 of the Zoning Ordinance.

ZoningOrdinance
The proposed use is defined as Automobile Repair Services, Major in the Zoning Ordinance. The use
definitionfromSection3028(C)reads:

The Permitted Use Table (Section 30792, attached) includes Automobile Repair Service, Major under
CommercialUsesandlistedasaSpecialUsewithmorestringentstandardsspecifiedinArticleIV(S*)in
theC2zoningdistrict.

GeneralstandardsforaAutomobileRepairServices,MajorusearelistedinArticleIV,SectionSec.3085
6, of the Zoning Ordinance (attached). Below is an analysis of each general standard listed that the
applicantwillneedtocomplywith:

1) Theapplicantisproposinginstallingafencedstorageyardatthebackoftheexistingstructure
forvehiclesthatarestoredonthepremisesinexcessof72hoursontheconceptplan.The
requirementofthestorageyardtobesetbackatleast100feetfromanyadjoiningresidential
districtisnotapplicablesincethepropertydoesnotadjoinaresidentialdistrict.
2) The requirement that the repair facilities are at least 150 feet from an adjoining residential
districtisnotapplicablesincethepropertydoesnotadjoinaresidentialdistrict.TheBedford
County building official will ensure that if spray painting takes place within a structure, the
structure will be designed for that purpose through the site plan/building permit process
shouldthespecialusebegranted.
3) Theapplicantdoesnotintendtodisplayorstorenew/usedautomobilepartsontheexteriorof
thestructure.

Thisrequestmakesuseofanexistingstructureinsteadofdevelopinganewsitefortheproposeduse.The
applicantstatesthatthislocationwillcreate18jobs,thatcouldbenefitCountyresidents.

ProjectImpacts
Environmental
Since the property is already developed, no grading or construction will occur in connection with this
request.

Utilities
The property is served by public water and private septic. The applicant will need to work with the
BedfordRegionalWaterAuthorityandtheVirginiaDepartmentofHealthtoensurethatexistingfacilities
areadequateforthechangeofuseatthesiteplanstage,shouldthespecialusebegranted.

Transportation
The site has an existing commercial entrance onto Forest Road. The Virginia Department of
Transportationhasrequestedthattheapplicantincludesatrafficimpactstatementdenotinganticipated
sitetripgenerationforthepreviousandproposeduses.Thiswillbenecessarytodetermineifadditional
entranceimprovementsarewarranted.

Aesthetic/Visual
The applicant proposes to upgrade the faade of the existing building to enhance the current and
surroundingviews.ThenewsignagewillrequirecompliancetoArticleVSection309313forfreestanding
signs, and Section 309314 for faade signs regulations. Automobiles stored on the property will be
placedinascreenedfencedstoragearealocatedbehindtheexistingbuilding.Mostoftheimprovements
are located inside of the building, and the applicant will work with the Building Division to meet the
requiredguidelinesatthesiteplan/buildingpermitphase.

CONCLUSION
TheapplicationbySifen,Inc.meetsalloftheapplicableZoningOrdinancestandardsatthisstageinthe
process.Theapplicantsproposalshouldresultinminimalimpacttothesurroundingarea,givenexisting
usesandzoning.Theapplicantwillbeupgradingtheexteriorfaadeandsignage,andinstallingafence
aroundtheexistingpavedareabehindthestructureforthefencedstorageyard.

After reviewing the application, staff recommends approval of the application with the following
condition:

1. Existinglandscapingandbufferyardmustremainaspartofthelandscapingrequirementatthesite
planlevel.Shouldanymodificationsbemade,theapplicantshallcontacttheZoningAdministrator
todetermineifanewlandscapingplanmustbesubmittedinordertoverifycompliancewiththe
landscapingrequirementslistedinArticleVSection3092oftheZoningOrdinance.

ARTICLE III. - DISTRICT REGULATIONS

Sec. 30-54. - C-2 General commercial district.

Sec. 30-54-1. Purpose.

The purpose of the C-2 district is to provide locations for a variety of commercial and service
related activities within the urban service area serving a community of several neighborhoods or
large areas of the county. This district is intended for general application throughout the county.
General commercial districts are most appropriately found along major arterial thoroughfares
which serve large segments of the county's population.

The C-2 district permits a wide variety of retail and service related uses. Site development
regulations are designed to ensure compatibility with adjoining land uses.

Sec. 30-54-2. Permitted uses.

Permitted uses shall be as listed in section 30-79.

Sec. 30-54-3. Site development regulations.

General Standards. For additional, modified, or more stringent standards for specific uses, see
article IV, Use and Design Standards.

(a) Minimum lot requirements:

(1) Lots served by private well and sewage disposal system;

a. Area: One (1) acre (forty-three thousand five hundred sixty (43,560) square feet).

b. Frontage: One hundred (100) feet on a publicly owned and maintained street.

(2) Lots served by either public sewer or water, or both:

a. Area: Fifteen thousand (15,000) square feet.

b. Frontage: Seventy-five (75) feet on a publicly owned and maintained street.

(b) Minimum setback requirements:

(1) Front yard:

a. Principal structures: Thirty (30) feet, or twenty (20) feet when all parking is located
behind the front building line.

b. Accessory structures: Behind front building line.

(2) Side yard: None.

(3) Rear yard:

a. Principal structures: Fifteen (15) feet.

b. Accessory structures: Three (3) feet.

(4) Where a lot fronts on more than one (1) street, front yard setbacks shall apply to all
streets.

(c) Maximum height of structures:

(1) Height limitations:

a. Principal structures: Forty-five (45) feet. Principal structures may exceed the principal
structure height limitation provided a special use permit is approved in accordance
with section 30-19.

b. Accessory structures: actual height of principal structure.

(d) Maximum coverage:

(1) Building coverage: Fifty (50) percent of the total lot area.

(2) Lot coverage: Ninety (90) percent of the total lot area.

ARTICLE IV. - USE AND DESIGN STANDARDS

Sec. 30-85-6. Automobile repair services, major.

(a) General standards:

(1) All vehicles stored on the premises in excess of seventy-two (72) hours shall be placed in a
storage yard. The storage yard shall be fully screened from public view and shall be set back at
least one hundred (100) feet from any adjoining residential district.
(2) Body and fender repair services shall be subject to the following:
a. The repair facilities are at least one hundred fifty (150) feet from any adjoining residential
district.
b. Any spray painting takes place within a structure designed for that purpose and approved
by the Bedford County Building Official.
(3) Exterior display or storage of new or used automobile parts is prohibited.
