All floors, roofs, and working decks shall be cleaned of debris at least daily, and a daily inspection
made by a competent person to verify such has occurred. If the building is a major building, such
inspection shall be noted in the site safety log.
Debris that cannot be removed from the site by the end of the shift shall be placed in containers or
shall be secured overnight to protect the public and property and shall be removed from the
site or placed in containers at the beginning of the next shift.
Storage of combustible material and other material and equipment that may present a fire hazard shall
comply with the New York City Fire Code.
Containers containing debris or waste shall be covered at the end of the workday and at any time
when full to near the rim. Containers need not be covered when they are not in use or while stored in a
fully enclosed space at the end of the workday.
A daily inspection shall be made for construction or demolition debris on all floors and if the building is
a major building, such inspection shall be noted in the site safety log.
Material and debris susceptible to dislodgment shall not be stored on scaffolds while work is not being
performed.
All corridors and exits shall be maintained free from debris. Debris shall not be stored in stairwells.
Leaks and or spills shall be tended to immediately to prevent a slipping hazard.
Containers shall be provided for the collection and separation of waste, trash, oily and used rags, and
other refuse. Containers used for garbage and other oily, flammable, or hazardous wastes, such as
caustics, acids, harmful dusts, etc. shall be equipped with covers. Garbage and other waste shall be
disposed of at frequent and regular intervals.
Combustible scrap and debris shall be removed at regular intervals during the course of construction.
Safe means shall be provided to facilitate such removal.
All employees shall be required to wear personal protective equipment at all times while
working within the building and site. PPE shall not be removed until the employee has
exited the work site at the ground level. All employees are required to wear a hardhat,
eye protection, a reflective vest or clothing and work boots. All workers must be trained
in the proper use of PPE prior to working.
Protective equipment, including personal protective equipment for eyes, face, head and
extremities, protective clothing, respiratory devices, and protective shields and barriers,
shall be provided, used and maintained in a sanitary and reliable condition wherever it is
necessary by reason of hazards or processes or environment, chemical hazards,
radiological hazards, or mechanical irritants encountered in a manner capable of
causing injury or impairment in the function of any part of the body through absorption,
inhalation or physical contact.
Where employees provide their own protective equipment, the employer shall be
responsible to assure its adequacy, including proper maintenance, and sanitation of
such equipment.
All employees must comply with codes, standards, regulations and policies set forth by The New York
City Department of Buildings, The New York City Fire Department, The United States Department of
Labor and applicable national consensus standards. National Consensus Organizations are inclusive,
but not limited to The National Fire Protection Association (NFPA) and the American National
Standards Institute (ANSI).
The general contractor shall maintain a place of employment which is free from recognized hazards
that are causing or are likely to cause death or serious physical harm to employees.
Stairways at construction sites shall be provided, maintained, and made available for department use in
accordance with the construction codes, including the Building Code. Stairways providing egress from
the building or structure under construction or alteration, and other components of the means of egress,
shall be given construction priority.
A copy of this Health and Safety Plan must be maintained at the site at all times.
All workers must receive a safety orientation prior to working at the site. Records shall be maintained
on site.
A fire prevention plan must be in writing, be kept in the workplace, and be made available to employees
for review. However, an employer with 10 or fewer employees may communicate the plan orally to
employees.
An emergency action plan must be in writing, kept in the workplace, and available to employees for
review. However, an employer with 10 or fewer employees may communicate the plan orally to
employees.
1. All vertical netting shall comply with the requirements set forth in chapter 33 on the New York City
building code, 29 CFR 1926.
2. When in the course of construction the building reaches a height of 4 stories or 40 feet (12 192 mm),
vertical safety netting shall be maintained at each story except at the story at grade, the story
immediately above the sidewalk shed and the roof level where a parapet is installed.
3. Vertical safety netting shall consist of a vertical system of nets and their supports that meet
requirements set forth in department rules, vertical safety netting shall be of a fine mesh of a size and
strength sufficient to contain falling tools and materials, wall operning screens, grills or tarpaulins may
be used in lieu of vertical safety netting, provided that they shall be of such construction and mounting
as to retain debris.
4. On every story where vertical safety netting is required, it shall extend from the floor to a height of
not less than 60 inches (1524 mm). Vertical safety nets and their components shall also meet the
requirements set forth in rules promulgated by the commissioner.
5. The holder of the work permit and his or her designee shall be responsible for the installation and
maintenance of all horizontal and vertical netting, and for complying with the requirements of this
section.
Horizontal safety netting shall be installed and maintained to comply with all federal,
state and local codes, standards, rules and regulations including: CFR 1926. Subpart
M, Article 19 Sections 27-1021, 27-1022 and RS-19-4 of the NYC Building Code, the
manual for site safety program, ANSI Standard for personnel and debris nets, and the
rules and regulations relating to netting as implemented through Local Law 61 of
1987.
Hot work may be conducted in the following areas: 1. Areas designed for hot work
operations. 2. Areas authorized for that purpose by the responsible person at the
premises when precautions have been taken in compliance with the requirements of this
chapter.
Hot work shall not be conducted in the following areas unless approval has been
obtained from the commissioner: 1. Areas where the sprinkler system is impaired. 2.
Areas where there exists the potential of an explosive atmosphere, such as locations
where flammable gases, liquids or vapors are present. 3. Areas with readily ignitable
materials, such as storage of large quantities of bulk sulfur, baled paper, cotton, lint,
dust or loose combustible materials. 4. On board marine vessels or watercraft at dock
under construction or repair.
Hot work program. Whenever hot work is performed in any building or structure, on a
building roof or on a building setback, the owner shall ensure that such work is
performed in accordance with this chapter and shall designate a responsible person to
ensure compliance.
Hot work program responsible person. The responsible person shall ensure that a permit
has been obtained from the department when one is required, and ensure that the hot
work is performed in compliance with the terms and conditions of the permit. The
responsible person shall inspect the hot work site prior to issuing a hot work program
authorization and periodically monitor the work as it is being performed to ensure there
are no fire safety hazards.
Hot work operations shall be conducted under the general supervision of the responsible
person.
An authorization for hot work operations shall not be issued unless the individuals
conducting such operations are capable of performing such operations safely.
Demonstration of a working knowledge of the provisions of Chapter 26 of the New York
City Fire Code shall constitute acceptable evidence of compliance with this requirement.
Torch operations using oxygen and a flammable gas, and any torch operation for
torch-applied roofing systems, shall be performed by a certificate of fitness holder.
All persons conducting hot work operations shall be trained in the use of portable fire
extinguishers, and shall be capable of extinguishing fires when they are limited in size
and spread such that they can readily be extinguished using a portable fire extinguisher.
The responsible person for the hot work area shall maintain reports in
accordance with FC2604.3.1.
Visible hazard identification signs shall be provided where required by FC Chapter 27.
Where the hot work area is accessible to persons other than the operator of the hot work
equipment, signs shall be posted in a conspicuous location to warn others before they
enter the hot work area. Such signs shall read as follows: CAUTION HOT WORK IN

Hot work operations involving cutting or welding shall be conducted at least 35 feet (10
668 mm) from combustible materials and combustible waste or shall be provided with
appropriate shielding to prevent sparks, slag or heat from igniting exposed combustibles.
All other hot work operations shall be conducted at least 25 feet (7620 mm) from
combustible materials and combustible waste or shall be provided with appropriate
shielding to prevent sparks, slag or heat from igniting exposed combustibles.
Openings or cracks in walls, floors, ducts or shafts within 35 feet (10 668 mm) of the hot
work area shall be tightly covered to prevent the passage of sparks to adjacent
combustible areas, or shielded by metal fire-resistant guards, or provided with curtains
to prevent passage of sparks or slag.
Combustible waste shall not be allowed to accumulate on floors and other surfaces
within the hot work area. Hot work areas shall be regularly cleaned and combustible
waste removed and disposed of lawfully.
Areas designed for hot work operations shall have floors with noncombustible surfaces.
Sprinkler system protection shall not be shut off or impaired while hot work is performed
unless approved by the commissioner. Where hot work is performed close to sprinklers,
noncombustible barriers or damp cloth guards shall shield the individual sprinkler heads
and shall be removed when the work is completed. If the work extends over several
days, the shields shall be removed at the end of each workday.
Approved precautionary measures shall be taken to avoid accidental operation of
automatic fire detection systems.
A fire watch shall be maintained during hot work operations. The fire watch shall
continue for a minimum of 30 minutes after the conclusion of the work. The
commissioner, or the responsible person implementing a hot work program, may extend
the duration of the fire watch based on the hazards or work being performed.
In the course of construction, once the structure reaches a height of 6 stories above
the adjoining ground level, horizontal safety netting shall be maintained not more than
2 stories or 30 feet below the stripping operation where reinforced concrete
construction is utilized.
Netting shall follow the placement of concrete as closely as possible but shall not
exceed the following limitations. The horizontal nets shall be jumped in accordance
with the following schedule;
