 STATEMENTOFPROBABLECAUSE

TheComplainantstatesthatthefollowingfactsestablishprobablecause:

YourComplainantisalicensedMinnesotapeaceofficerwiththeOakdalePoliceDepartment.Complainant
offersthefollowingstatementtoestablishprobablecause:

OnJuly30,2016atapproximately2:30a.m.,OfficerBillHansonwasdispatchedto2159HelenaAve,
Oakdale,WashingtonCounty,MNonareportofunderagedrinking.Thecomplainantsaidtheminorswho
hadbeendrinkinghadfledtheresidenceandweredrivinginasilverandwhitevehicle.Complainant
indicatedherminordaughterwasoneofthepeopleinvolvedinthedrinkingandwasinthecar.Whenthe
Officerarrivedheobservedthevehicledrivingdown22ndStreetSouthoftheresidence.TheOfficer
observedthedriverwascontinuallyapplyingthebrakes.WhentheOfficercaughtuptothevehicleithad
stopped.

TheOfficerthenapproachedthevehicleandmadecontactwiththedriverwhowasidentifiedasAshley
DawnBenert(defendant),DOB11/7/1995.TheOfficercouldsmelltheodorofalcoholonherbreathand
hadherperformsomefieldsobrietytests.Thesetestsgavetheindicationofintoxicationandthedefendant
wasplacedunderarrestandtransportedtoWashingtonCountyJail.Duringthebookingprocess,the
defendanthadaZiplocbaggieinherpursethatcontainedcrushedamphetamine.Theamphetaminewas
confirmedbytheBureauofCriminalApprehension.ThedefendantafterbeingreadherMirandarights
admittedthatshedidnothaveaprescriptionfortheamphetamine(Adderall)andthatshegetsitfroma
familymember.Sheadmittedthatshesnortstheamphetamine.

AfterbeingreadherMinnesotaImpliedConsentAdvisorythedefendantagreedtogiveabreathtest.The
testwasadministeredat4:28andregistereda.20alcoholcontent.
