AFFIDAVIT OF UNDERTAKING

I, SOCORRO R. DE LEON, of legal age, married, Filipino, a resident of A.

CURATO STREET, BARANGAY 4, CABADBARAN CITY, AGUSAN DEL NORTE,
PHILIPPINES and with business address at the same address, as attorney-in-
fact of DENNIS N. VILLANUEVA, of legal age, married, Filipino, a resident of A.
CURATO STREET, BARANGAY 4, CABADBARAN CITY, AGUSAN DEL NORTE,
PHILIPPINES and with business address at the same address, after having
been subscribed to an oath, depose and say:

1. That DENNIS N. VILLANUEVA is an applicant for the renewal of his

commercial sand and gravel permit located along Taguibo River within
the territorial jurisdiction of Barangay Sumilihon, Butuan City,
Philippines;

2. That he has satisfactorily complied with the documentary requirements

for the said renewal application;

3. That he is fully aware that there exist findings of unsystematic

extraction and scouring of bank walls along the northern portion of the
river bed;

4. That in order to systematize the extractions and scouring of bank

walls, he UNDERTAKES to implement the following mitigating
measures:

a. ARMOR bank walls to prevent further scouring,

b. STRICTLY FOLLOW the extraction procedure within the extraction
zone which shall be delineated later by the City ENR,
c. LIMIT the extraction into one (1) meter depth only, and
d. ADOPT such other measures that the CMRB may deem fit to require
in order to implement a technically responsible manner of
extraction and scouring of bank walls in his project area;

5. That he likewise DECLARES and ASSUMES full and complete

responsibilities for all consequences which may arise in connection with the
conduct of above recruitment activities; and

6. That I EXECUTE this Affidavit of Undertaking, as attorney-in-fact of

DENNIS N. VILLANUEVA, in compliance with the requirements in the issuance
of the renewal application of his commercial sand and gravel permit.
