PETITION

Comes now petitioner, through herein counsel unto this Honorable


Court respectfully avers that:

1. She is a Filipino citizen, of legal age, witch capacity to sue and be sued,
married to but separated in fact form respondent, and a resident of No.
169, Brgy. 33, P. Paterno St. Tacloban City where she could be served with
summonses and other processes by the Honorable Court;

2. Respondent is likewise a Filipino Citizen, of legal age, with capacity to sue


and be sued, married to but separated in fact from herein petitioner and
with address at No. 253, Brgy. 72, Marasbaras, Tacloban City.

3. She met the respondent on March 1, 2011. They became friends and
after a brief period of acquaintance, the respondent had courted her and
thereafter, they went on to a relationship of boyfriend and girlfriend;

4. They decided to get married in November 28, 2012. They sought all the
requirements of the marriage personally.

5. They were married on January 15, 2013, fulfilling all the essential and
formal requirements and the marriage was solemnized by Father Reyes at

the Sto. Nio Church, Tacloban City. The petitioner and the respondent
didnt have any children before their marriage and they decided that they
will not conceive any child that year.

6. On March 12, 2013, while the respondent was away from home working
at the office, the petitioner decided to clean their room. Much to her
surprise, she found 2 boxes of lipsticks, mascaras, eye liners and concealers
in the respondents drawer. The petitioner knew that those cosmetics does
not belong to her.

7. When the respondent arrived home, the petitioner immediately


confronted him about the cosmetics hidden in the respondents drawer.
The respondent then confessed that he was a homosexual and he
concealed that fact because he truly love her and he doesnt want to lose
her by telling the truth about his gender.

8. The petitioner, shocked by the confession of the respondent, decided to


run to her room and lock herself up. While she was running, she stumbled
on a bag that was brought by the petitioner when he arrived home.

9. Her stumble caused enough force to open the bag and to her surprise,
the petitioner saw that the bag was full of LSD(Lysergic acid diethylamide)
pills contained in a transparent plastic bottle. The respondent then
confessed that he is a drug addict and at the same time. He justified his act
by stating that the earnings he get from selling illegal drugs is used to help
their family.

10. The petitioner was horrified of what she had witnessed that day and
decided to leave their house and stay with her mother. She never knew
before her marriage that her husband was homosexual and the same time,
a drug pusher and a drug addict.

PRAYER

WHEREFORE, PREMISES CONSIDERED, petitioner respectfully prays


that the Honorable Court gives due course to this petition, declaring her
marriage with the respondent annulled by reason of concealment of
homosexuality and concealment of drug addiction and ordering the Local
Civil Registrar keeping the record of such marriage to make the necessary
corrections thereon.

Petitioner also prays for all other just and equitable relief the
Honorable Court may deem proper under the circumstances.

accordance with law, depose and state that:

1. I am the petitioner in the above-stated case;

2. I caused the preparation of the foregoing complaint;

3. I have read the contents thereof and the facts stated therein are true
and correct of my personal knowledge and/or on the basis of copies of
documents and records in my possession;

4. I have not commenced any other action or proceeding involving the


same issues in the Supreme Court, the Court of Appeals, or any other
tribunal or agency;

5. To the best of my knowledge and belief, no such action or proceeding is


pending in the Supreme Court, the Court of Appeals, or any other
tribunal or agency;

6. If I should thereafter learn that a similar action or proceeding has been


filed or is pending before the Supreme Court, the Court of Appeals, or
any other tribunal or agency, I undertake to report that fact within five
(5) days therefrom to this Honorable Court.
