RESOLUTION ADOPTING THE SANGGUNIANG BAYAN OF ISULAN


INTERNAL RULES OF PROCEDURES AS AMENDED

WHEREAS, presented before this Honorable Body for deliberation is the Sangguniang Bayan
Internal Rules of Procedures (IRP);
WHEREAS, this body recognizes the need to amend some provisions of the Internal Rules of
Procedures, a legislative tool that will provide a more consistent rules and regulations to ensure
orderly sessions and quality enactments necessary to effect a more effective and efficient discharge of
duties and responsibilities of the Sangguniang Bayan toward a quality public service;
NOW THEREFORE, after due deliberation and upon motion of Hon. Mariblithe A.
Cartujano-Garingo duly seconded by Hon. Rene F. Aristoza, Hon. Jennalyn N. Mejia, Hon. Gina B.
Belmes-Dael, Hon. Pableto A. Rendon, Jr., and Hon. Richard C. Petisme, be it;

RESOLVED, as it is hereby resolved to amend certain provisions of the Internal Rules of


Procedures as follows:

RULE I THE SANGGUNIANG BAYAN

SECTION I. COMPOSITION The Sanggunian shall be composed of the Vice Mayor as


Presiding officer, the members elected at large and such sectoral representatives as may be chosen
pursuant to law.

SECTION 2. TERM OF OFFICE The term of office of the members of the Sangguniang
Bayan of Isulan shall be three (3) years which shall commence on such date as may be provided by
law.

SECTION 3. OATH OR AFFIRMATION. All the members of the Sangguniang Bayan of


Isulan shall, upon assumption to office, take an oath of office of affirmation in the prescribed form,
duly subscribed before a person authorized to administer oath.

Copies of the oath or affirmation of office shall be filed and preserved in the office of the
Municipal Mayor of the Municipality of Isulan.

RULE II THE PRESIDING OFFICER

SECTION 4. THE PRESIDING OFFICER The Vice Mayor shall be the Presiding Officer
of the Sangguniang Bayan of Isulan. The Presiding Officer shall vote only to break a tie.

In the event of the inability of the Vice Mayor to act as the Presiding Officer, the Sanggunian
members present, constituting a quorum, shall elect from among themselves a temporary presiding
officer. The acting or temporary presiding officer shall not vote even in case of a tie but shall certify
within ten (10) days from their enactment or adoption of all ordinances and resolutions passed by the
Sangguniang Bayan of Isulan.

SECTION 5. POWER AND DUTIES OF THE PRESIDING OFFICER The Presiding


Officer shall:

a. Preside over the session of the Sangguniang Bayan of Isulan;


b. Preserve order and decorum during sessions, and in case of disturbance or disorderly conduct in
the session hall or within the premises, the measures as he may deem advisable or as the
sanggunian may direct;
c. Decide all questions of order, subject to appeal by any Sanggunian members in accordance with
these rules;
d. Sign all acts, ordinances, resolutions memorials, writes, warrants and subpoenas issued by or
upon order of the sanggunian, and
e. Exercise such other powers and perform such other functions as may be provided by law,
ordinance or resolution.

The regular presiding Officer shall not be a chairman or member of any standing committee.
He may, however, be elected as chairman or member of any special or other committee which the
sanggunian may organize, for specific purposes.

RULE III THE SECRETARY

SECTION 6. APPOINTMENT AND COMPENSATION The Sanggunian Secretary shall


be appointed by the Vice Mayor. His compensation allowances and other emoluments shall be
determined by law or ordinance.

The appointment of the Sanggunian Secretary shall be in accordance with civil service law,
rules and regulations.

SECTION 7. POWERS AND DUTIES OF THE SECRETARY The Sanggunian Secretary


shall:

a. Attend meetings of the Sangguniang Bayan and keep the minutes of its proceedings;
b. Record in a book kept for the purpose, all ordinances and resolutions enacted or adopted by the
sanggunian with the dates of their enactment and publication;
c. Forward to the Local Chief Executive for appropriate action, the ordinances and resolutions
enacted or adopted by the Sangguniang Bayan which have been certified as such by the
Presiding Officer within ten (10) days after their enactment or adoption;
d. Keep and affix the sanggunian seal on all ordinances and resolutions signed by the Local Chief
Executive;
e. Attest to all ordinances and resolutions approved by the Sanggunian and signed by the Local
Chief Executive;
f. Forward to the Sanggunian for review, copies of approved resolutions and ordinances within
seventy-two hours after their approval;
g. Post all ordinances and resolutions immediately after their approval at the main entrance of the
municipal hall and in two (2) other conspicuous public places particularly at the public market
and San Carlos Borromeo Parish Church;

h. Upon request, furnish certified copies of all records and documents in his charge not otherwise
classified as confidential, upon payment to the local treasurer of the fees prescribed by an
ordinance;
i. Keep his office and all records therein which are not of a confidential character open to public
inspection during the usual business hours;
j. Act as custodian of the public library and archives, if any, and annually account for the
properties therein; and
k. Exercise such other powers and perform such other duties and functions as may be prescribed
by law or ordinances.

RULE IV SESSIONS

SECTION 8. REGULAR SESSIONS The regular session of the Sangguniang Bayan of


Isulan shall be every Wednesday of each week of the month, at such time and place as the formal
notice thereof shall stipulate, or as may be decided (at exactly 9:00 a.m. at the S.B. Session Hall) or
unless otherwise stipulated by a majority of the members of the Sanggunian.

SECTION 9. SPECIAL SESSION As often as necessary, when public interest so demands,


special session may be called by the Local Chief Executive or a majority of the members of
Sanggunian.

In special sessions, a written notice to the Sanggunian members, stating the date, time and
purpose of the session, shall be served personally or left with a members of the household of the
member at his usual place of residence at least 24 hours before special session is held. Unless
otherwise agreed upon by two thirds (2/3) votes of the members present, there being a quorum, no
other matter may be considered at a special session except those stated in the notice.

The Memorandum of the LCE for the conduct of the special should be attached to the notice of
the special session.

SECTION 10. CALL TO ORDER The Presiding Officer shall open the session by calling
the Sanggunian to order.

At the beginning of each session, a prayer or at that discretion of the Presiding Officer, an
invocation by any of the Sangguniang Bayan member shall be observed followed by the singing of the
National Anthem and the Isulan Hymn. .

SECTION 11. ATTENDANCE IN THE SESSION Every member of the Sanggunian shall
be present in all sessions, unless expressly excluded by it or necessarily prevented from doing so by
sickness or other unavoidable circumstances duly reported to the Sanggunian through the secretary.

The report shall be made in advance or prior to the conduct of the session whether in regular or
special session.

SECTION 11-A DISCIPLINARY MEASURE pursuant to Chapter 3, Sec. 50 (5) of the


R.A. No. 7160 is quoted hereunder, to wit:

The discipline of members for disorderly behavior and absences without justifiable cause for four (4)
consecutive session, for which they may be censured, reprimanded, or excluded from the session,
suspended for not more than sixty (60) days, or expelled. Provided, that the penalty of suspension or
expulsion shall require the concurrence of at least two-thirds (2/3) votes of all the sanggunian
members. Provided further, that a member convicted by final judgment to imprisonment of at least one
(1) year for any crime involving moral turpitude shall be automatically expelled from the sanggunian.

SECTION 11-B MEMBERS ON OFFICIAL BUSINESS OUTSIDE THE STATION


UPON RETURN SHALL RENDER REPORT OF THE TRAVEL. Any member who is on official

travel to attend training or seminar upon his/her return should render oral report on the
training/seminar attended.

SECTION 12. OPEN TO PUBLIC Section 12. Open to Public Sanggunian sessions or
meetings of any committee thereof shall be opened to the public unless a closed session is decided or
ordered by an affirmative vote of a majority of the members present, there being a quorum, in the
public interest for reasons of security, decency, or morality of Sanggunian or any of its members or
when confidential matters are being considered. No two (2) sessions, regular or special maybe held in a
single day.

On a motion to hold a closed session duly approved, the Presiding Officer shall direct the
session hall cleared and doors closed.

Only the secretary and such other persons are specifically authorized by the Sanggunian shall
be admitted to the closed sessions. They shall preserve the secrecy of whatever may be read or said at
the session.

SECTION 13. SUSPENSION AND ADJOURNMENT OF THE SESSION Sessions of the


Sanggunian shall not be suspended or adjourned except by direction of the Sanggunian itself or the
Presiding Officer may, in his discretion, declare a recess of short intervals.

SECTION 14. OPENING AND ADJOURNMENT OF THE SESSION TO BE ENTERED


IN THE MINUTES. The exact hour of opening and adjournment of a session shall be entered in the
minutes.

RULE V ROLL CALL & QUORUM

SECTION 15. QUORUM A simple majority or at least 6 members of the sanggunian


including the vice mayor who have been elected and qualified shall constitute a quorum to transact
official business. Should a question of quorum be raised during session, the presiding officer shall
immediately proceed to call the roll of the members and thereafter announce the results.

SECTION 16. ABSENCE OF QUORUM When there is no quorum, the presiding officer
may declare recess until such time that a quorum is constituted, or a majority of the members present
may adjourn from day to day and may compel the immediate attendance of any member absent without
justifiable cause by designating a member of the sanggunian, to be assisted by a member or members
of the police force assigned in the territorial jurisdiction of the local government unit concerned, to
arrest the absent member and present him/her at the session.

If there is still no quorum despite the enforcement of the immediately preceding subsection, no
business shall be transacted. The presiding officer, upon proper motion duly approved by the members
present, shall then declare the session adjourned for lack of quorum

SECTION 17. MOTION TO ADJOURN VACATES CALL At any time after the roll call
has been completed, a motion to adjourn shall be in order, and if approved by a majority of those
present, all proceeding shall be vacated.

SECTION 18. STANDING COMMITTEES AND AREAS OF RESPONSIBILITY The


Sangguniang Bayan of Isulan shall elect the Chairman and members of the following standing
committees and Areas of Responsibility, the general jurisdiction of which shall be as hereunder
provided:

as Vice Chairman and the other as secretary of the committee.

1. COMMITTEE ON EDUCATION, ARTS, CULTURE AND HISTORICAL AFFAIRS

All matters or questions pertaining to or connected with the following are referred to this
committee:
- Formal and non-formal education
- Educational facilities
- Promotion of Culture and Arts
- Operation of Educational Institutions (both public and private)
- Naming of municipal streets
- All matters related to education, culture and historical affairs

2. COMMITTEE ON FINANCE, BUDGET APPROPRIATION AND WAYS AND MEANS

All matters or questions pertaining to or connected with the following are referred to this
committee:
- Local taxes, fees and charges
- Loans and other sources of local revenues
- Annual and Supplemental budgets
- Appropriation Ordinances
- All other matters related to local taxation and fiscal administration
- Study the revision of tax measures and generation of other revenue sources and forms of
revenue from both public and private sector
- Codification of Revenue Ordinances

3. COMMITTEE ON LAWS, RULES AND ORDINANCES

All matters or questions pertaining to or connected with the following are referred to this
committee:
- Sanggunian Internal Rules and violations thereof
- Order of Business and Calendar of Business
- Disorderly conduct of members and investigation thereof
- Privileges of members
- Enactment, revision of amendment of all kinds of ordinances except appropriation
ordinances
- Exercise of legislative powers (taxing power, police power, corporate powers and
propriety rights)
- Legality of proposed measures to be acted upon by the Sanggunian
- Review of ordinances and certain resolutions submitted by the barangay

4. COMMITTEE ON PEACE AND ORDER, HUMAN RIGHTS AND PUBLIC SAFETY

All matters or questions pertaining to or connected with the following are referred to this
committee:
- Human Rights
- Prevention of Human Rights Violation
- Police Matters
- Maintenance of Peace and Order
- Protective Services
- Traffic Rules and Regulations
- Fire prevention and control measures
- Public morality
- All other matters related to peace and order and public safety
- All other matters affecting human rights

5. COMMITTEE ON ZONING, PUBLIC WORKS AND LAND USE/HOUSING

All matters or questions pertaining to or connected with the following are referred to this
committee:
- Construction, maintenance and repair of roads, bridges and other government
infrastructure projects
- Measures which pertain to drainage and sewerage system and similar projects
- Subdivision development/real estate development
- Measures pertaining to land uses
- Zonification or zoning code enactment
- All other matters related to land utilization
- All other matters related to public works and infrastructure projects
- All other matters related to housing

6. COMMITTEE ON GOOD GOVERNMENT AND LABOR AND EMPLOYMENT

All matters or questions pertaining to or connected with the following are referred to this
committee:
- Organization and management, personnel administration, position classification and pay
plan, staffing patterns
- Creation of positions
- Policy formulation for the economical, efficient and effective local government
administration
- Conduct and Ethical Standards for local officials and employees
- Public Accountability of local officials and employees
- All other matters related to good governance
- Labor and employees welfare (both public and private)
- All other matters related to labor and employment
- Enhancement of relationship and good working condition of employer-employee
relationship in the private sector

7. COMMITTEE ON SOCIAL SERVICES AND CHILDRENS WELFARE

All matters or questions pertaining to or connected with the following are referred to this
committee:
- Social Welfare Services
- Squatter problems
- All other matters related to Childrens Welfare
- Senior Citizens

8. COMMITTEE ON HEALTH, SANITATION AND NUTRITION

All matters or questions pertaining to or connected with the following are referred to this
committee:
- Health Sanitation and Hygiene
- Cleanliness and beautification of the community
- Proposed measures related to hospitals, health centers and health programs
- All measures related to hospitals, health centers and health programs

9. COMMITTEE ON ECONOMIC ENTERPRISE, TRADE AND INDUSTRY/TOURISM

All matters or questions pertaining to or connected with the following are referred to this

- Administration/operation of the economic enterprise

- Enactment/revision of the Market Code

- Agricultural facilities
- Development program of agri-business enterprises
- Accreditation of any NGOs, Pos and other duly organized groups in accordance with
existing laws
- All matters affecting the cooperative development programs of the government
- All matters related to agricultural including plants and animals

11. COMMITTEE ON TRANSPORTATION, COMMUNICATION AND ENERGY

All matters or questions pertaining to or connected with the following are referred to this
committee:
- Operation of PUV/PUJ including tricycles, trisikads and pedicabs
- Operation of public and private communication facilities including but not limited to
television stations, radio stations and cable operations
- All other matters related to transportation and communications

12. COMMITTEE ON YOUTH AND SPORTS

All matters or questions pertaining to or connected with the following are referred to this
committee:
- Sports development
- Youth welfare and development
- All other matters related to youth and sports

13. COMMITTEE ON WOMEN AND FAMILY

All matters or questions pertaining to or connected with the following are referred to this
committee:
- Womens welfare, rights and privileges
- Womens organization
- Family welfare
- All other matters related to women and family

14. COMMITTEE ON MUSLIM AFFAIRS AND CULTURAL COMMUNITIES

All matters or questions pertaining to or connected with the following are referred to this
committee:

- All matters related to cultural communities including Muslims

15. COMMITTEE ON BARANGAY/COMMUNITY AFFAIRS

kinds of games and amusements
- All other related matters related to game and amusement

17. COMMITTEE ON ENVIRONMENTAL PROTECTION AND PRESERVATION


All matters or questions pertaining to or connected with the following are referred to this
committee:
- Environmental Protection
- Air and Water Pollution
- Wanton destruction of the environment and its natural resources
- All other matters or measures affecting the environment

18. COMMITTEE ON ACCREDITATION

All matters or questions pertaining to or connected with the following are referred to this
committee:
- Accreditation of any NGOs, Pos and other duly organized groups in accordance with
existing laws

SECTION 19. LIMITATIONS No Sanggunian member shall be a chairman, of more than


two (2) standing committees.

The regular Presiding Officer and the Sanggunian shall have a voice in all committee
deliberations.

No member of a committee shall act upon or participate in any matter in which he has a special,
direct, pecuniary and substantial interest.

SECTION 20. SPECIAL COMMITTEE The Sanggunian may organize special


committees, as it may deem necessary. The officers and members of special committees shall likewise
be elected by the majority vote of all sanggunian members.

SECTION 21. VACANCY Whenever vacancy occurs or is declared to exist in any of the
committees, the same shall be filled by election of the Sanggunian.

SECTION 22. COMMITTEE MEETING OR HEARINGS The committees shall


determine the frequency of their meetings or hearings, provided that they will act on referred matters
within 30 days. A majority of all members of the committee shall constitute a quorum. Committee
hearings or meetings shall be held only in a public building. All members shall be invited in any
committee hearings.

SECTION 23. COMMITTEE REPORTS AND ORDERS Committee reports and/or


orders on any ordinance or resolution shall be considered in formal meetings and shall not be

submitted to the sanggunian unless accompanied by the minutes of the meeting or hearing of the
committee which adopted them.

When a committee submits a report, the members thereof shall be presumed to have concurred
in the report and shall be precluded from opposing the same, unless they have entered their objection
thereto during the committee meeting or hearing.

RULE VI ORDER AND CALENDAR OF BUSINESS

SECTION 24. ORDER OF BUSINESS The order of business for every session of the
sanggunian shall be:

a. Call to order
b. Invocation
c. National Anthem
d. Councilors Creed
e. Isulan Hymn
f. Roll Call
g. Reading and adoption of the minutes of the previous session
h. Privilege Hour
i. First reading and referral to committees of proposed ordinances, resolutions, messages,
communications, petitions, and memorials.
j. Committee reports
k. Calendar of business
1) Unfinished Business
2) Business of the day
3) Unassigned business
l. Proposed ordinances and resolutions for second and third reading.
m. Adjournment

SECTION 25. ADOPTION OF THE MINUTES The minutes of the previous session shall
be submitted to the sanggunian for adoption.

SECTION 26. CALENDAR OF BUSINESS The calendar of business shall consist of the
following parts:

a. Unfinished Business business being considered by the sanggunian at the time of its
adjournment. Its consideration shall presume until such time that the unfinished business is
disposed of. Thereafter, the presiding officer shall call for the business of the day.
b. Business of the day proposed ordinances, resolutions and other measures set on the calendar
for consideration.
c. Unassigned business proposed ordinances, resolutions and other measures reported out by
committees but not calendared earlier. Any business included in this part of the calendar may be
set for consideration on motion of a member with unanimous approval of the sanggunian
members present at a session, there being a quorum.

SECTION 27. DISTRIBUTION OF CALENDAR OF BUSINESS The calendar of


business shall be distributed one day before the session, unless there is no addition to the one
previously distributed, in which case a note to this effect on the order of business shall be sufficient.

RULE VII ORDINANCES AND RESOLUTIONS

SECTION 28. ORDINANCES AND RESOLUTIONS DISTINGUISHED Legislative


actions of general and permanent character shall be enacted in a form of ordinances while those, which
are of temporary character shall be passed in a form of a resolution. Matters relating to propriety
functions and to private concerns shall also be acted upon by resolution.

SECTION 29. ESSENTIAL PARTS OF ORDINANCES AND RESOLUTIONS Proposed
ordinances and resolutions shall be in writing and shall contain an assigned number, a title or caption,
an enacting or ordaining clause and the data of its proposed effectivity. In addition, every proposed
ordinance shall be accompanied by a brief explanatory note containing the justification for its
approval. It shall be signed by the author or authors and submitted to the secretary who shall report the
same to the sanggunian in its next session.

SECTION 30. FIRST READING The Secretary shall report all proposed ordinances,
resolutions, memoranda and all communications to the Sangguniang Bayan members during the
session.

After the first reading, the proposed measure shall be referred to the proper committee for
study, comment and recommendation. No debate shall be allowed at this stage.

Only the chairman or vice chairman of the committee to which a proposed ordinance/resolution
was erroneously referred, as well as the chairman or vice chairman of the committee claiming
jurisdiction over the proposed ordinance or resolution may move that the referral be declared erroneous
and ask for its correction. However, the Presiding Officer may motu propio rectify an erroneous
referral.

SECTION 31. PERIOD TO REPORT The Committee shall submit a written report on the
proposed ordinance or resolution within thirty (30) days after it has been referred to it. Failure to act by
the committee upon the 30-day reglementary period and 15 days grace period would mean approval of
the proposed measure on committee level and a written report shall be prepared and which will be
subjected to the plenary for deliberation under second reading.

If the committee report on a proposed ordinance or resolution is favorable, it shall be included


in the calendar of business.

If the committee action on a proposed ordinance or resolution is unfavorable, it shall be laid on


the table and within, ten (10) days notice of the action taken will be furnished the author or authors
concerned stating the reason or reasons for such action; provided, that within five (5) days after receipt
of the notice, the sanggunian may reconsider the committee recommendation.

SECTION 32. URGENT MEASURES Any legislative matter duly certified by the Local
Chief Executive as urgent, whether or not it is included in a calendar of business, maybe presented and
considered by the sanggunian in the same session without need of suspending the rules. The
sanggunian likewise, may, on motion made by the chairman or vice chairman of the committee
concerned, consider a proposed ordinance or resolution as urgent and consideration thereof shall be
scheduled according to a time table.

If said motion is approved by 2/3 votes of the members constituting a quorum, the sanggunian
shall prepare a detailed time table fixing the date on or before which the proposed ordinance or
resolution must be reported by the committee concerned, the number of days or hours to be allotted to
the consideration of the measure on second reading, and the date or hour at which proceedings must be
concluded and final vote on said measure taken.

SECTION 33. SECOND READING AND DEBATE No proposed ordinance or resolution


shall be considered on second reading in any regular session unless it has been reported out by the
proper committee to which it was referred or certified as urgent by the Local Chief Executive.

On the day set for the consideration of a proposed ordinance or resolution for second reading
the same shall be read in full with the amendments proposed by the committee. If any, unless copies
thereof have been distributed earlier and such reading is dispensed with. Thereafter, the proposed
ordinance or resolution shall subject to debate and pertinent motions.
During the second reading, the principal author of the proposed measure shall deliver a
sponsorship speech not exceeding 10 minutes.

SECTION 34. DEBATE AND CLOSURE OF MEMBERS In the discussion of any
measure, a motion to close the debate shall be in order after two speeches for and one against, or after
only one speech for has been delivered and none entered against it.

When several members have registered or signified their intention to speak on the matter under
consideration and when said matter has been sufficiently and thoroughly discuss by the member
speaking, the Presiding Officer, motu propio, or upon motion of a member, order that a member having
the floor shall desist from speaking further so that other members may not be deprived of their
opportunity to speak.

SECTION 35. FIVE MINUTES RULES After the close of debate, the sanggunian shall
proceed to the consideration of committee amendments. A member who desires to speak for or against
an amendment shall have only five (5) minutes to do so.
The five minutes rule shall apply, likewise, in the consideration of an amendment to an
amendment, or an amendment by substitution.

SECTION 36. APPROVAL OF MEASURE ON SECOND READING The sanggunian


secretary shall prepare copies of the proposed ordinance or resolution in the form it was passed on
second reading and shall distribute to each sanggunian member a copy hereof, except that measure
certified as urgent by the Local Chief Executive or the sanggunian maybe submitted for the final
voting immediately after debate and/or amendments during the second reading.

After the amendments have been acted upon, the proposed ordinance or resolution shall be
voted on second reading.

SECTION 37. THIRD READING A proposed ordinance or resolution approved on second


reading shall be included in the calendar under third reading.

No ordinance shall be approved unless it has passed three readings, the copies thereof in its
final form have been distributed to the members at least three (3) days before its passage, except when
the local chief executive or the sanggunian certifies to the necessity of its immediate enactment to meet
a public calamity or emergency. Upon the third reading of a proposed ordinance or resolution, no
amendment thereto shall be allowed, and the vote thereon shall be taken immediately thereafter and the
ayes and nays entered in the minutes.

SECTION 38. APPROVAL OF RESOLUTION A resolution shall be passed in the same


manner prescribed for ordinances, except that it need not go through a separate third reading for final
consideration unless decided otherwise by a majority of all sanggunian members.

SECTION 39. MAJORITY REQUIREMENT No ordinance or resolution passed by the


sanggunian shall be valid unless approved by a majority of the members present, there being a quorum.
Any ordinance or resolution authorizing or directing the payment of money or creating liability shall
require the affirmative vote of a majority of all the sanggunian members for its passage.

Upon the passage of all ordinances or resolutions the sanggunian secretary shall record the ayes
and nays. Each approved ordinance or resolution shall be stamped with the seal of the sanggunian and
recorded in a book kept for the purpose.

SECTION 40. SPECIAL PROVISION ON THE BUDGET ORDINANCE The


sanggunian shall in no case increase the appropriation of any project or program of any office of the
municipality over the amount submitted by the local chief executive in his budget proposal.

After the local chief executive shall have submitted the annual general appropriation measure,
supplemental appropriation measures shall be considered only if supported by actual available funds as
certified by the local treasurer or by funds to be raised by corresponding revenue proposals included
therein.

SECTION 41. APPROVAL BY THE LOCAL CHIEF EXECUTIVE Every ordinance or
resolution passed by the sanggunian shall be forwarded to the local chief executive for approval. The
local chief executive shall affix his initials on each in every page of the ordinance or resolution and the
word approved shall appear with his signature on the last page thereof.

Within ten 10) days in the case of local units after receipt of the ordinance or resolution, the
local chief executive shall return the said ordinance or resolution to the sanggunian with either his
approval or his veto. If he does not return it within that time, the ordinance or resolution shall be
deemed approved.

SECTION 42. VETO POWER OF THE LOCAL CHIEF EXECUTIVE The local chief
executive may veto any ordinance or resolution on the ground that it would be ultra vires or prejudicial
to the public welfare particularly stating his reasons therefore in writing.
The local chief executive shall have the power to veto any particular item or items of an
appropriation ordinance, or of an ordinance or resolution directing the payment of money or creating
liability. In such case, the veto shall not affect the items/s which is/are not objected to. The vetoed
item/s shall not have affect unless the sanggunian overrides the veto in a manner hereunder provided:
otherwise the item/s in the appropriation ordinance of the previous year corresponding to those vetoed
shall be deemed reenacted.

The sanggunian may override the veto of the local chief executive concerned by two thirds
(2/3) vote of all its members, thereby making the ordinance or resolution effective.

The local chief executive may veto an ordinance or resolution only once.

SECTION 43. ENFORCEMENT OF DISAPPROVED MEASURES Any attempt to


enforce, promulgate or execute any ordinance, resolution or executive order after the disapproval
thereof shall be sufficient ground for the suspension or dismissal of the officer making such attempt.

SECTION 44. EFFECTIVITY OF ENACTMENTS Unless otherwise stated in the


ordinance or resolution, the same shall take effect after the lapse of ten (10) days from the date a copy
thereof is posted in the board at the entrance of the (Municipal Hall) and in at least two (2) other
conspicuous places, such as the public market and church.

Not later than five (5) days after the passage of the ordinance or resolution, the sanggunian
secretary shall cause the posting thereof in English together with a copy translated in the dialect use by
the majority of the people in the area, and shall record such fact in a book kept for the purpose, stating
the dates of approval and posting thereof.

RULE VIII THE DECORUM AND DEBATE

SECTION 45. MANNER OF ADDRESSING THE CHAIR When a member desire to


speak, he shall respectfully address the chair, Mr. Chairman or Mr. Presiding Officer.

SECTION 46. RECOGNITION OF MEMBER TO SPEAK. As general rule, no members


shall speak before the sanggunian without first obtaining the floor.

When two or more members wish to speak at the same time, the presiding officer shall
determine and recognize the member who is to speak first.

SECTION 47. TIME LIMIT FOR SPEECHES No member shall occupy more than 15
minutes in debates in any question or speak for more than once on any question without leave of the
sanggunian, except as hereinafter provided. The period of interpellation shall not be counted against
the time or the member speaking.

SECTION 48. SPONSOR TO OPEN AND CLOSE DEBATE The members reporting a
measure under consideration from a committee may open and close the debate thereon.

If the debate shall extend beyond session day, he shall be entitled to an additional 15 minutes to
close.

SECTION 49. DECORUM TO OPEN AND CLOSE DEBATE In all cases the member
who has obtained the floor shall confine himself to the question under debate, avoiding personalities.
He shall refrain from uttering words, or performing acts which are inconsistent with decorum.

It is requested that a member be called to order for words spoken in debate, the member making
such request shall indicate the words exempted to, they shall be taken down in writing by the secretary
and read aloud. The member who uttered such words shall not be held to answer, nor the subject to
censure by the sanggunian if further debate or other business has intervened.

All questions to the speaker or member having the floor must always be coursed through to the
presiding officer.

SECTION 50. CONDUCT DURING SESSIONS During the session, the members shall be
in proper attire and observe proper decorum.

Sanggunian Bayan attire during the session:

The member shall come to the session in formal attire particularly long sleeve barong for male
and any executive formal attire for female for all regular sessions and for special sessions any Sundays
Best attire for both male and female.

While the Presiding Officer is addressing the sanggunian or putting a question or while the
session is on progress, no member of the sanggunian shall leave the session hall without seeking
permission from the chair.

The use of the cellphone shall be regulated in order not to obstruct the proceedings of the
session and if possible, the cellphone shall be put in a silent mode.

SECTION 51. DISCIPLINE OF MEMBERS The sanggunian may punish its members for
disorderly behavior and with the concurrence of two thirds (2/3) votes of all its members, suspend or
exclude from the session a member, but if the penalty is suspension, this shall not exceed sixty (60)
days.

There shall be a fine of One Hundred Pesos (P100.00) for every late and Five Hundred Pesos
(P500.00) for every unjustifiable absence incurred by the member during the session as well as One
Hundred Pesos (P100.00) for leaving the session hall without permission from the presiding officer and
One Hundred Pesos (P100.00) for not in proper attire which shall accrue to the revolving fund of the
office of the Sangguniang Bayan.
SECTION 51-A Carrying of firearms is strictly prohibited within the premises of the
Sangguniang Bayan Office.

RULE IX VOTING AND MOTIONS

SECTION 52. Voting in the Sanggunian shall be done by voice, raising of hand, rising, or by
roll call, unless a different method is prescribed by the Sanggunian for a particular question. In taking
the vote, the affirmative shall be taken first and then the negative.
SECTION 53. To pass an ordinance or any proposition creating an indebtedness, the
affirmative vote of a majority of all members of the Sanggunian is necessary. Other measures, except
as otherwise specially provided, shall prevail upon the majority vote of the members present at any
meeting duly called and held.
SECTION 54. A tie vote defeats any measure or motion except an appeal from the decision of
the Chair which shall be considered sustained by a tie vote.

SECTION 55. The presiding officer shall rise to put a question into a vote by saying, As
many as are in favor of (stating the question), say Yes, and after the affirmative vote is expressed, As
many as are opposed, say No. If the Chair doubts the vote or if a division is called, the body shall
divide. Those in the affirmative shall be asked to either raise a hand or rise from their seats, and then
those in the negative to do the same. In any case, the presiding office shall rise to state the decision.
SECTION 56. The yes and no votes shall be taken and entered in the minutes upon the passage
of all ordinances, upon all propositions creating any liability against the municipality, and upon any
other proposition if requested by any member, even after a division has been had.
SECTION 57. When voting nominally, the secretary shall call the roll of members of the
Sanggunian in alphabetical order, and, as each name is called, the member shall announce his vote by
saying Yes or No, as the case may be, or Abstain or Present, if he is not voting. A member may explain
his vote not to exceed three minutes.
SECTION 58. After the roll has been called, when voting nominally, the secretary shall again
call in their alphabetical order the names of those not voting in order that they may vote. After this
second calling of the roll, no request shall be entertained by the Chair to record a vote.
SECTION 59. When an ordinance or any measure directing the payment of money or creating
liability against the municipality is passed by general consent, the secretary shall enter in the minutes
the names of all the members present at that particular time, this having the effect of nominal voting.
SECTION 60. No member can vote on a question in which he or any member of his family,
within the third degree of consanguinity or affinity, has a direct or personal pecuniary interest. This
does not, however, preclude any member from voting for himself for any position within the
Sanggunian.
SECTION 61. A member may change his vote only before the Chair announces the result of
the voting and if his vote can be identified by the mode of voting; thereafter, a member may change his
vote only by majority vote of the members present.
SECTION 62. A member who arrives late at the meeting shall be permitted to vote, provided
the result of the voting has not been announced yet by the Chair.
SECTION 63. No motion, except on the presence of a quorum, shall be entertained during the
voting.
SECTION 64. WHO MAY MOVE When a motion, report or proposed measure is adopted
or lost, it shall be in order for a member who votes with the minority to move for the reconsideration
thereof on the same or succeeding session day. Such motion shall take precedence over all questions
except a motion to adjourn or raise a question of privilege and a call to order.

SECTION 65. RECORDING OF MOTIONS Every motion shall be entered in the minutes
with the name of the member making it unless it is withdrawn.

SECTION 66. READING AND WITHDRAWAL OF MOTIONS When a motion is made,


the presiding officer shall state it before being debated. Except as herein otherwise provided, a motion
may be withdrawn any time before its approval or amendment

SECTION 67. PRECEDENCE OF MOTION When a question is under debate, no motion


shall be entertained except to adjourn, raise a question of privilege, declare a recess, lay on the table, or
postpone to a certain day (which motions shall be decided without debate) refer, and or postpone
indefinitely (which motion shall be decided subject to the five minute rule). Said motions shall have
precedence in the foregoing order. No motion to postpone to any day certain or refer or postpone
indefinitely, having failed passage, shall again be allowed on the same day.
SECTION 68. AMENDMENTS When a motion or proposition is under consideration., a
motion to amend shall be in order. It shall also be in order to offer further amendment by substitution,
but it shall not be voted upon until the original motion of proposition is perfected. Any of said
amendments may be withdrawn before a decision is had thereon.

SECTION 69. RIDER PROHIBITED No motion or proposition on a subject different from


that consideration shall be allowed under the color of amendment.

SECTION 70. MOTION OF COVER ONE SUBJECT MATTER No motion shall cover
more than one subject matter.

SECTION 71. AMENDMENT OF TITLE Amendments to the title of a proposed ordinance


or resolution shall not be in order until after the test thereof has been perfected. Amendments to the
title shall be decided without debate.

SECTION 72. CALL TO ORDER A motion to read any part of the rules is equivalent to a
call to order and takes precedence over any motion other than to adjourn.

SECTION 73. QUESTION OF PRIVILEGE - question of privilege are:


a.) Those affecting the rights of the Sanggunian: its safety, dignity and the integrity of its
members.
b.) Those affecting the rights. Reputation and conduct of the members, individually in their
capacity as such member.

Subject to the five- minutes rule, questions of privilege shall have precedence over all other
questions, except a motion to adjourn.

SECTION 74. PRIVILEGE QUESTIONS Privilege questions are those motions or subject
matters which under the rules, take precedence over other motions and subject matters

RULE X SUSPENSION OF THE RULES

SECTION 75. WHO CAN MOVE Any member can move for the suspension of the rules.

SECTION 76. VOTE REQUIRED - No rule shall be suspended except by the vote of
the two thirds (2/3) of the members constituting a quorum.

SECTION 77. INTERRUPTION OF MOTION When a motion to suspend the rules is


pending, one motion to adjourn may be entertained. If it is lost no similar motion shall be entertained
until the vote is taken on the motion to suspend.

SECTION 78. EFFECT OF SUSPENSION If the sanggunian votes to suspend the rule, it
shall forthwith precede to consider the measure. A two-third (2/3) vote of the members present shall be
necessary of the passage of said measure, a quorum being present.

RULE XI MISCELLANEOUS PROVISIONS

SECTION 79. AREA OF RESPONSIBILITY There shall be an assigned Sanggunian


Bayan Member for every barangay as his/her area of responsibility in the municipality of Isulan which
shall be subjected to change every year, to wit:
