The Provision of Early Learning and Childcare (Mandatory

Amount) (Scotland) Order 2017

Made 27th August 2017

Coming into force 1st January 2018

The Scottish Ministers make the following Order in exercise of the powers conferred by section 48(2)
of the Children and Young People (Scotland) Act 2014(a).

In accordance with section 99(2) of that Act, a draft of this instrument has been laid before and
approved by resolution of the Scottish Parliament.

Citation and commencement

1. This Order may be cited as the Provision of Early Learning and Childcare (Mandatory Amount)
(Scotland) Order 2017 and comes into force on 1st January 2018.

Amendment of section 48
2. In section 48(1)(a) of the Children and Young People (Scotland) Act 2014, for 600 substitute
1300.

 EXPLANATORY NOTE
(This note is not part of the Order)
This Order amends the Children and Young People (Scotland) Act 2014 to mandate that local
authorities provide the equivalent of 25 hours of childcare per week (1300 hours per year) for
eligible pre-school children, as defined in section 47(2) of that Act.
