We write on behalf of the Association and Chief James Hunt Although you did not call back after your Township Committee meeting last week as we had discussed, we heard that your governing body did, in fact, introduce the proposed ordinance establishing a police committee. That proposed ordinance is defective as a matter of law, and our office has been authorized to take action if it is adopted. The more glaring defects include the following provisions: ‘The positions of officer and sergeant are mentioned, but there is no number or range; ‘The ordinance expressly provides that an officer is subordinate to the chief could be named to your "Police Committee," leaving the chief in a position where he reports to a subordinate; © The "Police Committee" is being given a role in "the discipline of [Department] employees"; ‘+ The "Police Committee" is being given a role in assignments [e.g., "to ensure that the Police Department makes the best use of ... personal ...
