MOTION FOR CONTINUANCE

Comes now defendant Richard Jerry McLeod who requests a continuance for the following

reasons:

1. Defendant has been deprived of ALL of his discovery documents as these documents were

Seized and presumably destroyed by Mike Dewey, sheriff and his deputies as described in

his request for replacement of these documents and other private papers (attached hereto as

new motion for discovery (A) and a copy of complaint for damages filed against Mike

Dewey et. al. Exhibit B.

2. The initial request for discovery did not include all documents requested

3. The seizure and destruction of defendant McLeods discovery documents and private papers

is an unprecedented act of egregious prosecutorial misconduct designed to gain a tactical

advantage for the prosecutor and deprive McLeod of a fair trial,

THEREFORE; Defendant requests the trial be continued until the prosecutor provides McLeod

With all of the requested discovery documents and the return of his private papers, AND that

McLeod be provided a reasonable time to review and organize the discovery materials to enable

him to prepare an adequate defense.
